Major parties conducting internal audits of every MP as Greens reveal new audit proposal

The Liberal and Labor parties have undertaken sweeping behind the scenes audits of all their MPs to ensure they are not dual citizens and ineligible for parliament, despite both parties fighting an external probe for months.

And in a move designed to bring the citizenship crisis to a head, the Greens will immediately move when the Senate next sits to establish a committee that can compel all senators to produce evidence they have complied with section 44 of the Constitution.

The Greens move shapes as a test for Labor, which on Friday flipped its position and announced that it would support an undefined bipartisan process to uncover any additional dual citizens.

The Greens proposal will likely have the support of the Senate cross bench but will need Labor backing to proceed.

The internal audits by both major parties began months ago, soon after former Greens senator Scott Ludlam announced he was a dual citizen.

In the Liberal Party's case, federal and state directors agreed to undertake the legal checks on all sitting members of parliament and the process has been driven by state offices, in consultation with the national office.

It's understood that some, but not all states have now completed the process. Prime Minister Malcolm Turnbull's office is aware the work is underway.

For Labor, the process was driven by the party's national office, working closely with Opposition Leader Bill Shorten's office, with state party offices also involved.

A party source said that, in many cases, the process involved getting a fresh set of legal eyes to review the paperwork already produced for legal advisers during the candidate vetting process.

In more complicated cases, barristers and QCs have been engaged to provide additional advice. Labor's internal process began soon after Mr Ludlam's case emerged too and it concluded after about a month.

While it is not surprising the major parties would quietly run checks on MPs who could face legal hurdles, the revelation that it has been going on for months – even as Labor and the Liberals have fought off an external probe – will likely prompt calls for the findings to be publicly released.

It also raises questions about whether either party has discovered another MP may be an undeclared dual citizen and kept quiet about it.

Greens Leader Richard Di Natale said the fact that behind the scenes checks were done was "a sign of a government that has lost all credibility and is no longer fit to govern".

"There is now no longer any excuse for the government not to commit unequivocally to a transparent, independent audit of every single member of parliament," he said.

Mr Ludlam's resignation in July eventually prompted a High Court case that found 5 MPs – including former deputy prime minister Barnaby Joyce – were dual nationals. Former senate president Stephen Parry then sensationally came forward and quit last week.

Under the Greens' proposal, the party will attempt to set up a new senate select committee on November 13 when the Senate next sits that would co-opt citizenship experts to assess and provide advice to the committee.

The committee would comprise 3 government MPs, 3 Labor MPs, 1 Green and 1 xbench senator and would only examine upper house MPs.

The Greens hope a similar committee could be established in the House; ideally, they want a joint committee or commission of inquiry established but recognise the government is unlikely to support this.

Dr Di Natale said parliament faced a "constitutional crisis" and that "the prime minister and the opposition leader need to stop acting in their own self-interest and start acting with some integrity".

The government has resisted pressure for an external audit of all MPs, arguing it would reverse the onus of proof, that the High Court should deal with citizenship matters and that an audit, as Mr Turnbull put it, would be a "witch hunt".

Mr Shorten's peace offering is for "a universal disclosure to the Parliament" by all MPs but on Saturday, he failed to provide more details of how this would work even as he called for all parties to sit down and "work out a process that restores the confidence of the Australian people in the Australian Parliament".

The Greens hope their proposal will be taken up by Labor.

Mr Turnbull has questioned the utility of an audit by, for example, a parliamentary committee and said MPs should simply self-report themselves. He has already dismissed Mr Shorten's call for universal disclosure as "characteristically confused".

In September Turnbull stood before the media demanding that Bill Shorten prove that he wasn't a British citizen. Now when it looks like the citizenship saga could take down even more coalition MPs, Turnbull is claiming it's a "witch hunt". Witch hunt? How about you just obey the law.

But back to real news as Mal outsmarts the Labor imposter in NZ.

Mr Turnbull had his first win of sorts this weekend when he rejected NZ’s, Jacinta Ardern’s, offer to take 150 Manus Island troublemakers.

Ardern’s offer was nothing more than cheap window dressing for her NZ Greens supporters.

Ardern knows the rabble would only use NZ as a springboard over the ditch into Australia. Problem solved—for her! And the UN applauds.

SENATOR Eric Abetz has stepped up pressure on Braddon MP Justine Keay to produce papers that prove she renounced her British citizenship before the 2016 election.

Ms Keay has released a timeline of her efforts to renounce her British citizenship.

But she again declined yesterday to make public any correspondence from the British Home Office that would show she succeeded before June 9, 2016, the date nominations for the 2016 election closed.

She said she completed a UK Home Office Form RN Declaration of Renunciation of British Citizenship on May 9, 2016, receipted by the UK Home Office on May 31.

Labor leader Bill Shortenhas pledged to “clear the cloud over the constitutional citizenship crisis engulfing the Parliament”.

Senator Abetz said that pledge meant nothing until Ms Keay and Queensland MP Susan Lamb validated their credentials. “It will be clear to all that Mr Shorten’s words are worthless,” he said.

