'the law is an as' was mentioned to say that everyone seemed to think it should be the beast of burden for all their  personal issues .....

.......now with the advent of Rabid Feminism - the Law has indeed become a beast of burden for every whine they have.. or even imagine.... and that is an escalating problem with 'law', 'legislation', 'regulation' and Law... and is Hell bent on confrontation between the four.....

Will The Rule Of Law prevail?  Or will one or more of the others?.

An escalating burden on society.. but most of you missed it...... and will do so to your graves.....

A case based on 'circumstantial evidence' is not sound, and therefore there is every opportunity for a judicial review to - if not overturn a jury finding - find that a possibly lesser charge and conviction should stand...

But that's just legal chicanery - and is NOT the Rule of Law, which requires conviction beyond ANY possible doubt....

I may well believe the man is guilty - but in Law I cannot, on the evidence...... find that to be true.......

That is why we HAVE a Rule Of Law - so that personal feelings do not impinge on the facts as required by Law.

If - for example - you were standing on a roadway, waiting for a discussion on your kids and property..... when your ex-missus was killed within ten yards of you by a passing truck - are you guilty of killing her? Or of even organising that truck to hit her and kill her?

Unless you can prove links and intent, there is no case........ love it or leave it.

over 70.000 have signed the petition and there's also going to be a rally in Brisbane to let these judges know that they are out of touch, in fact, they've lost their marbles

It's about if they have a basis for an appeal or not. You can't appeal because you don't like the outcome, there has to be a legal mechanism for it and you feel it's unreasonable isn't one of those mechanisms.

JUDICIARY ACT 1903 - SECT 35A
Criteria for granting special leave to appeal
                   In considering whether to grant an application for special leave to appeal to the High Court under this Act or under any other Act, the High Court may have regard to any matters that it considers relevant but shall have regard to:

                     (a)  whether the proceedings in which the judgment to which the application relates was pronounced involve a question of law:

                              (i)  that is of public importance, whether because of its general application or otherwise; or

                             (ii)  in respect of which a decision of the High Court, as the final appellate court, is required to resolve differences of opinion between different courts, or within the one court, as to the state of the law; and

                     (b)  whether the interests of the administration of justice, either generally or in the particular case, require consideration by the High Court of the judgment to which the application relates.


OK.......according to an article I read this morning the AG has filed a Notice of Appearance and now has 22 days left to lodge an application for Special Leave to Appeal......criteria as above. 

Whether or not eminent legal minds can find compelling argument to support such application (obviously) remains to be seen, however public outrage over the downgrading of sentence, however well intentioned, is of itself, insufficient.

That said, I see scope for the public to channel its efforts towards  DPP Sentencing submissions to the Qld Supreme Court of Appeal.......guess that will probably occur if the High Court appeal does not proceed.
