Senator Bill Heffernan uses parliamentary privilege to accuse former PM of being alleged paedophile

Liberal senator Bill Heffernan has used parliamentary privilege to accuse an unnamed former prime minister of being an alleged paedophile, while also pointing the finger at the judiciary.

Senator Heffernan has been campaigning for the Royal Commission into Institutional Responses to Child Sexual Abuse to expand its investigation to include the court system.

He told Senate estimates today that he had given the commission "very disturbing" police documents that named at least 28 alleged paedophiles, some of whom are prominent Australians.

But he said the commission had told him it could not investigate the cases because they were outside its terms of reference.

"We have in Australia, sadly, a compromise at the highest of levels. There is a former prime minister on this list and it is a police document, " he told senators.

"It's not so much the secret that's the problem, it's when a group of people, such as the 28 people on this page, keep each other's secrets that the institution is compromised."

Senator Heffernan did not expand on the allegations or provide any further details, instead focusing on what he believed were the failings of the "the institution of the law".

"The treatment in the federal jurisdiction of children by some people in the Family Law Court is disgusting and a disgrace," he said.

Attorney-General George Brandis suggested the royal commission could look into the "grave matters" raised by the senator but said it was ultimately up to the commissioner to decide.

"The royal commission has a process for dealing with complaints and other information brought to its attention and placed into its hands by citizens," he said.

"It is for the royal commission to judge whether, by reference to its terms of reference, that information is something that it should or indeed is capable of inquiring further into."

Liberal senator Bill Heffernan claims he has a police list which names 28 prominent people, including a former prime minister, as suspected pedophiles.

Senator Heffernan didn't name any names but called on Attorney-General George Brandis to expand the child abuse royal commission so that it includes the legal fraternity.

He told a Senate estimates hearing in Canberra on Tuesday he had provided the commission with documents, one naming the alleged pedophiles including "a whole lot of prominent people."

Senator Heffernan is a vociferous campaigner against paedophiles, but his information hasn't always been right.

In 2002 he used parliamentary privilege to falsely accuse a judge of using commonwealth cars to procure young men for sex.

He said there was sadly a compromise at the highest levels.

"There is a former prime minister on this list and it is a police document," he said.

Senator Heffernan said the documents, delivered to him by a police agency some time ago, were very disturbing.

"No one seems to want to deal with them," he said.

"It's not so much the secrets that's the problem. It's when a group such as the 28 people on this page keep each other's secrets."

Senator Heffernan said the Wood royal commission in the 1990s indicated it was going to explore which members of the Sydney legal fraternity used to attend Costellos, the boy brothel club in Kings Cross. The commission, however, did not look into Costellos.

"A lot of them are still practising," he said.

Attorney-General George Brandis said just because someone's name appeared on a list didn't make them guilty.

He advised Senator Heffernan to go to the current child abuse royal commission, which would decide if the information was something it could inquire into.

"We should respect any decision of the royal commission about the ambit and scope of its terms of reference," he said.

PRIME Minister Malcolm Turnbull is under pressure to launch an investigation into elite paedophile rings in Australia, after allegations surfaced of a former prime minister on a police list of suspected paedophiles.

Child sex abuse survivors advocates have backed calls from Liberal Senator Bill Heffernan to expand the royal commission into child sex abuse.
The calls for an urgent inquiry follow the Senator’s sensational claim yesterday that he has a police list which names 28 prominent people, including a former PM, as suspected paedophiles.
Nicky Davis, the leader of the Survivors Network of those Abused by Priests (SNAP) urged the Mr Turnbull to act, saying the government should immediately announce a thorough investigation of elite paedophile rings in Australia, similar to one already underway in the UK.

Prime Minister Malcolm Turnbull must immediately launch an investigation into elite pedophile rings in Australia, says a survivors' network for people abused by priests.

The call follows a claim by Liberal senator Bill Heffernan that he has a police list which names 28 prominent people, including a former prime minister, as suspected pedophiles.

The senator didn't name names but on Tuesday called on Attorney-General George Brandis to expand the child abuse royal commission to include the legal fraternity.

Nicky Davis, the leader of SNAP (Survivors Network of those Abused by Priests) said the government should immediately announce a thorough investigation of elite pedophile rings in Australia, similar to one already underway in the UK.

Senator Heffernan's revelations came as no surprise to many survivors of child sexual abuse, Ms Davis said in a statement early on Wednesday.

'The rape, torture, and murder of Australian kids by those who believe themselves above the law is the real terror threat which demands prompt and effective action above all other issues,' she said.

'Those on the list feel entitled to commit these and other atrocities, secure in the knowledge that damaged victims would never be believed, and their crimes would never be investigated.'