“Their pointless exercise in publicising timelines that leave out the most important date is a tricky attempt to avoid hard questions.”

Meanwhile, doubts emerged about Coalition MPs Alex Hawke and Julia Banks in the dual citizenship debacle that already has claimed five senators, including Tasmanian Senate president Stephen Parry and Deputy Prime Minister Barnaby Joyce.

Constitutional experts are divided over whether “taking all reasonable steps” is sufficient under the latest High Court decision.

Prime Minister Malcolm Turnbull, who holds a one-seat majority, criticised the media at the weekend for carrying out “witch hunts” in relation to Energy Minister Josh Frydenberg and ruled out an audit called for by Senator Abetz, Denison MP Andrew Wilkie, Greens Leader Richard Di Natale and others.

Dutton lashes Shorten on New Zealand refugee call

Immigration Minister Peter Dutton has lashed Bill Shorten over his call for the Australian government to consider New Zealand’s offer to resettle some of the ­remaining Manus Island refugees, saying any such move would embolden people-smugglers.

Following New Zealand Prime Minister Jacinda Ardern’s offer yesterday to accept 150 men from Manus Island, Mr Shorten said the proposal shouldn’t be ignored by Malcolm Turnbull.

“Turnbull should take Prime Minister Ardern’s constructive offer seriously,” Mr Shorten said.

“Manus was never intended to be a place of indefinite detention. The Liberals have been in charge for four years and haven’t done anywhere near enough work on resettlement options.”

However, Mr Dutton accused the Opposition Leader of “sounding a lot like Julia Gillard and Kevin Rudd”, arguing his statement would be a “green light” to people-smugglers.

“Mr Shorten has not sought any briefings on the government’s work to clean up Labor’s Manus legacy,” he said.

“It is … a reminder to Australians that Labor under Bill Shorten would fold to internal pressure once again and it would be a green light for people-smugglers.”

The government has previously rejected resettling asylum-seekers in New Zealand, arguing it would encourage people-smugglers.

Ms Ardern is expected to discuss the issue with Mr Turnbull when they meet in Sydney tomorrow.

Just fewer than 600 men are ­refusing to leave the Manus Island processing centre for new accommodation at other locations in the region, arguing it is unsafe to leave.

Australia’s Immigration Department yesterday rejected claims the country had “abandoned” the asylum-seekers and refugees.

“Former-residents who choose to stay at the (centre) are doing so fully informed that PNG has provided them with suitable alternatives and that these can be accessed at any time. Any claims to the contrary are simply not true,” the department said.

But the Australian government’s apparent tactic of hoping a lack of food, water and basic comforts would drive the remaining asylum-seekers out of the closed detention centre appeared to be backfiring yesterday with the men bringing in boatloads of food supplies and being given access to power and water by locals.

Up to 30 asylum-seekers were yesterday reported to be involved in running the loads of food into the centre using the unsecured back entrance on the beach within the Lombrum Naval Base.

At the same time, PNG residents living near the centre within the base were regularly allowing the men to access water and to ­recharge phones.

The practice was being unofficially condoned by PNG authorities. A senior policeman who asked not to be named said his ­officers had not received any ­instructions to move the men out of the centre.

He also said police knew the ­refugees were bringing in food and being given access to power and water — but that was something his men had not been instructed to stop.

“It is part of the Melanesian way. If you come to my village without anything, then I will look after you and give you food,’’ he said.

The officer said he thought it was unlikely any move would be made to forcibly oust the men.

“It could take months,’’ he said.

“They will wait for them to leave.’’

The refugees have repeatedly stressed they do not wish to leave the centre as the locals around ­Lorengau may attack them.

But the Australian Immigration Department yesterday hit back at their claims, saying security services were in place at the ­alternative accommodation sites.

I find it laughable that these people want to remain in the concretation camp that they complained about and do not want to live amongst the locals who are supplying them with food and water as they are frightened of them yet some have already settled down in Manus island and opened up businesses . Lets face it after all the money they received from the taxpayers they could all buy homes there or open up businesses .

It's all delaying tactics so as to hold on by a fingernail to control of The House - even the suggestion, after the Joyce case clearly delineated the rules and set the precedent, that Turnbull wants each case to be put to the court separately, thus postponing the inevitable Downfall as long as possible, is a desperate move of a desperate government.

Very like Hitler shuffling phantom divisions around at the very end...

Grappler is grappling with the problem but at the end of the day when the sun goes down the HIGH COURT is the ONLY body that can decide a member's current status.

Labor's GetUp! HATE SQUAD attempts are meaningless until examined by the High Court.

That's why Mal said it is each members responsibility to check out his status and if in doubt refer it to the High Court for a final authorized decision.

Marathon postal survey almost at an end

The same-sex marriage postal survey is almost at an end with forms to be received by 6pm on Tuesday.

Australians have one last chance to mail their marriage equality form before the postal survey closes on Tuesday.

