More than 90 Ekka workers underpaid: watchdog

More than 90 Sideshow Alley workers were underpaid during last year's Ekka, an audit by the Fair Work Ombudsman has found.    Sad   

The Fair Work Ombudsman has managed to recover $11,094 for 95 carnival workers underpaid an average of $116 each.

Of 57 stall holders audited by the ombudsman, six were found to be underpaying their employees.

"There was a high contravention rate in relation to the base rate of pay and other entitlements of musicians, entertainers, performers and creative artists," a spokesman for the ombudsman said.


In one case, a worker was paid the minimum part-time rate of $15.51 per hour over the 10-day show when they were entitled to the casual rate of $18.92 per hour.    Shocked

The ombudsman's office found many stall holders had only verbal working agreements with their employees.

But in the absence of a specific written agreement, the Travelling Show Award stipulates that a worker is deemed to be a casual employee.

Another three investigations are yet to be completed, because auditors have had difficulty contacting travelling stall holders.

The Office of the Fair Work Ombudsman decided to visit the Ekka after receiving a number of complaints from workers immediately after the 2008 and 2010 shows.    Huh

Business owners can use the websites' PayCheckPlus and Award Finder services for assistance calculating their employee's wages.    Wink

The national minimum wage acts as a safety net for employees in the national workplace relations system to provide minimum rates of pay for employees not covered by awards or agreements. National minimum wage orders are made by the Minimum Wage Panel of Fair Work Australia.

Australia's minimum wage is $15.96 per hour or $606.40 per week. Generally, employees in the national system shouldn't get less than this.    Huh

An employee's basic rate of pay depends on such things as their age, job classification and what industrial instrument they're covered by (e.g. a modern award, pre-modern award, transitional Pay Scale, workplace agreement and so on).

The minimum wages received by employees in the national workplace relations system are reviewed by Fair Work Australia annually, with any adjustments taking effect from the first pay period on or after 1 July each year.
The review considers the rates of pay in:

    modern awards - from 1 January 2010 these specify the minimum wage rates for employees covered by a relevant modern award (subject to any transitional provisions)
    The national minimum wage - this applies to award and agreement-free employees.

Employers and employees cannot agree to a rate of pay which is less than the applicable minimum wage. An employee may also be entitled to other allowances or loadings, depending on the job they do (e.g. a casual employee may be entitled to a casual loading).    Wink
