I was more interested in the 'foreseeable outcome' raised.... very difficult to determine if someone can reasonably foresee that king hitting someone will cause death... but then again there have been enough cases of exactly that to give any reasonable person pause....

Seems this legislation has been made to 'stand alone' in its definitions, and to allow no defence of 'accident' or 'unintended outcome'. How far it will be pushed is something that I await... will the courts find against any presumption of a 'reasonable person' not foreseeing that outcome of death? Is a person who king hits someone from behind a 'reasonable person' and thus able to draw such a conclusion? Surely prudence would indicate that it is far safer NOT to king hit someone.

I await the court's ruling.... but I think this needs to be enforced heavily rather than watered down - the entire purpose of this legislation was to create a deterrent punishment for just such an offence - why allow it to be frittered away with 'plea of guilty' discount and 'remorse' discount.

But then - I'm no lawyer.
