The appeal is mostly due to public pressure, which isn't a matter of law.They might just get lucky, but I wouldn't expect it.

The fact the charge downgrade occurred at all is because of the evidence that exists. People might feel that it's unjust, but it's more unjust to convict when there is another plausible explanation.

Thanks for your opinion though. You're entitled to it I guess.


By ignoring a reasonable alternative, you lead to people being convicted of crimes they have not committed. How would that be just?

In this case it might not be true, but that still needs to be demonstrated.


And it no doubt will IF the application succeeds.

Oh and I still disagree with your opinion re the appeal.

When I toss off my legal hat, my personal view is murder..........not premeditated murder, but when push came to shove during the altercation, intent to kill then formed in his mind.....

Put my legal hat back on and as you say Grappler.......on the evidence, not proven.


Alinta, you seem to have current access to Registries.  Can you put up a copy of the actual Appeal (to the High Court) document?

lets face it.. Allison is dead...gone.. almost forgotten..the law brings it down to INTENT... but even thats not the real issue.,. the issue is the instructions the judge gave the jury.......did he tell them they had to be convinced beyond a reasonable  doubt that Gerard INTENDED TO KILL HER...


they the jury thought they were there to listen to the evidence..and make a decision did he murder her or didnt he...guilty or not guilty....

no they were there  to be convinced beyond a reasonable doubt.......

as to what his intentions were....


I have always thought.. Laws are written by MEN with Men in Mind...

why didnt the appeal court  have at least one female judge??... ooops mustnt even think like that...

Now for the best part......



Detectives believe they could show Gerard Baden-Clay was financially motivated to kill his wife Allison despite an appeal's decision saying there was no evidence of a motive to kill when his murder conviction was downgraded to manslaughter.

Baden-Clay reportedly made a call to Allison's life insurers a week before he killed her, which detectives believe could have proved he murdered his wife for money, the Courier Mail reports.

The decision by prosecutors to NOT concentrate on Allison's life insurance was mentioned when the 45-year-old's murder conviction was downgraded to manslaughter earlier this month in the Queensland Court of Appeal.
