I wonder if cods et al will accept the decision if the High Court (should there be an appeal ~ as opposed to yet another schmedia report there might be one) also concludes that a manslaughter conviction was the only one open, on the evidence?

the answer is NO......because it should go back to court..IMO.

It did, cods.

How many times do you need to be told?

I ONLY SAW .......DRUM ROLL

ONE TRIAL....

Make up your mind, dear.

You said 'court'.

Now you're saying 'trial'.

Do you have any idea whatsoever what you're on about, because nobody else here does.

OH GOD..

numpty and dumpty wont approve of this...

QUEENSLAND’S top prosecutor has privately told the Queensland Government he will appeal to the High Court to reinstate Gerard Baden-Clay’s murder conviction.

Director of Public Prosecutions Michael Byrne, QC, informed the Government before Christmas he intended to file for special leave for an appeal on January 4 – the eve of an appeal deadline and same day the High Court’s registry reopens after its holiday shutdown.

I am now going to read alintas LINK word for word.

So, you have been posting about it, and you had not even read it?  Why am I not surprised.  That decision is the only thing which is relevant in this entire discussion............and you have made post after post being critical of...............what you have not even read.

Jesus wept.

I am surprised in this case they didnt blame Alison...for nagging maybe..

One of the possible reasons for the existence of 'her' fingernail scratches (if indeed that is what they were) on his face was that she may have come up behind him, clawed his face and in some instant reaction (not involving an intent to kill) of his, she died (remember also.....there is no evidence as to the cause of her death....so all reasonable bets are on.)  I never did see any evidence of any tissue found under her nails or an explanation for the lack thereof.

Coulda Woulda Shoulda!

IF I recall, the Forensic Science Report was "inconclusive" ... because he had dumped her body (in water) and it wasn't found for 10 days(?) She would have been well bloated, probably covered in "maggots", black and unrecognisable. DNA from "under fingernails" was long gone.  Sorry to be so graphic.

He blamed the scratches, firstly on a "shaving accident" and then "a caterpillar". ROFLMAO

There is, of course, the PHONE CALL to the Insurance Agent he made BEFORE she died, that the Police found and the Prosecution omitted to use. She had also tried to change the Insurance Police before she was murdered.

He was in HUGE debt and they should have gone for the reason that he got rid of her because he needed the Insurance Money ... originally $1 million, although she tried to change that due to the cost of payments .... or something.   It's all online.

GBC is NOT stupid but he IS a MURDERER and should spend the rest of his miserable life in Gaol.   I read somewhere that he was a favourite of some of the "screws" and is on "lunch duty" or something?  Pathological LIAR. Conman.  Creep.

Why post crap like that cods?  I am looking forward to the entire process, and that will kick off when the grounds of appeal (to the High Court) ~ if there is one ~ are made known, I guess on the 4th or 5th January, 2016.

They don't agree that the Court of Appeal is a court - really?

When did they say that, dear?

As a Rule I do not respond to Neferti because she posts outright lies, but this needs to be debunked or proven.

Opinion?

My dear, it's a fact.

The Court of Appeal is a court.

Who told you otherwise?

The Court of Appeal decision (linked by Alinta above) is not long.  Read it, and then tell me where that Court's conclusions are incorrect or not open.

I've read it. You are correct, it isn't "long".  IT is, obviously, Open to Interpretation ....
Like everything else around here.

Aussie,  I can't get past the Courier paywall, but this link works.  If correct, I'm failing to understand that with due diligence this was not uncovered before trial.
