Former immigration detainee released after High Court decision among those arrested over violent Girrawheen home invasion

A man charged over a violent home invasion and robbery in Perth's north in which an elderly woman was allegedly bashed unconscious was released from immigration detention after a landmark High Court ruling last year.

Majid Jamshidi Doukoshkan, 43, was among 149 detainees released after the High Court ruled in November 2023 that indefinite immigration detention was unlawful.

Mr Doukoshkan is one of several people charged over the home invasion and burglary which left 73-year-old Ninette Simons hospitalised with head injuries.

Her 76-year-old husband Philip was allegedly tied up and assaulted after the group allegedly posed as police officers to gain access to the couple's Girrawheen home.

The Christchurch mosque shootings were two consecutive mass shootings on two mosques in Christchurch, New Zealand on 15 March 2019.

They were committed by Brenton Tarrant - a white Australian male - who entered both mosques during Friday prayer, firstly at the Al Noor Mosque at 1:40 p.m. and later at the Linwood Islamic Centre at 1:52 p.m.

Tarrant was arrested after his vehicle was rammed by a police unit as he was driving to a third mosque in Ashburton. He live-streamed the first shooting on Facebook, marking the first successfully live-streamed far-right terror attack, and had published an online manifesto before the attack.

On 26 March 2020, he pled guilty to 51 murders, 40 attempted murders, and engaging in a terrorist act.

I can’t blame the above at all. I value different opinion , unfortunately I’m not always right.

I can blame the “ high court “ , amazing how judges names are always hidden?

I also can blame the Albo government for not passing laws to direct the faceless, nameless “ high court “ judges to not allow their release.

I can also blame the previous  Lnp. government for not passing laws and leaving a ticking time bomb the Albo government was to stupid and distracted by its failing “ voice “ to identify and correct.

I don’t believe you can lock people up forever without a trial.

I don’t believe you have any right as a refuge when you enter the country illegally.

Australia should increase our refugee intake. Via the proper channels.

Not protect and allow prosper those  only who must run from their country due to the crimes they have committed there.

If you enter the country illegally, jail and on release back to your country of birth.

We have already seen how easy it was for nazis to escape and settle in Australia after ww2

Can you imagine worse case scenarios involving more deaths in terror attacks, more grisly than what you read about (and maybe watched for a short time the video was available) than what one person did with automatic weapons at a few mosques? By no means do I even consider Tarrant's actions even remotely justifiable. But, I understand his motivation. The main concern is that Tarrant was not targeting terrorists. He was targeting peaceful people at a Friday prayer meeting. And he was motivated by his apparent need to highlight the "great replacement" of white people.

Whatever condemnation you have of Tarrant (and the more condemnation, the better) you will have to realise that there are people out there that will cite Muslim terrorism as the source of revenge attacks against minorities. Unfortunately, "greggerypeccary", you want to continue to this cycle of violence, with the implication that the elderly couple were victims of some people incited by the Brenton Tarrant killings, by all means, try and explain that to authorities and the victims concerned.

There is nothing connecting the two issues.

The latest released detainee charged with breaching his curfew requirements had previously been charged earlier this year with aggravated home burglary.

Burundi-born Kimbengere Gosoge appeared in Midland Magistrates Court on Thursday after being charged with breaching his curfew requirements five times in as many days, as well as one count of failing to maintain a monitoring device. He did not apply for bail and will reappear in court later this month.

Court records show that Gosoge had already been charged with one count of aggravated home burglary before he was arrested on the curfew breaches. He is due to appear in court on that matter in early June.

Gosoge had previously faced deportation after being convicted of burglary and stealing back in 2017. In that instance, he was given a six-month community-based order for a charge of being armed or pretending to be armed in a way that may cause fear and one charge of burglary, and was fined $500 for three counts of stealing and one count of breaching a bail undertaking.

He then became one of the 152 people in indefinite immigration detention to be released following last year’s High Court decision.

The news about Gosoge’s earlier aggravated burglary charge follows a week of intense scrutiny of the Federal government’s handling of the released detainees. Another former detainee, Majid Jamshidi Doukoshkan, was charged over his alleged role in the brutal bashing and burglary of an elderly Perth couple. He had previously been repeatedly bailed and had his ankle monitoring requirements lifted despite multiple instances of non-compliance with his curfew.

The Albanese government came under further pressure over its handling of detainees on Tuesday night following revelations a man charged with murder was freed from immigration detention last month by the Administrative Appeals Tribunal as he was deemed “a low risk of reoffending”. Emmanuel Saki, 29, has been charged with murder over the stabbing death of 22-year-old Bosco Minyurano on May 12. AAT deputy president Stephen Boyle overturned a 2019 decision to strip the Sudanese man of his visa and he was released from immigration detention in early April.

Burundi-born Kimbengere Gosoge on Tuesday was handed a one-year jail sentence for each of the six charges laid against him this month for breaching his curfew and failing to maintain his electronic monitoring device.


The court heard Gosoge had fled the east African nation of Burundi with his younger brother after their father was killed in the civil war. The pair boarded a container ship in South Africa, and sailed to China and The Philippines before arriving at the Kwinana Bulk Terminal south of Perth.

His brother drowned at a beach just two weeks after he was granted a visa, and Mr Mola said his client had struggled to recover from the trauma of that incident.

Gosoge had gone on to marry and have two children. Gosoge’s wife, Mr Mola said, had “struggled with parenthood” and the children had been taken into state care. His wife is believed to still be in Melaleuca women’s prison.

My conscience is clear, I've never voted for the ALP or the Coalition

If you vote for them, you've got no reason to complain about criminal refugees

Don't vote at all and resign yourself to paying the fine every three years, that's what I do

Politics these days is beyond a joke, I went bush to get away from it, it's a better world out here

You get to see the real Australia, much more than just woke cities that drive you insane

When I look out my window, I'm not bored looking at a wall of a house next door, I see a mountain range, green fields, and wildlife

And I don't see rabid teenagers crashing into houses, home invading, or robbing and killing passers by

If you ever wanted to be in awe of Australia, and get a respite from the vile LibLab politics, travel to see some valleys from lookouts

Take your camera and set it on "Stitch", take 4 photos and stitch them together - awesome panoramas of overawing Australia

All teenagers and refugees should be made to do this, so they can realize what tiny ants they are, and then made to live in the bush for a while

The Albanese government has accused the Administrative Appeals Tribunal of misinterpreting its changes to immigration laws, after the AAT cited directions from ­Immigration Minister Andrew Giles in its decision to release a ­detainee who has since been charged with murder.

Sudan-born Emmanuel Saki, 29, was charged earlier this month over the stabbing death of 22-year-old Bosco Minyurano on Mother’s Day. The convicted domestic violence perpetrator had walked free from immigration detention just weeks earlier after a decision by AAT deputy president Stephen Boyle.

The reasons given by Mr Boyle relied heavily on the Direction 99 guidance handed down by Mr Giles in January 2023. Those directions included a call for greater tolerance of offending by non-citizens who had spent their “formative years” growing up in Australia, and Mr Boyle wrote that guidance was a key consideration that prompted him to overturn the cancellation of Saki’s visa.
