Title: if this wasnt so sad it would be funny.

http://www.dailytelegraph.com.au/news/national/qld-may-consider-tougher-bail-laws-after-horror-murdersuicide/news-story/f0b00daa90a63ac02dc6c45345a9d981

Queensland got it wrong AGAIN.

ANTI-violence campaigners have called for an overhaul of Queensland’s bail laws after the tragic slaying of Gold Coast woman Theresa Bradford at the hands of her husband.

Ms Bradford, 40, was stabbed to death by her estranged husband David in front of her children at her home on the northern suburbs of the Gold Coast early on Tuesday.

The deadly incident came just two weeks after David Bradford was granted bail in a specialist domestic violence court on charges stemming from an assault on his wife last November.
Gold Coast Centre Against Sexual Violence director Di McLeod said Queensland’s legal system isn’t providing adequate protection to victims of domestic violence.

“Clearly things need to change there,” Ms McLeod told reporters.

“There’s a presumption against the granting of bail where there’s a history or threat of domestic violence in most Australian jurisdictions. There’s not in Queensland.

“There’s no specific provisions in the bail act that cater specifically for domestic violence cases.” Ms Bradford’s death is the fifth case of a woman allegedly being murdered by her partner on the Gold Coast in 16 months.

Ms McLeod says history shows domestic violence offenders regularly breach court- imposed conditions and reoffend.

there are two moments in this story that either makes me want to scream or laugh out loud..

His LAWYER said this... with a straight face..

Quote:
Bradford’s lawyer Mark Donnelly told the Courier-Mail there were “no indications whatsoever that he would do what he did”.

“He had accepted the relationship had irretrievably broken down and was accepting of the very restrictive bail conditions that had been imposed, including having no contact with his partner,” Mr Donnelly, of Krosen and Co. Lawyers, said.

how could you get it so WRONG Mr Donnelly?... >:(

next.

Quote:
Friends of Ms Bradford said she was living in terror after her husband was bailed just two weeks before the killing.

Mr Bradford, 52, was released on bail by a specialist domestic violence magistrate, despite his estranged wife telling police he knocked her unconscious in a violent attack on November 28 last year.

Two weeks after the magistrate released the former train driver, despite the strong objections of police, he broke into his wife Teresa’s home and stabbed her to death before taking his own life.

The couple’s four children were home at the time and fled to neighbours for help.

Domestic violence workers say 40-year-old Teresa was let down by a system that should have protected her.

Friends of Mrs Bradford told the Gold Coast Bulletin she was “terrified” when her husband was released.

what is the point of a victim report or a police report

if even SPECIALIST DOMESTIC VIOLENCE MAGISTRATES take absolutely no notice of them...

what does a victim of DV have to do to get a known violent person put away???>...

be dead I guess.

not only are both parents dead   but 4 children have one hell of a lot to live with for the rest of their days..

and I guess the magistrate can go home and sleep peacefully....

yes the magistrate could have listened to the Police....and who knows even put the victims wellbeing first for a change..

5 dead in 16 months.....how many other living in cold fear.. we will never know ..

unless they are killed then we find out..

'her' children?  You mean he had nothing to do with them or their birth or anything else?  FFS....

No wonder he over-reacted and struck out...... rob a man of his most precious and he WILL seek to defend house and home and hearth.....  TS is wrong with you people?

I've told you all before - while ever governments fly in the face of human nature - in this case the genetically installed burden on a man to protect his Family against all enemies (whether they be domestic or foreign), and tell him that not only will he have nothing to do with that family any more, but will still pay for it and be punished with violence if he seeks to continue to be part of it - you are asking for trouble.

If the woman is destroying that Family (as he sees it), that man will defend it, and sometimes that means that woman has to go sine she is the one destroying that Family....  sorry 'bout that.

Now - I don't justify or defend his actions - but, as usual, I am the lone voice asking for a more reasoned and reasonable approach than the immediate violence of the state to secure advantage for the destroyer of family (as he undoubtedly sees it), which violence by the state will engender violence - NOT SOLVE IT!

I think this entire discussion of 'domestic violence' needs to be looked at in the real light of human characteristics and ingrained behaviour.

How many times must I tell you... stop the violence against men and the violence will ease.

Seeking to outline the REAL parameters of Violence in no way indicates that the person doing so is violent by nature.   To the contrary - it is more likely that, as a thinking human being, they have been subjected to violence and have rejected it, rather than 'playing out' the violence that has been imposed on them - as so very many do.

Look it up.... damaged people have this terrible tendency to assume the role of the one who has damaged them, and then perpetrate the very same things that have caused the damage....... it's a psychological twist on the old saying that violence begets violence, and it is a hallmark of the dysfunctional family.

What, as a society do we need to do in light of young, single, unskilled women with children striking out on their own to get away from violent  men? Is there a way we as a society can help abused women without creating generational welfare dependency?

My point, dearest cods, is that a piece of paper protects nobody - it is only the threat implicit in that paper that has any effect - and that threat is violence itself, often not justified, and is most often the trigger point for retaliation.

While ever the State persists in bullying men rather than seeking reasoned resolution of difference - that State violence will always generate more violence.

You, and many others, simply do not understand the mechanics of violence.

I understand (or try to understand) what it's like for women who've spent years (decades) of their lives being slapped around by their husbands/boyfriends. I grew up with it all around me. There's no mystery about what needs to be done; the question is where does the money come from?

