Kyle Rittenhouse lawsuit brought by father of man killed can proceed

A federal judge says a wrongful death lawsuit from the father of a man who was shot and killed by Kyle Rittenhouse can move forward.

Anthony Huber was killed in Kenosha, Wisconsin, during unrest sparked when police shot a black man in the back.

On Wednesday, US District Judge Lynn Adelman dismissed motions filed by Mr Rittenhouse and the government defendants who were seeking to block Mr Huber's legal action.

Yeah, I had to look at that twice.

All good though: the 'government defendants' are actually city officials and law enforcement officers who are also being sued.

It's not a case of government officials defending the trigger happy gun-nut.  Thank goodness.

Kyle and his Attorneys are expected to make millions from slander lawsuits against the MSM and worlds greatest daddy John Huber wants a piece of the action. If his son wasn't a Felon and a Thug none of this would have happened. Maybe Huber just needs the money to replace the income his son shared with him, not! His son wasn't the victim, Kyle was.

Anthony Huber’s father, John Huber, also alleged that Rittenhouse, who was 17 at the time of the shootings, conspired with law enforcement to cause harm to protestors. John Huber is seeking unspecified damages from city officials, officers and Rittenhouse.

U.S. District Judge Lynn Adelman on Wednesday dismissed motions filed by Rittenhouse and the government defendants seeking to dismiss the civil rights lawsuit.

In allowing the case against Rittenhouse and the others to proceed, the judge said that Anthony Huber’s death “could plausibly be regarded as having been proximately caused by the actions of the governmental defendants.”

Huber attacked someone on the ground. He whacked Kyle in the head with his skateboard then tried to take his gun. Kyle had a single point sling so grabbing his gun resulted in barrel pointing towards Huber.

If Huber left Kyle alone he would still be alive.

Huber should be nominated for a Darwin award, those who support what he did are also candidates for a Darwin award.

I was pleased to read this report.  At the time, I couldn't accept
the the US judicial system had effectively let Rittenhouse get away
with murdering two people in cold blood.

I can only hope that John Huber's claim is successful, and if so, that
its financial loading on Rittenhouse will shut him down permanently
and ruin his life hereon.

This sad little crybaby grub should by rights be now residing in the
big house—where I'm sure a few of the boys would've by now carried
out a little shirt lifting—to really bring on some genuine tears.



At the very least, Rittenhouse should've been convicted of two charges
of involuntary manslaughter.

In Australia, that charge requires the prosecution to prove that the
accused had caused the death of a person(s) during an unlawful
and dangerous act, as was noted by the Australian High Court
in Wilson v. The Queen in 1992.

In Rittenhouse's case, it was obvious—even to blind Freddy—that he acted
in "an unlawful and dangerous manner".

(Is the involuntary manslaughter charge the same/similar in America?)

There's no viable evidence proving that Huber's skate board ever
contacted Rittenhouse's head.  The court record says;  "During the
struggle, a skateboard he (Huber) was carrying 'made contact'
with Mr Rittenhouse’s shoulder".

And the reason Huber acted so heroically?  Rittenhouse had just
then murdered Joseph Rosenbaum—the fatal shot hitting him in
his back as he [Rosenbaum] was running away.  And Rosenbaum's 
"crime"?   Verbally goading Rittenhouse and his gung-ho armed
mates.  Court records show that prosecutors and witnesses said
he was not a threat, and instead characterised him as a "babbling
idiot" and "not a serious danger".

And of course, if you witnessed someone murder another person,
wouldn't you at the least attempt to disarm him?

Not so at all.  Huber was attempting to incapacitate Rittenhouse in
order to relieve him of his weapon—after Rittenhouse had already
killed another person.  Huber's "attack" was preemptive of another

Yes, the Judge stated possible plausibility as a reason for letting the lawsuit proceed, but in the end it won't be a Judge that decides the outcome of this lawsuit.....it will be a jury, & the requirements are less for the complainant to make a case.....that said, it will still be extremely difficult, but not impossible, but still extremely difficult to get a favorable decision on liability in light of his ALL COUNTS UNANIMOUS NOT GUILTY VERDICTS from his criminal trial.

I doubt that proficiency was the issue - he seems to have a problem with courage. He killed a guy because he was frightened by having a plastic bag thrown at him and one who was completely disabled by the first shot but he needed to shoot him about 7 more times. The kill shot came with a round in the back while he was laying face down on the ground.

His problem is that he is a gutless turd.

The state and judge have very little to do with the verdict. In criminal trials in the USA the 12 man jury is the law. All the evidence in the world doesnt matter if the jury sides with the shooter.

He was charged with homicide, attempted homicide and reckless endangerment in the deaths of Joseph Rosenbaum, 36, and Anthony Huber, 26, and the wounding of Gaige Grosskreutz, 27.

However, he was acquitted of all charges last November after evidence showed he was defending himself while being chased and attacked.

Defense attorneys for Kyle Rittenhouse successfully questioned Gaige Grosskreutz, who was shot in the arm by Rittenhouse, about his own threatening actions leading up to him getting shot and "maimed".....a shooting plainly seen as self-defense on Rittenhouse's part.

Grosskreutz was armed himself, and was proven beyond any doubt as being the aggressor.
