A WOMAN convicted of assaulting young children has failed to persuade top judges her trial was unfair because too few Muslims were on the jury.

Ruba Talib, aged 42, of Briarwood, Runcorn, Cheshire, claimed it was wrong for her to go before a jury at Chester Crown Court as there were not enough Muslims in the area and on her panel.

A MEMBER of Melbourne's notorious Haddara clan shot his cousin in error during a bungled attempt to blast a member of the rival Chaouk family, an out-of sessions hearing heard late last night.

Two brothers and their cousin faced the court in relation to the drive-by shooting of teenage victim Sabet (Sam) Haddara last June after tailing him as he returned from a trip to the local shops.

The 18-year-old was shot in the neck during the ambush in Altona North after he pulled over, with police alleging six shots were fired at him. One lodged in his neck.

Advertisement: Story continues below Waleed Haddara, 26, was charged with multiple offences, including attempted murder, kidnapping and possession of firearms and a silencer.

His brother Fadi, 23, and his cousin Saad 28, also faced the hearing on multiple offences including recklessly cause injury. All were refused bail and remanded to appear in the Melbourne Magistrates Court on Monday.

The hearing was told that a driver in the car with Waleed Haddara heard him say on the phone, ''Is it Matwali?'' and later said ''I'm going to kill him.''

Matwali Chaouk is a member of a family involved in a blood feud with the Haddaras.

Waleed then allegedly said: ''I'll show you how it's done'' and fired at the car his cousin was in until the chamber was spent.

Detective Sergeant Pixie Fuhrmeister said it was all a case of mistaken identity.

''Investigators believe he shot his own cousin by mistake,'' she said.

The three were arrested yesterday during raids on properties in Altona, Altona North, Seabrook, Caroline Springs, Williamstown North and Hoppers Crossing.