Ms Davis said many survivors of child sexual abuse had approached the royal commission but felt they were not being heard.

Former Prime Minister Margaret Thatcher was aware a Liberal MP was suspected of sexually abusing boys but “turned a blind eye” to it. She awarded a knighthood to Cyril Smith, secret documents, released after a yearlong fight for disclosure, reveal.

"There is no doubt about it now, from what we know, that she [Thatcher] turned a blind eye to people who were quite clearly pedophiles. That is absolutely clear,” said Labour MP Simon Danczuk, who exposed Cyril Smith’s abuse in Parliament.

Smith was investigated in 1970, 1988 and in 1999 on suspicion of "indecent assault against teenage boys" in the 1960s.

At the time, the authorities decided there was no reasonable prospect of conviction.

Later, Greater Manchester Police also admitted there had been “overwhelming evidence” Smith abused boys both physically and sexually.

This didn’t change Thatcher’s decision to knight Smith for his services as a counselor, mayor and MP in Rochdale, Lancashire.

The 19-page dossier on Smith’s knighthood released to the Mail on Sunday, reveal a leading member of the Political Honors Scrutiny Committee, Lord Shackleton, warned Thatcher “the risk that such an award could give rise to adverse criticism.” This is according to one of the letters marked “secret”.

In the same letter, Shackleton said it would be "slightly unfortunate" if this "episode" prevented Smith from receiving the award.

Despite the risk of damaging the “integrity of the honors system,” Thatcher went ahead and awarded a knighthood to Smith in 1988.

The Mail has been demanding to see the dossier on Smith’s knighthood and Downing Street correspondence for a year, but was only allowed to review the secret documents after threats of High Court action.

The government postponed its response several times so the newspaper had to contact the Information Commissioner’s Office. The file was finally provided though several pages were withheld on grounds of national security.

"(The Cabinet Office) have resisted publishing these documents for over 12 months - that's not acceptable,” Danczuk said. "And we now know they are resisting publishing at least four other files relating to historic child sexual abuse.”

The committee sent a letter to the Director of Public Prosecutions asking "whether the case against Mr Smith was not well founded: or whether it was a sound case, but that the evidence was not likely to stand up in court" but no response was received, the Manchester Evening News reports.

Danczuk says the UK government is refusing to publish at least four other files on historic child abuse because it’s worried about what information may be revealed ahead of May's general election. He accused the current prime minister and deputy prime minister of a cover-up.

"Nick Clegg and David Cameron have colluded in covering this up. It involves their people and we should not have to learn about this piecemeal because of journalists pestering for information,” Danczuk told the Mail on Sunday.

But while Cameron “promised there would be no stone unturned into the inquiry of historic sex abuse,” Clegg’s office seems to be reluctant to comply.

“Nick Clegg, who sits in this department, has already written to me refusing to carry out an investigation into who knew what about Cyril Smith in his party and it’s disappointing to see the Cabinet Office continuing this unhelpful approach,” Danczuk said.

The Cabinet asserts the rest of the dossier is not being published “on grounds of national security,” the Mail reported.

“We are sorry that it has taken some time to consult all relevant officials,” the department said.

Smith died in Rochdale in 2010 aged 82. Margaret Thatcher was prime minister from 1979 to 1990. She died in London in 2013.

Senator Heffernan said the Wood royal commission in the 1990s indicated it was going to explore which members of the Sydney legal fraternity used to attend Costellos, the boy brothel club in Kings Cross. The commission, however, did not look into Costellos.

When David Yeldham, one of Australia's most respected former judges, committed suicide last month the country was shocked. Yesterday, after weeks of rumours, some of the answers fell into place when a royal commission revealed he had confessed, hours before he died, to a secret life of paying men for sex in Sydney's public lavatories :P :P :P

it was my first trip to sydney Herb.
What i found astonishing (at the time ,coming from a very homophobic Qld) was the typical guy in these clubs.
The qld stereotype would have been the guy from" are you being served", running around saying "i'm free".

But these guys were huge, buff, looked mean , looked like a group of elite athletes . mainly in jeans and chesty bonds white singlets.

My girlfriend was enjoying the meat market much more then myself.
I found it totally surreal.
i can see the attraction of the mardi gras.
i like that aspect of homosexuality.

I've never read a gay magazine or news rag in my life, but I seem to be better informed than you are. That's because I have always read widely.

A NSW District Court judge who compared incest and pedophilia to homosexuality and suggested juries may no longer think sexual relations with a child were unnatural or “taboo” faces a ban from hearing further sex cases.

