Chances are the person was innocent & a confession obtained by torture -

Technically they cannot be war criminals because Palestine did not ratify the Rome Statute because that could see Palestinians liable for unislamic war crimes when it comes to itbach el yahud(slaughter the jews)

Israel is not in Gaza officially but they are still occupying Palestinian land around it.
Anything that would be done with Israel inside Gaza is done just as easily outside it, they control all aspects of life.
