Its an opinion Prevailing,
but a carefully thought out one
...just like the fact that Politics should NOT be the 'Power' in South Africa regardless if it is black or white, Mandela or Botha.

The Age of Politics via the USA is coming to an End..
The Age of Art via Australia is begining.
Only Military then Music to go via South America and the Occidental.

...you do know where the Occidental region of the world is, don't you Prevailing? Huh

Section 3(1) of the Criminal Law Act 1967 provides that:

Section 3(2) states:

    "Subsection (1) above shall replace the rules of the common law on the question when force used for a purpose mentioned in the subsection is justified by that purpose."

This abolished common law rules on what was "reasonable," such as the duty to retreat. Thus, reasonable force can be used in the prevention of any crime or in making an arrest to:

    allow the defendant to defend himself from any form of attack so long as the attack is criminal.
    prevent an attack on another person, e.g. in R v Rose (1884) 15 Cox 540, a young son shot dead his father to protect his mother from a serious assault, believing that this was the only practical way of defending her given his small physical size.
    defend his property against criminal attack in the widest sense, i.e. it can be physical possessions like a watch or credit cards demanded by a mugger (where there would also be physical danger to the owner) or, at the other extreme, possession of land.

The Human Rights Act 1998 incorporates into English law Article 2 Convention for the Protection of Human Rights and Fundamental Freedoms, which defines the right to life as follows:

    "1. Everyone's right to life shall be protected by law. No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which this penalty is provided by law.
    2. Deprivation of life shall not be regarded as inflicted in contravention of this Article when it results from the use of force which is no more than absolutely necessary:

        (a) in defence of any person from unlawful violence;
        (b) in order to effect a lawful arrest or to prevent the escape of a person lawfully detained;
        (c) in action lawfully taken for the purpose of quelling a riot or insurrection."

Only the Military should have Guns and if 'that' Military is corrupt, then it is a matter for an Unified Military Force that isn't at the whim of the Political United Nations.

Maybe Juliar Gillard should carry a Gun, then do an operation, then create and animated movie, then stage a Rock Concert ...all upon a PROFESSIONAL agenda of course. Wink

Like I said: The USA Political Empowerment, difuses the Military as the 2nd most powerful Industry by allowing 'anyone' to possess a Gun. They even gave Saddam Hussein weapons to fight the Ayatollah Khomeini, then look what happened. Roll Eyes

Sorry - but the right for 'General Public' to bear arms is just downright stupid and serves no purpose but to make the Military look 2nd best.

So there - no sympathy from me for those massacres. More to come for sure.

The mother of the Teenager who broke into the man's place instigated charges for assault against the man. The mother and boy won the case.

In a crowd of many varied professions - I should only expect a person dressed in Military garb to be in possession of having a gun. To think that everyone else does - is plain neurotic and if they do ...just to justify myself having to spend money and buy a gun too is even more neurotic.

Stupid world we currently live in.

I would be interested in knowing where Robert Milton Holmes, the father of James Holmes, worked before 2000. If anyone has this information, please send it to me.

On his Linkedin profile Robert Holmes lists a University of California, Berkeley Ph.D. in Statistics from 1981. He currently works for FICO, but also lists working for HNC Software from 2000 to 2002. (HNC Software was acquired by FICO.)

We have a DARPA link in HNC Software.
