As your postscript says, the Palestinians have not ratified the Rome statute or anything else that would give the ICC authority over Israel for war crimes, if they do ratify it they will be liable for war crimes as well, firing unguided rockets into Israel from Palestinian territory is a war crime which means Hamas is guilty of thousands of war crimes!
