Rest what case Gregg?...You haven't argued any of the points in this case.

All the way, all you have done is what you always do. Carp, undermine, belittle but never add to intelligent argument.

I'm shining the light on you Gregg but you look like a little boy who has lost his way.

It's a bit like those little fish that swim with the sharks, they hang around, pick up the crumbs and never get eaten by the predator they feed off.

It's all good RB............we can debate the evidence (or lack thereof) to our hearts content here.........so many hypotheses we could put forward as to the circumstances of Allison's death.

That has no impact of that scenario.  It is entirely neutral on that hypothesis.

Then, you'll be able to explain why.  Just singing 'like pig's f....g arse' to a Court of logic takes you nowhere.  You might just as well have said, 'Aussie, I'll hold my breath and go blue in the face unless you and the Appeal Court agrees with me.....because you should."  It would have exactly the same impact.

Which is a motive, but it does not negate the alternative explanation.

Not at all Gregg. I work on facts, Policing drummed that into me.

The Case against Gerard Baden-Clay, is an overwhelmingly strong  circumstantial one.

You add all the factors of this case up and they come up with one outcome - Gerard Baden-Clay cold bloodedly murdered his wife.

How is this hypothesis not available on the facts?

She found out about his affairs, she found out he was broke....she scratched his face...they had a confrontation outside so as not to disturb the kids.....she falls......hits head.....dies.  He panics, puts her in the car...dumps the body......gets home......and the rest is well known, and neutral on intent to kill.

Please explain what piece of evidence excludes that scenario.

no one is saying thats not a possible hypothesis

you are saying... MURDER it wasnt his intention...

the way I see it is..

there is no evidence as such of what went on when she was killed.......

the appeal says.. he showed no signs of D.V before this night....so that in HIS favor.....and is ok to think about in this appeal..

the worry the stress of his situation...money mistress wife finding out pride.. none of that must come into it..

the before and after are of no interest..

just the bit where no reports of DV in his past... Roll Eyes

so we come down to his intentions....at the moment of death.....

do we know what state he arrived home in???>..

no.

do we know who started what?

no

do we know HOW his faced was scratched even though he said it was self inflicted..

yes.

do we know who ended up under a bridge very dead..

yes!..

do we know who put her there

yes!..

do we know if he intended putting her there

its only a guess.. yes!

but we are only interested in his INTENTIONS AT TIME OF DEATH......

well I keep asking.. HOW DOES ANYONE KNOW>> WHATS SOMEONES INTENTIONS WERE...

unless they bought a gun and shot someone...a length of rope and hung someone...

how do we actually know???.. how do we prove....

anything..

when the coroner cant even tell us HOW SHE DIED....extraordinary  Roll Eyes Roll Eyes

cause of death'

undetermined

I would question that for sure.....but! I am just a stooooooopid member of the public what would I know..

Im not sure do we have TIME OF DEATH EVEN??

even a rough idea??....

I am amazed how little evidence this coroner had of anything Roll Eyes to be honest..

Quote:
There were no injuries on the body of a kind to indicate an intent to kill or do grievous bodily harm," the judgment read.

so short of a bullet hole  or a knife through the heart..from the back preferably INTENT is almost impossible to prove...

so therefore isnt it almost IMPOSSIBLE to NOT INTEND TO KILL   TO BE PROVED

if he was so strung out and beside himself with worry...how do we know.. he didnt storm home with every intention of getting rid of at least one problem in his life..

didnt he say he didnt want to be married anymore...i

I have read your case.. I even went so far as to google it... but I agree with the outcome...I am shocked actually it got as far as it did.. but without reading the 400 pages....I cant see any evidence at all he was involved..seeing as how the crown had 3 years to come up with some.. this was woeful....

the man looks a wimp to be honest doesnt look to me like he would have the balls to murder anyone..

he has all the hallmarks of these same people that do get found guilty of murdering their partner....
deceit/ money problems/mistress/double life/in the case of Simon Gittany secretly tapping phones.

they seem to have a lot in common.....

however for this guy no way....I can only gather thanks to the police they have never found who killed her.... and that isnt right either though I am pleased to see its been handed to Cold Case for review... well done..
