The Australian Customs ship Oceanic Viking gathered evidence for the case in the summer of 2007-8 and mediated between Japan and Sea Shepherd activists who boarded a whale chaser.

The Environment Minister, Tony Burke, said the government had made no decision on whether it would monitor Japanese whaling this summer. Whaling activity this season was likely to be mainly in the Ross Sea region for which New Zealand had search and rescue co-ordination responsibility.
