A father who allegedly shook his 10-week-old baby boy to death in Sydney’s west will remain behind bars.
The child died in The Children's Hospital at Westmead on Saturday, having suffered significant brain injuries.
The 24-year-old father, who cannot be identified due to legal reasons, was arrested at Mount Druitt police station on Monday and charged with manslaughter.

Court documents allege he “violently” shook his baby on Friday night, causing critical brain juries and resulting in his death.
The father was mentioned briefly on Tuesday in Mount Druitt Local Court where he did not apply for bail before it was formally refused.
Emergency services were called to a home at Bidwell about 10.15pm on Friday following reports the child was unresponsive.
The baby was first taken to Mount Druitt Hospital then transferred to Westmead in a critical condition where he later died.
A post-mortem examination showed the child died as a result of a significant brain injury, NSW Police said.
The father will return to court on February 12.

Mt Druitt and surrounds is one of the most dysfunctional parts of Sydney with ice use, alcoholism, child abuse,  but she wouldn't know because she lives so far away she may as well be on another planet.

But do you not see cods, Gordon had no regret for the baby at all.  In the very first post he suggested is that the mother is drug affected, and therefore the baby was defective with no evidence at all.

Anyway, in this case.  It is manslaughter, because, the prosecutors would have trouble establishing intent to kill beyond reasonable doubt.  The plantiff could easily plea for manslaughter, as sort of accidental death with no intent.  UNLESS, of course, the father have documented how he wanted to kill his baby, and estabilish motive (e.g. to hurt mother / to claim insurance), then murder charge wont stand.  Only in very rare circumstances, the jury would convict someone on 'instantaneous' intent to murder.

  I get that   but is it a fair call   the baby didnt stand a chance....it has no voice..only the court....unless someone was there and these mongrels usually make sure they are alone....my feelings are manslaughter he will get at the most 6 years we have seen it in the past... the child is dead  dig a hole and forget it...

I think I know what you mean.  Perhaps, we should look into increase the scale of penalty of manslaughter, or even establish a new criminal code with adequate penalties.  However, even then, you cant expect the penalty to be that of equivalent to a murder - as the conviction of murder requires a higher standard of evidence, and rightfully so.

I agree to and extent....  I dont think gordy should have brought that up unless he had evidence...I agree   but did it warrant the attack from mothra?.... why couldnt she just ask him for the evidence of drugs.....he admits he put two and two together Mt Druit what else.. ::) ::) ::)... all I asked was shouldnt he the father be charged with murder?  and not manslaughter.......so far no one including you has given me their opinion on that..... do you think I should have copped the abuse and lies mothra spit out? you think they were justified tickle?????.. how about accusing gordon of saying the baby is better off dead.... nowhere does he say that or even suggest it... its all in her mind... your point is taken  I will remember that in future Oh Cods, chill, girl.  I think we both have being here long enough to know, that once Mothra and Gordon gets started, there is no stopping.  Best to stay out of it.   :) Anyway, in this case.  It is manslaughter, because, the prosecutors would have trouble establishing intent to kill beyond reasonable doubt.  The plantiff could easily plea for manslaughter, as sort of accidental death with no intent.  UNLESS, of course, the father have documented how he wanted to kill his baby, and estabilish motive (e.g. to hurt mother / to claim insurance), then murder charge wont stand.  Only in very rare circumstances, the jury would convict someone on 'instantaneous' intent to murder.    I get that   but is it a fair call   the baby didnt stand a chance....it has no voice..only the court....unless someone was there and these mongrels usually make sure they are alone....my feelings are manslaughter he will get at the most 6 years we have seen it in the past... the child is dead  dig a hole and forget it... someone has to stand up and say our law are rubbish........if he dropped the baby and it dies I would say yes unintentional.... but shaking till its tiny brain is smashed   no way. I think I know what you mean.  Perhaps, we should look into increase the scale of penalty of manslaughter, or even establish a new criminal code with adequate penalties.  However, even then, you cant expect the penalty to be that of equivalent to a murder - as the conviction of murder requires a higher standard of evidence, and rightfully so.

well going from murder to manslaughter to me is a cop out..... maybe a new name for killing babies..helpless children....it happens too often for my liking

whatever the sentence   its based on the lowest one thats gone before....  remember where the mother and boy friend killed the little girl and set fire and buried her in a woods somewhere then they went on tv with the other children telling everyone a stranger had grabbed her.....well he got 6 years...  I he would be out now   with I am almost sure no restrictions on dealing with children....

our laws are sicker in some ways..

What goes on in Mt Druitt wouldn't be tolerated in a decent area of Sydney but it comes down to triage. Pregnant teenagers who drink smoke and take drugs is just business as usual. Ice use is at epidemic levels. It comes down to a triage situation.

When you hear a child is murdered nobody even blinks when Druitt is mentioned.
