It's not illegal to hire a contractor.  But......when you then direct him in the same manner of an employee, he is no longer a contractor and becomes your employee to whom you have additional legal obligations.

I have seen many work places where contractors and permanents work side by side in teams.

You have legal obligations to a contractor as you do with a permanent employee.

Its John Smith moronically throwing around red herrings, being a self employed contractor is a perfect moral and legal way to practice work, in fact the its the basis of unionism in this country as back in the shearing sheds, they were self employed contractors and the union championed their cause. Not sure who unions represent these days beyond them selves, the majority of people are on common law contracts or other legal arrangements.... which unions are not interested in representing, they are stuck in the technical trades / manufacturing sector which is a shrinking group.

Governments of both sides struggle to understand the big growth area of small business / self employed contractors ..... the ALP even refuses to recognise them.

The only Red Herring is whats floating around between your ears , or is that jelly fish? .... you don't think employers hire 'employees' as subcontractors?  Get out from in front of your computer every now and then and go out into the real world  (ask mummy for permission) . I've seen it hundreds of times myself.

An employer has the right to choose whether they want contractors or not.

They can directly hire people, they can hire people through a labour hire company or the can hire a contractor.

Often contractors earn 2-3 times what the permanent staff member does and even with that they could still be cheaper.

It depends on whether you have enough work for them or not.

A well structure company has a set of core staff that administer and maintain IP, beyond that the number of people you employ is mapped to business activity. Casual and contractor staff are great for those peak periods.

Go have a look at the rules and have a go at the assesment tool.

If you are starting a genuine business you will get an ABN - if it is only a pretend business or rort you won't.


'pretend' or 'rort' has come to mean new things under the union-driven labor party. a number of analysts have commented recently about the difficulty in getting an ABN.
