A SPLIT has emerged in the highest ranks of the Victorian government over a secret meeting between Premier Ted Baillieu's most senior adviser and former deputy police commissioner Sir Ken Jones.

With his government mired in crisis over the turmoil at the top of the police force, Mr Baillieu yesterday defended his chief of staff Michael Kapel, saying his decision to meet with Sir Ken in February was appropriate and ''what we expect''.

But Deputy Premier and Police Minister Peter Ryan said the two-hour meeting was inappropriate and should never have taken place.''I would have preferred that [Mr Kapel] did not do that,'' Mr Ryan told ABC Radio.

Mr Ryan also revealed he had declined a similar offer to meet with Sir Ken.

Mr Baillieu said he had been unaware of the meeting between Mr Kapel and Sir Ken until he was informed by Mr Ryan, who found out only after being told by the Police Association the next day.

''Michael was contacted by Sir Ken Jones in good faith,'' Mr Baillieu said. ''Michael in his role meets with people all the time and that's what we expect.''

Mr Baillieu's claim that the meeting was initiated by Sir Ken contradicts earlier reports that Sir Ken was first approached by government
.


Mr Baillieu would not reveal what was discussed at the meeting but said nothing emerged that warranted further action.

Mr Ryan said he should have been informed of the meeting before it took place and any attempt to undermine Chief Commissioner Simon Overland would have been highly inappropriate


The comments place the government's two most senior figures at odds over the crisis that has engulfed the top level of the Victoria Police, along with the Office of Police Integrity and the Ombudsman.

The comments also highlight a growing rift in Coalition ranks, after Mr Ryan previously convinced his Liberal cabinet colleagues that Mr Overland be publicly reprimanded rather than sacked.

Many people within Government have many discussions with individuals related to their portfolios and I don't intend to go into the details of any discussions I may or may not have had.

Q. Have you met with Sir Ken Jones?

As I said, many people within Government are approached by a range of people in relation to their portfolio responsibilities and I don't intend to respond to any questions about private discussions I may or may not have had.

Q. Mr Baillieu said it was appropriate that Mr Kapel met with Sir Ken, Peter Ryan said he wouldn't have preferred that meeting went ahead. How come you are reluctant to say whether you met him or not, they seem happy to talk about it?

As I say, the Deputy Premier and Premier have responded to the matters that you refer to and I don't intend to comment on discussions I may or may not have had with individuals that may be relevant with my portfolio.

Q. You have said in Parliament that you haven't met with Jeremy Rapke, and you said in Parliament the number of occasions you have met with Gavin Silbert. Why won't you say whether you met with Sir Ken Jones or not?

As I said, ministers have discussions with a number of people on a private basis in relation to their portfolio responsibilities and I'm not prepared to comment on whether I have or have not had discussions with any individual under those circumstances.

Q. Why not? You are willing to say in Parliament on the public record whether you have met with some senior legal figures, why won't you say, in the interests of openness and transparency as your government believes in, whether you have met with Sir Ken Jones or not?

The comments that I've made in Parliament have related to questions as to meetings that I've had in a formal or official capacity and I've responded in relation to all meetings that I've had given that context. But as I've said, ministers meet with many different individuals in relation to their portfolio responsibilities and when those meetings take place on a private basis I'm not prepared to make any comment on whether they may or may not have taken place.

Q. Why is that inappropriate in a democracy, if the ministers of the crown are meeting with senior members of police, why wouldn't you just say yes or no?

Well, as I say, ministers across their portfolio responsibilities have a range of meetings on a one-on-one basis and it's not necessarily appropriate to go into the details of those meetings.

Q. What's the difference between an official and unofficial meeting?

Ministers meet with a number of individuals on a private basis and if those meetings are held on a private basis it is not necessarily appropriate to comment on the discussion that may or may not have occurred.

Q. So if you met him on a public basis you would say whether you met with him?

Clearly if I'd met with Sir Ken in an official capacity I would be happy to respond in relation to that.

Q. So you met with him on an unofficial capacity then?

Ministers have a number of meetings in a private capacity and it's not necessarily appropriate for them to comment the meetings they may or may not have had.

Q. Wasn't the Baillieu Government going to be more transparent than its predecessor about these very types of things?


I've simply responded to a question to say that ministers in their portfolio responsibilities from time to time have discussions on a private basis and it's not necessarily appropriate for them to comment as to whether or not these meetings have taken place

Buzz, as a champion of equal rights, what's your position on this?
A GAY venue in Collingwood has won the right to ban women to ensure its patrons are not subjected to attempts by predatory females to turn them straight.
VCAT has granted Sircuit Bar in Smith St an exemption to anti-discrimination laws, allowing it to ban women because they make the men uncomfortable.

"The applicant primarily relies on the exemption to exclude women from the venue, other than on Sundays after 3pm," VCAT reasoned.

