*there is no penalty in Islamic law for being raped.
*Islamic law carries the death penalty for rapists.

Your statement is incorrect on a number of levels. The issue of consent is important in Islamic law. In Islamic law, a rape case has a lower burden of proof, which further helps to act as a deterrent to rape.

If a woman says that man had consensual sex with her, he would not be convicted on that evidence alone, and vice versa. If she says that he raped her, he could be convicted on that evidence.

The crime of rape is also considered to have a victim who is entitled to compensation.

In Islamic law, a rapist potentially faces punishments such as whipping, and/or jailing, and/or exile, or stoning, crucifixion or amputation, so the punishments are potentially quite different.
