Using both my eyes, I can see they said:

Quote:
Manslaughter has the same max sentence as murder being 15 yrs except that it is not mandatory so the sentencing judge will decide the jail term.

I see nothing about parole (using both my eyes.)

QED.

We do not have 'Attorneys' in Australia.  We have Lawyers (a recent enough Americanism) or Solicitors or Barristers.

Your Guru is fake, and they are also posting garbage.

Gerald Baden-Clay is a MURDERER.  He murdered his wife, whether, intentionally or accidentally, who knows.  He then took her in his car and DUMPED her over a bridge, while his little girls slept. Then he cried because he "didn't know where she was" ... blah blah blah.

He deserves LIFE in prison.  He obviously sweet talked some Queensland "Attorney" to get his sentence reduced from Murder to Manslaughter .... why? If the sentence is the same ... is he hoping to get out early? Did the Taxpayers pay for this Appeal?

You didn't dispute that he has NO MONEY and can't claim any of his former (murdered) wife's either?  He is a Jail Bird and should remain in custody for at least 25 years. "Life" in Oz is only that, isn't it?

This is a QUEENSLAND Murder case so you, as a retired Defence Lawyer, should be able to at least make a "prediction" of what the Judge might sentence this creep for in January. Hopefully, his "appeal" will go UN-noticed and he will remain in his 10x10 cell for the next 15 years to LIFE, at least.

yeah! make it manslaughter after all there no bringing the mother of his daughters  back is there. Angry Angry Angry

Which is beside the point.

The problem is there was a plausible alternative explanation, which gives rise to reasonable doubt. That's how it works.  [/quote]

I like it...

when you kill someone there is always an alternative explanation.. Roll Eyes Roll Eyes

you mean

apart from someone being DEAD of course.

or maybe.. APPEARING TO BE DEAD>

should that be ALLEGEDLY DEAD... just to be safe..

its hard to tell these days...

by the time some are finished with the system... we end up owing them.......and they come out HEROs..

gosh I hadnt looked at it that way.. Angry

I agree with your websleuwth...

did you know during all the search time.. I think about a month... he never looked for her ONCE....he only turned up at the makeshift HQ.. once...he never talked to Allisons family...

Not my "guru", arsie.  Somebody that the Websleuths Forum/Board has "verified" as genuine. I don't make the Websleuth "rules".

So can YOU explain the Queensland Defence Lawyer's take on the Baden-Clay case/result of the Appeal?

People do not understand the difference but I gather it is "premeditated = murder" and "unintentional = manslaughter".  It is still killing someone! Nothing "accidental" about it.

Hope he rots in gaol. The bastard.

He won't.  He'll do about four years max, with some discounting for time already served.

The decision means he caused her death but had no intent to kill her.  Huge difference to murder.

Geeze, isn't that what I have been saying ALL through this thread?

Regardless of how many "years" he serves.  He will ALWAYS be a MURDERER. His girls will hate him for taking away their Mother when they needed her.

So, Domestic Violence, resulting in DEATH is ONLY Manslaughter in Queensland?

Then the bastard tried to get out of it .... what sort of shaving equipment makes scratch marks?

He dumped her body.

I don't recall you referring to 'four years.'  Perhaps you can show me.

The death of someone at the hands of another who had no intent to kill is not a 'murder.'  It is, in Queensland, manslaughter.  Sometimes it is 'Dangerous driving causing death."

I know it is a clever thing to rave on about what allegedly happened to 'her' after she had died......but, if you take the emotion right out of it, as the Law will, at that stage, she was a cadaver, the same thing medical students carve up at their Unis.

Great and original thought Mr R Neck.  You seem to have forgotten to answer this*:

That's because it was YOU, arsie, who mentioned  "four years". Not me.  Grin  I'd get my head checked out if I was you. You are losing it.

You are really, really HOT with your FREE advice today, arsie.  Grin

EVIDENCE, obviously. That's where the POLICE investigate.  Defence Lawyers, just get paid to TRY to get the perpetrator off with a minimum sentence.  Have you ever had to defend somebody who has committed MURDER, or just DUI (traffic offences)?

You sound to me like you have never acted for anyone other than a traffic offence, or a divorce. IF I had a Legal Problem, you (judging by your comments here) would be the LAST PERSON I would contact to "defend" ME.  Roll Eyes

It would not matter to you how I answered that, so, I will not bother.  If you ever had walked into my Office 'on fire' seeking my assistance, I would, as a deliberate matter of choice,  have gone to the toilet and made better use of the waste product washing down the urinal.

he didnt want her to go to the  Real Estate conference where his mistress would be...?????....

what does INTENT MEAN....does it mean you have to intend doing the person harm before you challenge them...?? which would be almost impossible to prove unless you found a plan they "intended" to work too..

does DOMESTIC VIOLENCE rear its head in these cases??????????......

if he didnt intend to KILL her.. did he intend to cause her any harm at all... Roll Eyes Roll Eyes Roll Eyes

or did she manage to fall all by herself.. and who knows maybe did herself harm at the bridge before she fell over it.....

the DIckie family must be devastated   they would have looked into this blokes eyes....and seen the coldness...

to have play acted like he did before she was found... would take some cold bastard thats for sure....

somehow Allison will be all but forgotten now whilst his miserable lawyers fight for his lousy release...

one thing nef he wont be able to hide will he..and they can keep him in Qld... see where there been  another murder suicide up there.. Roll Eyes Roll Eyes Roll Eyes

alive one day dead the next...an 11 year old allegedly  killed by her mother..
