I have read the Judgement, again, especially Pg 14.

My interpretation of the decision has not changed. GUILTY of murdering his wife.

Reduced to Manslaughter because he is still in denial.

He should also get a few years for perjury.

I feel very sorry for the 2 daughters.  May Gerard B-C rot in gaol or consider topping himself as he is one useless male.  His kids don't need him.

RIP Allison.

Nice photo of a piece of expensive stuff over a cadavar.  Enjoy!

Tell me what was in page 14.  "Perjury???????"  Blaaddy hell.  Let's be brutal, as one must.  When it comes to guilt or not....at Law....no-one ought (or should) give a stuff about his/her kids.

A question as I'm not familiar with many sentencing details relating to Queensland.

When Baden-Clay is resentenced for manslaughter next year, is it sent back to the Supreme Court and will it be the original trial judge who passes sentence ?????

Odd.  Looks like the Appeal Court is going to sentence.

I've already asked Mr R. Neck that very question, and then he ran off.

It was a strange comment.

I'd really like to hear his answer.

This is what's called  A DOG'S BREAKFAST...A DOG'S LEGAL BREAKSFAST.

Right before your eyes ladies and gentlemen. You see a convicted Murderer turned into some sort of lame arse crim who accidentally killed his wife...I know a crock of sh.t when I see one.

And I am looking at one.

Are all the Queensland Judges..dickheads of the first degree like these three, Larry, Moe and Curlys'?

God help Queensland!

Probably the best thing that can happen now is for the judge to sentence Baden-Clay to life imprisonment, which is the maximum penalty for manslaughter. If this was manslaughter, then it was a particularly severe case of manslaughter, and should warrant the maximum penalty.

Of course that is not what is going to happen, even though judges do take into account community standards.

So you would punish someone who had no intent to kill or cause grievous bodily harm in the same way you would someone who killed with that specific explicit intent?

this decision... what else???>..

why do you need everything spelt out for you..

you are so childish.. Angry Angry

this man was found guilty by 12 of his peers.... to the charge of murder...

if anyone would like every murderer in QLD to go down this path... then this sounds like it will suit them  to a tee..

why not blame the victim for being in the wrong place at the wrong time and be done with it..

wont be long before we see Brett Cowan take the same route..

Yes, I do, because that it the Law and has been for close on two hundred years.......guilt must be proven on evidence presented in Court and considered by a Jury, beyond reasonable doubt.  That a fundamental cornerstone of  the British system of criminal justice which Australia inherited.

Intent to kill or do grievous bodily harm is an essential element of murder, and it must be so proven beyond reasonable doubt.

That is impossible when on the evidence, there are plausible explanations for the relevant conduct other than....an intent to kill or do grievous bodily harm.
