I thought I read something the other day about the prosecution not persuing some particular point hard enough in the trial. Cant recall what it was at the moment.

Therefore I would prefer a retrial to allow this, unless of course the prosecution believes they have a strong case for the appeal.

Will watch with interest.

That was ~ Baden-Clay contacted the Insurer of Allison's life after her death about her Death cover.  It was referred to in the Trial and in the Court of Appeal.  It is not 'new' evidence uncovered after Trial, so that renders it water under the bridge.

Thanks, Aussie, for ruining yet another thread by providing clearly thought out, logical arguments based on facts and readily available evidence that proves your point beyond all doubt, and completely shoots down the "arguments" of those who rely solely on ACA, 60 Minutes, and talk-back radio gossip.

You bastard.

No need to thank me.  It's what I learned at Graffiti School, the graduates of which Lord Herbert finds offensive because they are always ruining his Threads with cold hard facts as well.

I can certainly understand Herbert's frustration.

In his (Walter Mitty) world, all that matters is bigotry, misogyny, sexism, racism, irrational fear, hatred, and Islamophobia.

I'm sure that facts are very confronting for him.

Poor dear.

Yeah I think that was it he contacted her life insurer on more than one occasion cant recall exactly when, but to me made him look guilty. (Of something I guess is the current point)

The Prosecutor (correctly in my view) did not attempt to push it as proof of anything other than the fact he made the contact, and that he did was not hidden from the Jury.

Had there been grounds to support it, the Appeal Court could have ordered a retrial and I expect would have done so.

Indeed, I too will be watching with interest.........in fact I'm itching to scrutinise the grounds for appeal to the High Court....

Look guilty?

What are you talking about?  He is guilty.

On ACA and 60 Minutes they showed grainy footage of him walking out of his house in slow motion with menacing music playing over the top.

Moreover, 99% of people who call talk-back radio shows say that he's guilty.

Confronted with evidence like that, how can there possibly be any doubt in your mind?

Seriously?

As you are in Qld, are you able to clarify anything about current articles suggesting Baden -Clay contacted Allison's life insurer a couple of days before her death????

I wonder if cods et al will accept the decision if the High Court (should there be an appeal ~ as opposed to yet another schmedia report there might be one) also concludes that a manslaughter conviction was the only one open, on the evidence?

the answer is NO......because it should go back to court..IMO.

It did, cods.

How many times do you need to be told?

I ONLY SAW .......DRUM ROLL

ONE TRIAL....

SHOW ME WHERE THERE WAS ANOTHER..

YOU SEE THE COURT OF APPEAL IS NOT WHAT I PRESUME TO be a TRIAL.......

it can up and change the charges to whatever they see as law......just for the few... of course... numpty being one of them... hilarious.

CHANGE THE CHARGES...REALLY?

HE WAS EITHER FOUND GUILTY BY A FAIR TRIAL... OR HE WAS NOT GIVEN A FAIR TRIAL...

;LETS DO IT AGAIN....

as it is MANSLAUGHTER   doesnt carry half the stigma of a MURDERER....

in fact they are trying to make it look very much as if Alison/..ASKED FOR IT????....

you dont agree thats fine... please dont use my id again in this case... because i dont want to be banned...

you and numpty can think what you like.. I am not interested ..

I am now going to read alintas LINK word for word.
