Question to longweekend58:

"So youre ok with having a pm who wasnt democratically elected?"

Answer from longweekend58:

"he was... by caucus as per the constitution.  simple really."

So in 2013 was Abbott on every ballot?

Or did you vote for your local candidate?

And in 2016 - will Turnbull and Shorten be on your ballot or your local candidate?

the definition of 'buffoon' is not getting a single fact wrong.

this was my point about how so few people on here understand the nature of words and what they mean.

You're good Melielongtime, as Karnal said...better than Hemmingway.  You lecture us on how the PM is elected by caucus as per the Constitution and that crap is excused by you with a dismissive wave of your hand...it was just getting a simple fact wrong.  Oh yeas....a simple fact concerning something as totally unimportant as how the PM is elected.  Who is the ignoramus melielongtime?  You or me?

still you.  Im not a constitutional lawyer and so the occasional error is ok. you on the other hand make major mistakes on matters of law and yet claim to have been a lawyer.  THAT is being an ignoramus.

I can't post the link Cods, but I understand that following the death of the victim, the charge of grievous bodily harm was upgraded to this.(*)

The Bill inserts a new offence into the Queensland Criminal Code, *“Unlawful Striking Causing Death”*.  This offence is separate to murder or manslaughter and prevents a person from relying on the accident defence.

Presently the law for accident requires an accused person to raise evidence of the accident but once this is done the prosecutor must disprove beyond reasonable doubt that the accused person intended that the event should occur or foresaw that event as a possible outcome or the Crown has to establish that an ordinary person in the position of the accused person would reasonably have foreseen the event as a possible outcome

it wouldnt be right to CLAIM they intended to kill the person..... but the fact is they did... and their actions brought that death about.....

its more than accidental death....like killing someone in a road accident...where all sorts of things are involved....striking someone is purely INTENTIONAL....you mean to HIT them and probably HURT them.......its violent in the extreme.....and should be treated as such......

when we use some word.. we take away the reality.......meaning a life has been stolen.... "Unlawful"...it demeans the reality.......

we call it manslaughter  and fancy names..like Unlawful.....

how about a THUG using  violence  causing death......

lets call it what it is....a life stolen by some coward who thinks violence is ok...

they strike from behind...its bordering on murder.......its that close..

bugger what their intention was.......its the result that matters.

Yes, hence.......

The new offence of “Unlawful Striking Causing Death” specifically removes an accused person of relying on the accident defence.  The explanatory notes which accompany the bill indicate that the new offence prevents a person from attempting to argue that “although the strike was deliberate and wilful, the death of the victim as an ‘accident’.”

thanks.... is that Qld or NSW?....its all weird the way we have different rules for the same crime...

I do not believe we give the victim or future victims.. justice... I really dont...

are these laws advertised do you know..

I mean its always young men that are involved....maybe these laws should be posted in the pubs and clubs where they drink.. in the toilets maybe..

something is just not getting through...

I prefer prevention...myself..I am sure your the same.

Point them all out with links.   Are you really telling us that you believed the Constitution set out how the PM was elected?  Seriously?  Either way you answer...it establishes that you are an ignoramus on a simple political issue.

Oh.....and here I was thinking it was about a tragic outcome to a circumstance where two groups came together late at night in an entertainment area in Brisbane.  Silly me.  Of course it matters that one involved Kiwis and the other involved 'one of our finest.'  That's very relevant.  It'd be entirely different if it was just a random attack by an Australian bogan on an Australian homeless tramp, wouldn't it?

This one's Qld Cods..........in the media, you'll generally see them referred to as "one punch laws"........if you google that, I expect you'll be able to find info for other states.

If a man stabs another man and he dies it's murder. Doesn't matter if he was trying to kill him or not. Why isn't it the same situation when a man king hits another man? If he dies it's murder. Plain and simple.

yeah I will.

tell me you didnt tell me if these LAWS...aka if you HIT someone and they die...

you cannot claim it was an accident..

is this advertised in the boys rooms??....in pubs and clubs..

I just feel... these young people do not understand the consequences........

they dont think about the end result... because well half the time they dont know what the charge will be..

if you are caught speeding... they know they will be find.. its advertised everywhere...they cannot plead ignorance...

yet they can with this LAW as it doesnt seem to be OUT THERE...there its needed...

you drink and drive... this is what happens its even in lights.

you drink and hit.... silence.
