It's also a fallacious argument. He's trying to refute the claims by saying "who do you believe?". It is not a valid refutation.

Apart from the fact that seeking asylum is not illegal, my belief will be formed upon substantiation of claims by both sides........only then.....

People smuggling is a crime

Being a passenger on a people smuggling vessel is not illegal for the purposes of seeking asylum.