"This is to ensure that gay men are not subject to attempts to change their sexuality, which reduce their comfort in the venue, which includes being fully accepted for who they are."

Despite the ruling, a spokesman for the venue said the club had never had a problem with women trying to turn gay men straight.

"We haven't had that problem here. But it does happen that women try and turn gay men straight," said the general manager, who wanted to be known only as Steve.

Sircuit is a two-level nightclub that includes pool tables, a maze, movie lounges, private rooms and a wash area.

The venue is an active fund-raiser and is regularly used by gay men's social and community groups.

VCAT said it was important gay men had a venue where they were not subject to disparaging comments.

"For gay men who wish to display affection ... those actions can readily lead to misunderstanding and disparaging comments which are not applied to heterosexual people," VCAT said.

"The applicants wish to provide a venue where it is safe and acceptable to openly express homosexuality."

The Human Rights and Equal Opportunity Commission did not wish to intervene in the decision, and VCAT said it did not contravene the Charter of Human Rights.

Human Rights Commissioner Dr Helen Szoke said she supported the exemption.

"One of the objectives of the EOA is to promote recognition and acceptance of everyone's right to equality of opportunity," Dr Szoke said.

However, Dr Szoke said complaints about women trying to turn gay men straight in nightclubs "would not be covered under our legislation".

Other gay venues have had less success in banning patrons.

Last year the Peel Hotel in Collingwood lost its right to ask people their sexuality before they were allowed to enter.

I haven't been there in about 20 years - from when I lived in Richmond (and was young and gorgeous)


I DON'T know SIRCUIT, so I'll use "The Peel" as a "template" - and GENERALISE

Over the years "The Peel" has had a NUMBER of these door policies and exemptions ...

straight guys
straight women
straight couples
Straight groups of people

etc.  etc ...

... and abandoned them with management changes - or legal challenges/warnings

I've known a few door staff over the years - and the reality is - they are RARELY - if EVER - applied or enforced

They are put there, for EXTREME situations and used at the doorman's discretion

For example - THIS exemption may be pulled out when a bus load of rowdy, pissed pack of bogan chicks from the western suburbs - out on a "hens night" - roll up for a "gawk at the poofs" as part of a pub crawl

It's kind of an "attitude code" applied in the same manner as a "dress code"

I don't believe a small group of girls - with their gay male friends - will be refused entry

NOR will lesbians
NOR will a decent looking hetrosexual couple

I can ONLY think VCAT sided with the hotel - due to a record of using discretion and never mandatory, blanket policy
I think this "ban" was the ONLY way they could be given these discretionary powers


NO hotelier turns away business on such a thing


Though - correct me if I'm WRONG - doesn't a hotel already HAVE the right to refuse entry/service to ANYONE, without giving a reason ?


For the record - I DON'T support the right of ANY business to refuse service (or discriminate) SOLEY on the basis of gender, sexual orientation, race, culture or faith


But on a LEGAL aspect, this is NOT groundbreaking
Fernwood gyms have a VCAT endorsed "women only" policy - due to women in leotards feeling uncofortable being "oggled" by men while they are doing their stuff

(note the similarity ?)
There's NO gym shortage in Melbourne


I think THAT'S  a reasonable case for an exemption

First blood: advisor quits over OPI scandal

An investigation by the Office of Police Integrity has claimed its first scalp with an advisor to Deputy Premier Peter Ryan forced to quit his other job as a policeman.

Senior Constable Tristan Weston had been working full-time for Mr Ryan while on leave from the force without pay.

Mr Ryan said Mr Weston had been working in his office as a ministerial advisor since March 8
.


His statement indicated Mr Weston would continue in his ministerial role.

"The adviser is currently on leave from his employment with the Victorian government,’’ Mr Ryan said.

Police Association secretary Greg Davies said the OPI had taped Mr Weston’s phone conversations and described the surveillance as "absolutely beyond belief".

Mr Davies called for a royal commission and said Victoria Police was in a "political crisis".

"This is a sad and sordid affair which seems to have a new revelation every day of the week," he said.

Deputy Commissioner Ken Lay said he had withdrawn approval for Mr Weston's "secondary employment" this week based on information provided by the Office of Police Integrity.

He had reportedly been the subject of an investigation by the OPI for misconduct.

Mr Lay said he accepted Mr Weston's resignation.

"While I appreciate the significant public interest in these matters, it would not be lawful for me to comment any further on what is an ongoing OPI investigation," Mr Lay said.

Mr Weston was defeated as the Liberal candidate for the rural seat of Macedon at last year's state election.

Victorian Premier Ted Baillieu on thin ice over police fiasco

PREMIER Ted Baillieu is confronting the fragile reality of a one-seat majority government today.

His parliamentary secretary for police, Bill Tilley, has warned that unless the Government addresses the fiasco surrounding the ousting of deputy commissioner Sir Ken Jones, he will consider the option of becoming an independent
.


