Nope, & being the sentencing on the charges rests with New York State, one would conclude the ability to 'unconditionally dismiss' is their prerogative as well.

I'm sorry Panther, but the convictions remain - no charges are being dismissed.

Oh, I see. You're after the judge's additional words, are you?

I'm afraid you'll have to read the article for that, Lee. I'd advise you to click on the link to Judge Merchan's ruling, it's all there.

Feel free to have a squiz, mill it over a bit, consider his arguments, references and case law precedents, including his rebuttal of the defence's "Alabama Rule", all in Judge Merchan's clearly written ruling, where he rules out dismissal absolutely.

Never ever, he says, absolutely not. Justice must be served.. DL will be sentenced in court, just like any other convicted felon found guilty by a jury of his peers. It would be a cold day in hell before a convicted criminal was dismissed from sentencing in the state of New York!

I'm paraphrasing, of course, but do feel free to click on the link and read it for yourself. You're no Trump supporter, I know, but I'm sure the Washington Post hasn't made it all up.

Yes that is correct. The bit at the end of the ruling also said that this finalisation leaves Trump in the position that he can appeal the convictions.

They think he will appeal the convictions but that could be a double edged sword as if he were to lose the appeal as he should that court could rule that this penalty is insufficient and give him a proper penalty.

Yes that is correct. The bit at the end of the ruling also said that this finalisation leaves Trump in the position that he can appeal the convictions.

They think he will appeal the convictions but that could be a double edged sword as if he were to lose the appeal as he should that court could rule that this penalty is insufficient and give him a proper penalty.


An appeal could backfire spectacularly.

At the end of his second (and last}, term he could find himself going to prison at the age of 82.

I'm sure his lawyers are advising him to shut up and just accept the sentencing, and I'm sure some of those lawyers will be:

a) ignored

b) sacked

c) never paid

Section 65.20 - Sentence of unconditional discharge
1. Criteria. The court may impose a sentence of unconditional discharge in any case where it is authorized to impose a sentence of conditional discharge under section 65.05 if the court is of the opinion that no proper purpose would be served by imposing any condition upon the defendant's release.
When a sentence of unconditional discharge is imposed for a felony, the court shall set forth in the record the reasons for its action.

2. Sentence. When the court imposes a sentence of unconditional discharge, the defendant shall be released with respect to the conviction for which the sentence is imposed without imprisonment, fine or probation supervision. A sentence of unconditional discharge is for all purposes a final judgment of conviction.

In a New York Magazine article published in June 2019, Carroll claimed the event occurred "in the fall of 1995 or the spring of 1996" - more than twenty years prior.

She claimed she did not report the event to the police.

At the time, the criminal statute of limitations on such accusations was five years.

If New York's authorities were not aware of it, that explains why Trump wasn't charged at the time or within the five years before the allegation became time-barred.

In June 2006 New York changed the law but the change did not retroactively apply to alleged crimes committed before 2006.

Carroll could make a civil claim because of the Adult Survivor's Act which amended the civil statute of limitations to allow "alleged victims of sexual offenses such as sexual assault and unwanted sexual contact in the workplace to file civil suits between November 24, 2022, and November 24, 2023"

Do you know how many Trump farmers have worked out that Trump is going to deport all their labor ?

Some farmers are saying that the shops will be empty in about 2 days if Trump keeps his promises.

How many Trump Businesses have worked out that Trump is deporting their labor. Building, factory workers, shop assistants, service industry workers etc. Then there is the Tariffs gonna hit Trump voters real big time. They are working it out.
