Vice President J.D. Vance and billionaire Elon Musk are furious with a federal judge, who has temporarily blocked Mr Musk’s cost-cutting team from accessing sensitive government data. The ruling came in response to a lawsuit, from 19 Democrat-run states, which argues Mr Musk’s DOGE team has no legal power to access key systems in the Treasury Department. Those systems are used to process trillions of dollars in government payments. “If a judge tried to tell a general how to conduct a military operation, that would be illegal,” Mr Vance wrote on social media.

“If a judge tried to command the attorney general in how to use her discretion as a prosecutor, that’s also illegal.

“Judges aren’t allowed to control the executive’s legitimate power.”

Mr Musk called for the judge in question to be impeached and removed from his job, calling him “corrupt”.

The legal question, here, is whether Mr Musk’s actions are in fact a legitimate use of the executive branch’s power, or whether his team is overreaching, and trying to exercise power it doesn’t actually have.

Elon Musk has labelled a federal judge’s decision to temporarily block he and his staff from accessing sensitive data from the Treasury Department “absolutely insane”. (You can read the details of that ruling, including the logic behind it, in the post below.)

“I’d like to propose that the worst 1 per cent of appointed judges, as determined by elected bodies, be fired every year,” Mr Musk wrote on social media.

“This will weed out the most corrupt and least competent.”

In case his target was unclear, he later added that the judge overseeing this lawsuit, Paul Engelmayer, was “a corrupt judge protecting corruption” who “needs to be impeached NOW”. Impeachment is the process by which a judge can be removed from their job.

Musk's comments about the Judge blocking DOGE access are extremely worrying for a number of reasons. The biggest of all is that he thinks anyone who doesn't do what he (or Trump) want should be fired. Is this not exactly how a dictator behaves? If the judiciary doesn't do their bidding, they get rid of the judicial official.

Vance claims that Judges can't control the Executive's power. He's wrong, because that is precisely what their job is - to strike down laws or Executive Orders from Presidents if they are deemed to be illegal and/or unconstitutional.

Have any of the DOGE staff had FBI background checks before accessing all this sensitive data?

Lawfare


If the executive branch is overreaching and taking actions that fall under the court's jurisdiction, then that means they're operating outside their "legitimate power".

These separations are in place for a reason.

The courts upholding the law isn't corruption.

What Trump is trying to do that he doesn't have the legal authority to do (bypassing congress etc), that is corruption.

Just because Trump doesn't understand that, and JD is happy to lie about it, doesn't make it Lawfare.

That's what's told to the ignorant MAGA faithful who know even less than Trump.

Exactly, but in the twisted, deranged mind of Donald J. Trump, if they don't do his bidding then they are corrupt and must be fired.