The marathon campaign is almost at an end, and any forms received after 6pm on Tuesday will not be counted by the Australian Bureau of Statistics (ABS).

The results will be announced on Wednesday, November 15 around 10am (AEDT).

Most opinion polls show the 'yes' vote winning with around 60 per cent, but an academic study of Twitter opinions refutes that.

Griffith University professors David Tuffley and Bela Stantic used advanced data analytics which they say have proven accurate at predicting the outcomes of hard-to-call polls, including the 2016 US presidential election.

After running their algorithms, support for 'yes' came in at 49 per cent.

The 'yes' campaign has been well supported by a number of high-profile Australians with Julie Bishop revealing that she had voted 'yes'.

The Liberal Party's deputy leader joins Prime Minister Malcolm Turnbull and Opposition Leader Bill Shorten in the 'yes' camp.

Even if the 'yes' vote does win, there is no guarantee marriage equality will pass the House of Representatives.

A stomach turning sight as stegosaurus looms out of Labor's vast cesspool of corruption.

The ALP created this whole citizen crisis, working behind the scenes to get their ship in order before setting up the initial outrage. It is an attempt to push over the Coalition and put Labor nodding dolls in power.

Problem is Juliar, us the public remember that what ever you say is more likely to be a lie than true. We also remember that you only have interest in your Union movement and it’s political arm the ALP. You may well have once been PM but you are what you always been.

There will be NO carbon tax under a "govt" I lead.

Gillard says citizenship questions about Labor MPs are a ‘waste of time’

Former prime minister Julia Gillard says Labor has been doing thorough background checks of candidates for over two decades.

Welsh-born Ms Gillard issued a brief statement on Friday accusing some reporters of “wasting their time” asking her about her UK citizenship, amid a debate over the eligibility of current MPs.

“I renounced my British citizenship in order to stand for election to the Senate in 1996,” she said.

“I was unsuccessful in that election. I was then elected to the seat of Lalor in 1998.

“What my personal experience shows is that more than two decades ago the Australian Labor Party was giving accurate advice to candidates on issues regarding eligibility to stand for federal parliament.”

It comes after the Perth lawyer who triggered the dual citizenship crisis by exposing then Greens senator Scott Ludlam’s New Zealand citizenship revealed Ms Gillard and Tony Abbott were actually the original targets of his investigation

John Cameron, who has a keen interest in constitutional law, said he began digging in 2011 but wasn’t able to gain traction until several years later. He started with then Prime Minister Gillard and opposition leader Tony Abbott.

“When I started I was after Gillard and Abbott but I wasn’t having much joy getting the evidence; or I wasn’t getting much joy in the high court accepting the evidence that I had from the British border authority,” he said. Instead Mr Cameron turned to his home country of New Zealand for information and the “low lying fruit” that was Senator Ludlam.

“So it was easier to go after Scott Ludlam as one of the low lying fruit because it was accessible through New Zealand,” he said.

Labor has backflipped on the citizenship issue this afternoon, throwing its support behind forcing all MPs to “disclose” to the parliament that they are not dual citizens after previously opposing a parliamentary audit.

Earlier, Malcolm Turnbull launched a passionate defence of cabinet minister Josh Frydenberg, calling it “absurd” to claim he inherited Hungarian citizenship from his mother who was stateless when she fled the country “which would have pushed them into the gas chambers.”

The prime minister accused those pushing for a citizenship audit of MPs as engaging in “witch hunts”, also taking aim at critics of the energy minister who have questioned his citizenship.

“Has this witch-hunt become so absurd that people are seriously claiming that Josh Frydenberg is the citizen of a country which has stripped his mother and her family of their citizenship and would have pushed them into the gas chambers had it not been that the war was ended before they had time to do so?” Mr Turnbull asked reporters in Perth on Friday.

He said politicians should not be tried by “innuendo and smear”, but rather any parliamentarian was able to stand up, offer evidence and move to refer one of their colleagues to the High Court, the only body with the power to disqualify MPs.

Two of Mr Frydenberg’s ministerial colleagues Barnaby Joyce and Fiona Nash were disqualified from parliament by the High Court over their dual citizenship-by-descent last Friday.

The Australian reported on Friday that Hungary has rules that can confer citizenship by descent.

Attorney-General George Brandis said rather than an audit, he expected a parliamentary committee would come up with proposals to either change section 44 of the constitution through a referendum or find a legislative means of sorting out the problem.

He said the Labor and Liberal parties had exhaustive processes for candidates to declare and prove their eligibility.

Conservative Liberal MP Kevin Andrews is among those pushing for an audit, insisting it was time to lance the “festering sore”.

“This has now become a festering sore for the government. We can’t talk about anything else. We need to get this resolved,” Mr Andrews told ABC TV.

Communications Minister Mitch Fifield revealed on Thursday now-resigned Senate President Stephen Parry had confessed to him in August about possibly being a dual UK-Australian citizen, but did not take action until this week. Mr Turnbull said he was not aware of the conversation, but it had been Mr Parry’s responsibility to comply with the constitution.
