Lynette Daley died from injuries inflicted during violent sex act, court hears

A woman who died on a remote beach on the New South Wales North Coast suffered fatal injuries from a violent sex act, a court has heard.

Lynette Daley was found dead on Ten Mile Beach, north of Iluka, in January 2011.

A jury of seven women and five men on Monday heard the 33-year-old suffered severe lacerations to her genitals from a violent sexual act involving the use of a hand or fist.

Crown prosecutor Philip Strickland SC told the court Ms Daley had lacerations in and around her vagina.

"The lacerations to the vagina were very significant," he said.

"They caused significant bleeding — a significant loss of blood."

'Boys will be boys,' says accused

Paul Maris, 47, has been charged with aggravated sexual assault in company and hindering the discovery of evidence.

He told the court Ms Daley was "quite all right" with the sexual act which led to her death.

"She didn't say stop it, she was alright with what we were doing," he said.

But Mr Strickland told the court a post-mortem examination had shown Ms Daley had a blood alcohol level of more than 0.3 at the time, and either did not or could not give consent.

Adrian Attwater, 42, has been charged with manslaughter and aggravated sexual assault in company.

The court was played an excerpt from his record of interview with police, in which he was asked how the situation had developed.

"These things just happen, man," he said.

"Girls will be girls and boys will be boys."

The court was told Maris was seen with an apparently intoxicated Ms Daley at a supermarket in the area the afternoon before her death.

The jury was told a witness would testify that Maris asked him: "Hey mate, can you do us a favour and drop this thing [Ms Daley] down the road for us?"

About 50 witnesses could be called in a trial expected to last another five weeks.

This is at least 2 yrs old now- more senationlist topics about rape- why?

It was pretty horrible- but dont rehash old news- what is the point? As if we dont get enough nasty topics about these assaults- and they always descend into nastiness- and you know it-

RIP to the victim- I am sure you wouldnt want your story used this way- respect to the victim-

Story is much more than two years old...Trial is current, it seems......Article dated 1 Aug 2017.

Because it's in court a the moment. Didn't you read the article?

Did you see the charges?


She can't have....the event was six years ago.  No idea where she got 'two' years from.

I see why the charge isn't murder but i hope they get the maximum possible sentence for manslaughter possible.

Murder?  Probably lack of evidence of intent to kill.

Too high to consent, for a start.

But she died from blood loss owing to lacerations on her genitals. You can't tell me for a second that she was okay, if she were conscious, of that happening to her.

People apparently operate differently at various levels.  I might be comatose at 0.3% and you might be firing.

The charges give some idea on what must be very limited evidence available to the Crown.

So all the people involved liked to get highly intoxicated and have rough sex.
Not something I recommend but not against the law.

They should be charged with not rendering adequate assistance (what ever that is) and hindering the investigation.

A MAN on trial for manslaughter after a sex act caused his partner’s death said they had previously engaged in the violent sexual activity and she had never been injured

Sounds like she was into getting blotto and having rough sex. Bad choice it seems.

You cannot tell  anything from someone you dont know on a forum especially what they like and do not like in the bedroom- you can only tell about anyone by the way they treat you on a day to day basis- as I have gleaned from you
