Incorrect.

Seeking asylum, in a boat, without a passport or visa in not illegal.

You have been misinformed.

Well it is illegal, until you claim asylum.

incorrect, their entry remains illegal regardless of asylum seeking status. The law is quite clear on this point, anyone who enters Australia without a valid visa does so ilegally.

do you enjoy repeating the same nonsense? It isn't illegal.

Normally repeating the same thing that has been proving to be false is a sign of mental disease. You need to check yourself out.

re teddy / Ian

1) Wasnt there another riot earlier last year, that killed one Iranian asylum seeker and injured 77 others?
2) Many people there had been in detention for a long time.  And even if they are found to be genuine refugees, there is no certainty when detention would end.    As even though, Australia believe that all refugees there will be resettled in PNG, the PNG government does not agree.
3) Such condition would creat and aggrevate mental health illness, further desperation.

And when everything bubbles over, riot / hunger strike will happen.  This is not rocket science.  Basically, these people are there without any hope.

Teddy, put yourself in to the same situation,  what would you have done?

Not happy with Rudd's policy then?

No, not at all.

Are you?

Only good thing he did.

Why do you think it's a good thing?

The less uninvited illegals, browns, blacks and muslims entering Australia the better.... Wink

Why do you think it isn't?

I agree: I don't want illegals in the country.

Asylum seekers aren't illegals though.

Moreover, the colour of an asylum seekers' skin, or their religion, doesn't bother me in the slightest.

So, why are you against the humane treatment of asylum seekers?

Yes, I just put the illegal bit in for you and the UN, who think they are illegal entrants. The verdict is in don’t you know!!

The UN doesn't make legislation (i.e. laws).

They aren't doing anything illegal (i.e. contrary to or forbidden by law).

Simple.

"Ellen Hansen from the Canberra office of the UN High Commissioner for Refugees told ABC Fact Check that:

"the term 'illegal' is not one that UNHCR uses or encourages the use of in relation to refugees or asylum-seekers arriving without a visa".

no it's not ... as long as they are making their way to an entry point or person of authority from whom they can claim asylum nothing they are doing is illegal

Doesn't seem to be doing them or anybody else much good though John, so why don't they just bugger off where they will be welcome.

No, it doesn't at all.  You've been misinformed.

The Protocol Against the Smuggling of Migrants uses the term 'illegal', as does the Convention Relating to the Status of Refugees.

However, a protocol in itself does not actually make anything illegal.

That's determined by our legislation (i.e. Acts), and people entering Australia without a visa are not referred to as 'illegal' in Australia's Migration Act.

Asylim seekers have not committed any crime, nor broken any Australian or international law.

Simple.

"Allegedly" persecuted.

Sri Lanka (an ally of Australia) believes them to be economic migrants.

And moreover, since the end of the Tamil rebellion, the lawful govt of Sri Lanka (a new one btw) has given assurances there will be no persecution.

As for the rest, the Iranians, Iraquis, Afghans and what have you, are we to admit these very possible sources of future malcontent and subversion to our shores in ever-increasing numbers? Which as we have seen - have you forgotten already? - will rapidly become the case as soon as we buckle to their pressure.
Let them enjoy the pestilences of PNG or travel back the way they came.
