have you read the coroners report.....that alinta kindly put up..

he says... you can strangle someone without breaking anything..[he uses all the right words]...if the cloth used is thick enough and wide enough..

her jacket was pulled up round her throat with both her hands caught up in it...

I've read the Report cods.  Did you miss this bit?

Quote:
As previously noted, the jumper may have come to be located up around her neck area by other means.

When he said 'by other mean,' he was referring to means other than strangulation.  Even the Coroner was unable to conclude she was strangled, cods.

Back to the drawing board you go.

(Are you personally abusing me...again?)

and her arms entangled in it... Roll Eyes Roll Eyes Roll Eyes

oh forget that bit.

No I did not.  Neither did the Report, and it referred to that but still concluded....'As previously noted, the jumper may have come to be located up around her neck area by other means. "

It also ended by saying that the cause of death was 'undetermined.'  Now, unless you are some sort of scientist better qualified than the bloke who wrote that Report....I suggest....you go back to the drawing board.

Got an answer yet to the question?   Do the facts set out in that scenario establish beyond reasonable doubt that the teenager with the cut in his hand intended to destroy the ornament?

Aussie so good to see you back on thread even if it is with your war of attrition with poor old Cods.

Curiously I have found your posts on the legal aspects of this case 'wanting' first time I've seen that from you.

Fine.  Let's have your explanation, not your rhetoric.  My views are sound and have the endorsement of the Appeal Court of Queensland.

really... you read them do you??.... Roll Eyes Roll Eyes Roll Eyes

to me there is a 50/50 chance of someone being wrong and the other right..

this isnt so much about LAW... as what someone sees as BEYOND DOUBT.....

when the only witness is the accused....no one knows what was in his mind... when the person died......

he could have totally lost it when she scratched him..just long enough to kill her....dont forget this was a man used to getting his own way 100% and his world is falling apart...

what ever the law says....BEYOND A SHADOW OF DOUBT....is almost impossible to prove.....so err on the accused side...... that way he cant sue us later.....

the victim is dead...all we care about is the living...

Aussie would you care to nominate who has endorsed your views from within the Queensland Judiciary and what views...all of them?

All I can say is WOW!!!!!! You have achieved a miracle!!!!

All wrong....yet again.  The Law requires proof beyond reasonable doubt....not beyond a shadow of doubt.  Why do you make this schitt up?  You whinge like a stuck pig when I (politely) try to help you understand, and yet you still have no idea.

Are you yet willing to answer the question attached to my scenario, or is the obvious answer too uncomfortable for you to confront, cods?

Somewhere up there ^^^^^^ you will find a link to a Thread where I expressed exactly the same view that the Court of Appeal came to.......before their decision was released.  Kytro also was right on the money.  I'm not going to apologise for being vindicated.

That IS the problem. What WE can't comprehend is that GBC, throughout all of this has DENIED having anything to do with Allison's death. Yet he now has convinced Those in Authority that is was an ACCIDENT.

What is it?  He wasn't there when it happened or he didn't do it, or somehow she threw herself over the bridge?

I imagine that the little girls were told what they could and could not say!

Best answer to that is to point you to my scenario.  Where  there is proof beyond reasonable doubt that the teenager with the cut in his hand intended to destroy the ornament.  He too lied...he too tried to cover up.....he denied all knowledge and involvement......he too 'rang the insurance company'.....his prints were all over the fragments found in the bin...