Such a move would strip the Liberal/National Coalition Government of its majority and force it to govern in minority.

While it is unlikely that Mr Tilley, a former police officer and a conservative, country MP, would side with Labor,
it would be a devastating blow for the Baillieu Government for him to move to the cross-benches.
It is a week ago today that the police leadership crisis became a political fiasco, when the Sunday Herald Sun revealed Mr Baillieu's chief of staff, Michael Kapel, had secretly met Sir Ken in February.

Deputy Premier and Police Minister Peter Ryan was infuriated when he found out about the meeting the next day.

Several Government MPs are known to have serious concerns about Mr Kapel's actions.

They also harbour concerns about Sir Ken's treatment and the decision by Chief Commissioner Simon Overland to call in the Office of Police Integrity to investigate his former deputy.

But none of the MPs has bucked the party line - until now.


Mr Tilley, who was representing the Government when he opened the ski season at Mt Hotham yesterday, has displayed the courage and honesty that has been missing until now in this debate.

The straight-talking Mr Tilley, approached for comment by the Sunday Herald Sun, clearly expressed his concerns that there had been a
lack of transparency and integrity in the Government's dealings
with Sir Ken.



"I believe in full integrity. I believe in absolute transparency. Those were the words that were used going to the election, having an open and transparent government. And I don't take words very lightly,"
he said.

TED BAILLIEU - IT'S TIME TO ACT

Make no mistake, the government is in strife.


It no longer controls the direction of the biggest scandal in Victoria. But how the government deals with the situation engulfing Victoria Police will give Victorians a clear understanding of whether this is a good government, or whether those disaffected Liberals out there were right all along - is Baillieu the accidental Premier?


But Victorians are still getting used to Premier Baillieu.
For now, the Baillieu bicycle remains on training wheels.


The Premier is the front person and the buck stops with him.
And Ted Baillieu has some big decision to make.
Does he give in to the factions and cut Michael Kapel loose?
And what should he do now with Simon Overland, especially since the Rush review into Police command has been delayed until November.
That's a huge shadow cast upon the state's Police Commissioner at a time when local police are flashing their lights at speed camera sites.

Baillieu accused of hiding from drama

Premier Ted Baillieu has been accused of hiding from controversy following the latest twist in Victoria's police drama.

Mr Baillieu remained silent on Friday despite revelations Detective Senior Constable Tristan Weston, an adviser to Police Minister Peter Ryan, had resigned while under investigation from the Office of Police Integrity.

Despite quitting the force, Sen Const Weston remains an adviser to Mr Ryan on police matters and a liaison officer between Victoria Police and the government.

Mr Baillieu's decision not to front the media drew criticism from the opposition and police union.

"The premier, whenever the going gets tough, whenever there is questions to answer, the premier goes missing," Opposition Leader Daniel Andrews told reporters on Friday.

"The premier hides in his office and will not answer questions, and that is not leadership."

Police Association secretary Greg Davies said Mr Baillieu's silence had allowed the saga to drag on

CLANDESTINE dealings between Premier Ted Baillieu's office and ousted police deputy commissioner Ken Jones could become one of the first issues to be examined by Victoria's new anti-corruption commission.

Victorian Labor is considering referring unanswered questions surrounding a secret meeting between Mr Baillieu's chief-of-staff, Michael Kapel, and Sir Ken to the government's planned new Independent Broad-based Anti-corruption Commission, to be established this year.

A referral to IBAC -- a body designed by the Victorian Coalition to replace the Office of Police Integrity -- would embroil Mr Baillieu and Police Minister Peter Ryan and seriously embarrass the government.

School mergers in limbo as Baillieu says no to funding

DOZENS of schools that agreed to merge after being promised multimillion-dollar classrooms and buildings are now in limbo, with the
Baillieu government telling them it does not have the money
to fund them.

Parents and teachers say they are frustrated and disappointed after agreeing to amalgamate and, in many cases,
embarking on costly redevelopments
- only to find the projects may not get off the ground for several years.

Educati- each involving two or more schools on
Department figures show there are currently 38 so-called ''school regeneration projects'' -
which started under the former Labor government but will now require an estimated $750 million from the new government to complete. Of those projects, 25 have been partly funded and another 13 have received no money.

Some of these projects are already
part-way through construction
and putting them on hold has caused
great disruption to the schools involved
.

Strange.

Yet you defend Brumby's pressuring of the corrupt Victorian Police force to release incorrect and half-full crime statistics which paint a false picture just before an election.

The Victorian Police is corrupt from top to bottom and is the result of a decade of mismanagement and political interference.

The mess that VIC Police is in can be found at the doorstep of John Brumby.

Yet Buzz defended that sorry episode.

What a surprise. You're biased Buzz. Biased as all hell.