Finding the remarks brought NSW courts into disrepute, the NSW Judicial Commission has recommended judge Garry Neilson “not sit on cases involving sexual offences”.

The judge’s comments caused a public outcry when they were revealed and politicians of all sides demanded action be taken against him.

The NSW government filed a complaint with the Judicial Commission that he had brought the NSW court system into disrepute and NSW Liberal senator Bill Heffernan, who is pushing for the judiciary to be included in the royal commission into child sex abuse, also filed a complaint.

The commission did not find Judge Neilson should be referred to parliament for dismissal but recommended the Chief Judge of the District Court ban him from sitting on sexual cases.

For most of his career, Judge Neilson heard civil cases, not criminal matters.

The commission, acting on complaints from then NSW attorney-general Brad Hazzard, and Senator Heffernan, found Judge Neilson’s remarks would undermine faith in the system and diminish the significance of criminal conduct against victims.

“They were also said at a time of increasing public awareness of the blight of sexual abuse of children brought to prominence by the Royal Commission into Institutionalised Responses to Child Sexual Abuse and other inquiries,” the commission found.

“We find that the words used by the judge, whatever he meant by them, did have a tendency to, and did in fact, undermine the confidence of the judiciary.”

The comments, the finding said, would lead the public to think a judge of the District Court hearing allegations of significant sexual misconduct “does not regard the offences as significant crimes”.

In its 37-page finding, the commission said Judge Neilson had conceded that a reasonable person would consider he held the views expressed but denied they were his views and apologised for “completely inapt” language.

The finding said his evidence was both “confused and confusing” and the public conclusions drawn by politicians and mainstream media about his comments were justified.

It also found his comments made it appear that he was not applying the law and existing legislation.

Judge Neilson made the remarks during a 2014 case of a 58-year-old man known as MRM, who was charged with raping his younger sister in the family’s western Sydney home in 1981.

The judge said during legal argument that “this is the second decade of the 21st century, not the 1950s or 60s when jurors might believe any homosexual connection was ‘unnatural’, and any sexual connection with a child was ‘unnatural” and any incestuous connection was ‘unnatural’.”

He also said a jury might now find “nothing untoward” in the sexual advances of a brother to a sister who was sexually mature.

“Juries now regularly hear cases of sexual conduct which was once considered ‘unnatural’ or taboo,” Judge Neilson said.

“We find that the expression of those opinions did have the tendency to undermine confidence in the judiciary and the District Court and caused alarm within the community,” the commission said.

Where he was wrong in saying what he did was in believing that PC morality had not yet caught up with protecting and sponsoring those who are guilty of deeply neurotic sexual behaviour.

A BANORA Point woman claiming to be the victim of an elite pedophile ring says she was repeatedly prostituted at "pedophile parties", including ones attended by at least three former prime ministers at Parliament House in Canberra.

Fiona Barnett made the sensational claims to media outside the current royal commission in Sydney at the invitation of victims' group Survivors Network of Those Abused by Priests.

She said she witnessed children being kidnapped, raped, tortured and murdered at the hands high-ranking police, politicians and judges.

"My experiences were horrific beyond words," she said.

"But the way I've been treated for reporting the crimes I've witnessed and experienced has been far worse than my original abuse experiences."

Ms Barnett said all her reports to police and royal commissions had so far been ignored.

"I have provided sufficient names, times, dates and places for authorities to investigate," she said.

"Australia is a pedophile haven.
"Our laws are written, interpreted and administered in a way that benefits pedophiles and silences victims of crime."
Ms Barnett recounted a story about being shown as a child what happened to "traitors" who spoke out.

She alleged she witnessed a man being tied to two tractors which drove in opposite directions, tearing him limb from limb.

She said the alleged "VIP pedophile ring" was still operating and trying to silence her and other victims who wanted to speak out but feared for their lives.

SNAP leader Nicky Davis said she asked Ms Barnett after Liberal Senator Bill Heffernan publicly claimed to have a police list of 28 prominent Australians involved in child abuse ring.

"Survivors try so hard to get justice, and so often we're ignored," she said.

"It's just (because) Senator Heffernan has made this a media issue that we're able to attract this level of attention to one of our survivors today."

Sen Heffernan made the allegations under parliamentary privilege earlier this week, saying the list of names included a former prime minister.

"We have in Australia, sadly, a compromise at the highest of levels. There is a former prime minister on this list and it is a police document," he said.

"It's not so much the secret that's the problem, it's when a group of people, such as the 28 people on this page, keep each other's secrets that the institution is compromised."

Ms Barnett said the current royal commission would be a failure if it refused to investigate her claims.
