In my view, the case was not managed properly by the Prosecution.

It made a few mistakes which left loopholes ie opportunities which were subsequently exploited by Baden's defence team.

This bungle could ONLY happen in bloody QLD.

So yes, I do hope this application succeeds.

All the evidence needs to be considered.

It's a shame this did not happen.

The decision by prosecutors to NOT concentrate on Allison's life insurance was mentioned when the 45-year-old's murder conviction was downgraded to manslaughter earlier this month in the Queensland Court of Appeal.

Perhaps Nefertiti 'hypothesised' seems to be the in thing with the Queensland Court system. In fact it's all the rage with the Judges in the Appeals Court.

Except that hypothesis is not supported by the evidence.  In fact, it is discounted as undetermined.

Aussie you have been around long enough to know that Verbal Assault IS a form of Violence.

Emotional abuse over a period of time can be a ticking time bomb that can easily lead to physical violence.

I believe this contributed to the overall pattern of a toxic relationship, which helped Gerard to 'go over the edge' get a big payday for himself and remove what he saw as the source of his problems...his wife Alison.

Of course I can be accused of 'hypothesising' this but seeing that its O.K. for Judges to do it...why not?

'Verbal violence?'  Self contradictory term.

You assume that he went over the edge and she was not the aggressor in 'verbal violence' or emotional abuse.  Gawd, she did have plenty of reason to 'lose it,' after all.

Sure, and it will stick as 'open/available' if it is plausible and consistent with the evidence.

I find it interesting to see the LAWs.. changed over ONE PUNCH...death.....its now I believe in NSW at least 8 years....

.whats to argue about...

as far as i know it was the hue and cry from the public that brought that about.. they were fed up with slaps on the wrist....

for those left behind.. it will never be enough.. but at least he gets thrown in jail.....

I am wondering if they can use the INTENT wiggle off the hook.... Roll Eyes Roll Eyes

I am sure a lot of lawyers are doing their homework on that one.....they will find a loophole..



in the case of domestic violence death... well it appears to be all in  the accused favour...it all comes down to INTENT BEYOND A REASONABLE DOUBT..

do you all have the same degree of REASONABLENESS???.....

do not forget... after the altercation nothing must be taken into account.....why because no ,one can prove BEYOND ETC ..... so death due to domestic violence...

seems to have  a massive loophole. for all the creeps to jump through......
