Title: $360 an hour for a solicitor ! Why ?

These are people who produce nothing except some words on a bit of paper and never guarantee their work but charge like wounded bulls. Why do they value their work so much ?

Is it because they have no real competition and have wrangled the system so we can't have competition from abroad ?

They are making money from the misfortunes of others -
putting them in an even worse situation with massive legal bills.

if you know the LAW.. then there is no LAW that says you have to use a lawyer/solicitor..

if you think you are as smart as them... feel free.

I dont think they would be able to charge what they do.. if they were not worth it..

there are rip offs of course like in every walk of life..

but if thats what it costs for someone who knows more than you do..

then get an education...

and see what you will charge when you have your Law degree..

have you been to a dentist lately??????..$250 for 10 min.

jeez i've got an education idiot. It's just that the lawyers in canberra see fit that I should have to compete on the world stage so there is no monopoly for me :(

same thing with the medical profession. They are a protected species too that doesn't guarantee their work, and doesn't have to compete on a world stage

as are all magistrates

as they both must sign an oath of allegiance

if they do not sign this they are not at the bar

any that do not honour the inner workings of

admiralty law , UCC law will and are disbarred ..

thus then and so it is this treachery must be

well renumerated for these masonic band of thieves ,

You should have been allowed to.  It is a discretionary thing ~ the Magistrate/Judge may allow a lay person an opportunity to do something like that.  You struck one in bad mood or you annoyed s/him somehow.

The easy way around it was to hand the statement up to the Magistrate/Judge.

Further, I'm surprised it is 'only' $360.00 an hour now.  When I retired about ten years ago, I was chargeing $300.00 an hour.

No - the solicitor my friend went to told me I couldn't do that
so I checked with a solicitor who is a friend of mine & he agreed -

"you can't read out your mate's statement"

You must have nice magistrates where you live?

I'm surprised the solicitor didn't advise you along the lines of.."it's up to the Magistrates' discretion.....s/he may not allow it......if not allowed, the statement can be handed directly to the Magistrate."

To simply say you are not allowed is incorrect advice.

To my knowledge you have to ask to be 'recognised' as a 'friend of the court'. I would expected to be allowed in the lower courts but it would be unusual and for something specific.

yes, I paid $330 about 9 years ago for a divorce lawyer.
And $360 3 years ago for one of my sons.

And they cannot practice unless they pay their fees to the Law society.  A lawyer went to prison for contempt over not paying his fees, stating that he saw no reason for any real need to do so.  Back in the 90's I think in Malbunistan...

Law is a closed shop....  and only those considered 'ideologically safe' are permitted through the doors.

The question is are those skills worth the money.  I say no.  Not only that, but the entire process that permits such blatant rip-off fees is run by lawyers and their mates who make the rules and constantly extend them to include more and more people who have no real interest in them.

Robbing people with a fountain pen is no less robbery..... you property magnates know that full well.   ;D ;D ;D

The Barrister would have done more than merely read word for word from the Statement.

What was the $1500.00 paid to the Solicitor for?  What did s/he do?

I don't know. Perhaps a no-win-no-fee guarantee would be fair ;)   When I pay for goods I expect to get something that works and is fit for its intended purpose and if it breaks down I expect to get it repaired or replaced !! Some how that rule doesn't apply to high priced legal services :(

I'm assuming (perhaps erroneously) that the Council issued an Infringement Notice with an amount to be paid for the listed offence/s ....or, an option to have the matter dealt with by the court. Clearly your mate chose the latter and I wondered how much difference between the original penalty and the court fine.

You should have been allowed to.  It is a discretionary thing ~ the Magistrate/Judge may allow a lay person an opportunity to do something like that.  You struck one in bad mood or you annoyed s/him somehow.

The easy way around it was to hand the statement up to the Magistrate/Judge.

Further, I'm surprised it is 'only' $360.00 an hour now.  When I retired about ten years ago, I was chargeing $300.00 an hour.


I'm surprised the solicitor didn't advise you along the lines of.."it's up to the Magistrates' discretion.....s/he may not allow it......if not allowed, the statement can be handed directly to the Magistrate."

To simply say you are not allowed is incorrect advice.

I had to pay $330 for an hour with a family law solicitor.

However, the advice I was given was pure gold and saved me a lot of money and angst, sometimes you have to pay for the experience of the person sitting across the table from you.

Good legal advice can save you a fortune as well as cost you one.

Very true - I know of an estate worth $80 grand was not worth contesting but
another one worth $860 grand was - which was subsequently won.

Some years ago a colleague of mine from a previous job was arrested and charged with a very serious crime for which he was innocent (and rather obviously so). It was the case which made me realise that cops are not very bright or very diligent. Anyhow, his lawyer eventually got the charges dropped after proving he was innocent and it cost him $5000 which is a fair bit of money. But he considers it pretty cheap since he was facing a 5 year jail term. Without a trained and experience lawyer he could have had real trouble.

Any profession is worth to you what it saves you from.  What is 5 years jail worth to you?

Unless the dispute is being handled in a Judge Judy type court, losing side in a civil action will be ordered to pay (generally) about 70% of the winners's legal costs and (in some cases) 100% of the winner's legal costs.

No.  It is virtually automatic....in most cases the Judge will initiate it....with a casual comments like, 'Costs?' 

Costs follow the event/cause.  Google it.

I have to admit, I've always considered lawyers overpaid overpriced show ponies who had 3 hour lunches and sat around drinking coffee all day ... a few years ago I moved next to a lawyer, and she works longer hours than anyone else in the complex where I live ....including many Sundays and public holidays

I've since revised my opinion to 'some lawyers are overpaid overpriced show ponies who take 3 hour lunches and drink coffee

mind you, If I could charge $360hr, I'd work as many hours as I could while I could

Because they spend heaps of dosh on an education where they practically have to learn another language and intermediate psychology, and know the law back to front in order to help either prosecute or defend people who break into people's houses in order to fund a heroin addiction. Then they have to be able to represent people who don't know the law enough to put forward a defense or prosecution over some kind of lawsuit. That's why they charge that much.

Now, can I get some fries please.