I don't want to sound like Pauline, BUT, the problems arise when the women has no skills or money, continues to have children and stays out of the workforce/vocational training for years and years. Of course the money is going to come from the taxpayer, but is the money ever going to be enough to NOT create welfare states.

Hmm - it is a hard one, and can only be resolved to some extent by a return to genuine full employment.  Unfortunately it becomes a kind of endless generational thing for some, and never lose sight of the fact that 'domestic violence' is not all about slaps etc.. look at the list some day.

95%+ callouts for 'dv' to the NSW Police result in no charges, since it is most often a simple short-term disagreement, and therefore the term 'violence' should be removed from discussion of the issue as a first step in de-escalating this dreadful situation, since its use implies violence when most often there is none, and quite often pre-disposes police etc to respond violently, thus escalating the situation out of control.

I think a proper and rigorous study is long overdue into all aspects of violence in society, and particularly I think there is a need to chart the progression of 'domestic violence' from simple disagreement to ultimate sanction by one party over the other - in one way or the other.  I believe that a full study of the track of escalating relationship violence will show that the intervention of the police and courts over non-issues escalates things, until the inserted violence of the police and courts causes a tip-over, at the point where one party has nothing left to lose.

That is why I call for a cessation of the war against men over relationship violence.... insulting, humiliating and bashing men over a disagreement while offering no valid solution other than assisting the other party to walk away without any responsibility, while making no attempt to even discuss differences peacefully, will eventually give you what you want.... war between the sexes.

Anyone who hasn't seen yet that government is setting out to do that very thing, after all these years of escalating violence - is deaf, dumb and blind.

POLICE pleaded in vain with a domestic violence magistrate to keep Gold Coast wife killer David Bradford behind bars after he allegedly gaffer-taped his estranged partner’s mouth shut, punched her so severely she blacked out and dragged her across the floor by her hair.

.
Bradford, 52, was released from jail on bail two weeks ago after being charged with a violent attack on wife Teresa, 40, on November 28.

Yesterday, he broke into their Matas Drive home at Pimpama and stabbed her to death in front of their four children before killing himself.

The children ran to a neighbour’s house to raise the alarm.

Mrs Bradford is the fifth Gold Coast woman to be murdered by her partner in the past 16 months.

Her husband had been in custody since the November incident, over which he was charged with assault occasioning bodily harm, unlawful strangling, deprivation of liberty, and domestic violence-related common assault.

Despite objections from police who said he was in a “fragile mental state” and was “an unreasonable risk of causing self-harm or harm towards others”, Bradford was released on bail on January 12.

Specialist Gold Coast domestic violence Magistrate Colin Strofield allowed Bradford to be released on bail after his Legal Aid-funded lawyer argued there was no criminal history, no independent witnesses and Bradford had been in custody for 44 days.

The police who charged Bradford alleged the disability pensioner — who was already stressed about his wife wanting to leave him and believed she was having an affair — snapped after receiving a phone call about his medical condition.

Police alleged he slapped his wife, placed gaffer-tape over her mouth and punched her in the face until she blacked out.

She lost control of her bladder and bowels and was then dragged by the hair into the kitchen.

When she tried to call 000, Bradford sat on top of her and threw the phone away before choking her with his forearm.

Teresa Bradford’s estranged husband David Bradford took her life.
After pinning his wife to the ground for 25 minutes, Bradford then went to the bedroom and returned with some rope, a pocket knife and box cutter, which he said he was going to use to tie her up.

When police arrived, Bradford was holding a rope and threatening to kill himself.

His bail conditions required him to live at a Brisbane CBD hotel, report to police and not go within 100m of his wife except for court appearances. Bradford’s lawyer Mark Donnelly said yesterday that he was “gobsmacked” at the tragedy as there were “no indications whatsoever that he would do what he did”.

PLEASE DONT LET THIS LEGAL AIDER EVER DO A DOMESTIC VIOLENCE CASE AGAIN..

“He was in my office only two weeks ago, a family member spoke to him just yesterday and he seemed fine,” Mr Donnelly, of Krosen and Co. Lawyers, said.

“He had accepted the relationship had irretrievably broken down and was accepting of the very restrictive bail conditions that had been imposed, including having no contact with his partner.”

Mr Donnelly said Bradford was planning to defend most of the charges and was entitled to bail ahead of a committal hearing in March.

Bradford’s bail hearing heard he was penniless and homeless with no access to his children.

Mr Strofield and Chief Magistrate Ray Rinaudo declined to comment yesterday.

Attorney-General Yvette D’Ath said it was “too early to be discussing the circumstances around the individuals involved, including any reports about bail”.

“This matter is before the police and may possibly come before the Coroner or the Domestic and Family Violence Death Review Board,” Ms D’Ath said yesterday. “This is an extremely tragic incident.

“We know from reports that children are involved and our thoughts go out to those children and friends and family at this very difficult time.”

You, and many others, simply do not understand the mechanics of violence.

grap I have long had trouble trying to figure out what you talk about...I am sorry..but this again is one of those occasions ..

you are turning this into your usual diatribe about women abusing men...and poor men not getting the attention they deserve...

almost no one agrees with you ...but that doesnt stop you turning every thread about DV into a mish mash of topics...feel free to start your very own.. MEN AGAINST VIOLENT WOMEN thread..

although you will deny it.. thats what you are about imo.....

then you make bizarre statements like this..
