Hear hear Nail,
also:

I have a friend who doesn't speak well in public & I asked a solicitor whether I could read out
his statement in court for him.

I was not allowed to.
He had to hire a barrister to read it which cost over $500
just to read a silly statement!

What a rip-off & it was just over a council matter concerning a dog.

that sounds like a monopoly. What a disgrace Sad

And to think that a lot of these lawyer types end up in politics making new legislation to provide new business opportunities for their lawyer mates Sad

if you know the LAW.. then there is no LAW that says you have to use a lawyer/solicitor..

if you think you are as smart as them... feel free.

I dont think they would be able to charge what they do.. if they were not worth it..

there are rip offs of course like in every walk of life..

but if thats what it costs for someone who knows more than you do..

then get an education...

and see what you will charge when you have your Law degree..

have you been to a dentist lately??????..$250 for 10 min.

But why couldn't I read my mate's statement out?

You should have been allowed to.  It is a discretionary thing ~ the Magistrate/Judge may allow a lay person an opportunity to do something like that.  You struck one in bad mood or you annoyed s/him somehow.

The easy way around it was to hand the statement up to the Magistrate/Judge.

Further, I'm surprised it is 'only' $360.00 an hour now.  When I retired about ten years ago, I was chargeing $300.00 an hour.

I'm surprised the solicitor didn't advise you along the lines of.."it's up to the Magistrates' discretion.....s/he may not allow it......if not allowed, the statement can be handed directly to the Magistrate."

To simply say you are not allowed is incorrect advice.

we are after all assuming it is a true stoy. it is booby after all!

It was a large fine but I won't give the exact amount
because the matter is really confidential.

Yes. Thats why you are blabbing details on a public internet forum.

You can represent yourself but then  as the old saying goes, you may well have a fool for a client.

I had to pay $330 for an hour with a family law solicitor.

However, the advice I was given was pure gold and saved me a lot of money and angst, sometimes you have to pay for the experience of the person sitting across the table from you.

Good legal advice can save you a fortune as well as cost you one.

Why would you ask that?  If you want a one on one exchange with Bobby, you can PM him.  If you post in public, the public will reply.......even unsolicited.

I can tell you this.  In matters of property, more often than not, you will end up paying the Lawyers far more than the value of the property in dispute.....unless the cake to be carved is huge.

Very true - I know of an estate worth $80 grand was not worth contesting but
another one worth $860 grand was - which was subsequently won.

Hey Bobby.........trying to get my head around this.....did your friend plead guilty to the pooch charges????

Yes he did even though he was not guilty.

It was:
(1) a dog at large - ( the gate wasn't properly shut & his dog was no more than 5 meters from the front gate)
(2) his dog biting another dog - ( false as there was no mark or injury )

The dog is super friendly & wouldn't harm an ant.

He followed his lawyers advice because he was told it would cost $7,000 to defend otherwise.
It still cost him $2,000 which included a barrister for $500 to read out a silly statement full of falsehoods & fake remorse.

Now he doesn't want to pay his lawyer.

like I said they charge like wounded bulls and never guarantee their work Sad

What sort of guarantee do you expect a Lawyer to give you?

I don't know. Perhaps a no-win-no-fee guarantee would be fair Wink   When I pay for goods I expect to get something that works and is fit for its intended purpose and if it breaks down I expect to get it repaired or replaced !! Some how that rule doesn't apply to high priced legal services Sad

Hear hear Nail,
& that no win no fee thing is a scam -
you still have to pay the costs of the other party if you lose.

no you don't.  the judge has to make an order regarding costs and even then it doesn't cover ALL the costs.  Where do you get your info from?

I think your definition of 'closed shop' is a group that demands you earn a degree qualification to join. How evil!  Don't we all want to be operated on  by someone who learned surgery at Tafe or via an online youtube video?
