Wow, what a blow to Gillard and Bowen! Angus Houston has reported to the government that the deal with Malaysia needs more work and that the government should IMMEDIATELY increase capacity at Nauru and Manus Island. Now we wait to see if Gillard will finally cave in and bring back elements of the Pacific Solution that have been proven to work - offshore processing, TPV's, turning back boats, etc. Time for Gillard and Bowen to admit they screwed up and do the right thing quick smart!

So called refugees are not freemen as defined under the constitution (Citizens) and therefore have no rights or protection under Australian law... :) :)

This is the first time we've heard a non-politicised report on the issue, and one I'm inclined to take seriously.

Biggest losers here are the greens IMO.  Its a classic case where pragmatism rules ideology.

Labor will cope flack for changing tact and following the report, but so will Abbott if he opposes any recommendations.

This report should not guide our politicians - the constitution should...the Parliament subject to the constitution...not a panel of outsourced experts...If they implement anything that undermines the constitutional rights of freemen they can be sued or challenged in the High Court... :) :)

But refugees are not freemen and not entitled to the protection of Australian law... :) :)

you've got to love how the media writes this up ... yes they agreed we should reopen Manus Island & Nauru, something the ALP had already put on the table, but they aslo said the Malaysia solution was good and only needed some extra work in sofar as ...

'' safeguards and accountability" of the deal "as a basis for the Australian parliament's reconsideration of new legislation ..."

The panel also recommended future asylum seekers not be eligible to sponsor family members to come to Australia under the Special Humanitarian Program

"The report recommends offshore processing on Nauru and Manus Island. This has always been ALP policy but Tony Abbott wouldn't agree to it."

Lets not forget TPVs and virtually everything about Howards Pacific Solution and Malysia - once the conditions are approved.

it is a real slap in the face to Gillard. It essentially say that the coalition are right and the ALp dead wrong and the Greens even 'wronger'.

so let's see what Gillard has said... she will support ALL of the recommendations which are essentially the Pacific Solution and the possibility of Malaysia sometime in the future.

So this is how Gillard says 'oops, I was wrong'? get a committee designed the get a result yu want and then implement it because 'experts decided it'?

Honestly, this woman is a truly appalling leader andn it has now taken 5 years to finally say that Rudd was a fool for stopping it and Gillard is a bigger fool for not re-implementing it until she had no other option.

Malaysia specifically wan't deemed  illegal or wrong. THe problem was that the Immigration Minister did not have the power to send asylum seekers to a country that has no legal obligations to protect them under the legislation as it currently stands.

It would have been exactly the same if the people swap was with Nauru or virtually any other country.

I like how he said, basically, turn back boats where safe to do so. It was not that dissimilar to Abbotts turn back the boats except it was a more defined vague statement if thats possible.

No - that is not correct.  The report does not recommend turning boats back to Indonesia nor does it recommend TPVs.

It does however support a major part of the Green policy - ie increasing intake to 20,000.

thank you for that GM.. this person for some unknown reason has had it in for me for years... the fact is he has been banned on here for it but I am prepared to take it further if thats what he wants..

he has a mouth like a drain.. filthy.he tells the most appalling lies.. things he makes up with the filthy language to go with it..I steer clear of him with a ten foot barge pole but have no intention of ignoring this again.. been there done that.

This forum does suffer from fairly lame moderation especially inthe protection of defamatory comments or abusive behaviour. If you complain to FD he pretends he knows nothing about it, demands you show him evidence and then pretends he didnt see it and then do nothing. The weakest area of this site is PROTECTION of posters from abuse and defamation. and its not hard to fix. It just requires moderators to moderate firmly fairly and without bias.

Those safeguards, etc are things Gillard has refused to include in legislation - because she can't. You can't tell a sovereign country what to do in its own detention centres. It's like us telling (or trying to tell) the Americans what to do at Guantanamo Bay.

If you complain to FD he pretends he knows nothing about it, demands you show him evidence and then pretends he didnt see it and then do nothing. The weakest area of this site is PROTECTION of posters from abuse and defamation. and its not hard to fix. It just requires moderators to moderate firmly fairly and without bias.

where do you come up with this crap? Gillard had already negotiated various extra conditions be met by the Malaysians that they aren't bound to with their own asylum seekers ... if the report feels that she needs to take it further fine, but don't tell me she can't .... you have a habit of making things up don't you?

and that is why malaysia REFUSES to sign the refugee convention as they have no intention of treating them properly. It is also why everyone except Gillard opposed it including many of her own party. And now she doesnt have to use malaysia becaus now suddenly the amazingly effective Howard Solution is going back into place.

Immigration Minister Chris Bowen yesterday warned asylum seekers they could no longer assume that they would be allowed to stay in Australia if they came by boat.

"From this point forward anybody who comes to Australia by boat runs the risk of being transferred to an offshore processing place," he said.


What a joke! Does that mean that previously the government was welcoming these people with open arms?

Also, no one died during the years of the Pacific Solution, but conservative estimates put the death toll under Labor at more than 600 people dead at sea. Clearly, Labor's policy (or lack thereof) has been the least humane in comparison.
