Malcolm Turnbull has vowed to block the merger of two “lawless” unions as the government plans introduce legislation to parliament that would force the industrial umpire to apply a public interest test for any union mergers.The Australian revealed this morning the the federal government would move to block the creation of a CFMEU and Maritime Union of Australia “super union” trying to pass legislation that would require further scrutiny on union mergers from the Fair Work Commission.
Mr Turnbull said this morning his government would “stand up for the rule of law” in the workplace.
“There are very real concerns about these two unions. Both of them have shown a long-term disregard for the law, they’ve been essentially lawless,” Mr Tunrbull told Melbourne radio station 3AW.
“One of the reasons they feel they’ve been able to get away with it is because of their size, so why would you want two already lawless unions who are big, to become even bigger?
“We’ll give the Fair Work Commission the power to assess whether it’s in the public interest for any mergers of unions to take place. It’s not dissimilar to the way the ACCC can approve mergers between companies or not. I think it’s manifestly in the public interest that we stand up for the rule of law.”
Finance Minister Mathias Cormann said the public-interest test would work similar to the scrutiny companies were given before proposed mergers were approved by the competition watchdog.
“We consider that a merger between the CFMEU and the Maritime Union of Australia, both unions with a bullying and militant and intimidating culture, is a real threat to our economy,” Mr Cormann said.
“It is a threat to productivity, it is a threat to jobs and what is proposed is that there should be a public interest test for the Commission that is making judgments on whether or not such a merger is in a public interest.”
Earlier this morning, Bill Shorten described Mr Turnbull as “desperate” for claiming the Labor leader could be in jail under the government’s new building code.
Mr Shorten hit back at the Prime Minister’s attack after legislation passed through the Senate on Wednesday night which banned secret payments from business to unions.
“I think that latest outburst is a lot more about him than me; these are the comments of a man under great pressure and he is desperate,” Mr Shorten told ABC radio.
“Don’t you think its remarkable that this government is so obsessed that they want to pass laws which just go after unions or particular individuals? I am very proud of my record of standing up for workers.”
Mr Shorten said that under the “bad laws” a business would not be able to compensate the widow of a builder who died at work.
“A worker dies on a building site or a work site, the union asks the company to pay something towards the widow, that would be illegal under this new law,” Mr Shorten said.
Yesterday, Mr Turnbull said the Labor leader’s opposition to the laws showed he defended union corruption.
“Here is a wholly owned subsidiary, a union that has no regard for the law, that is flagrantly breaching the law,” Mr Turnbull said yesterday.
“Bill Shorten has been defending, tooth and nail, corruption and secrecy, defending big unions and union officials doing dodgy deals with employers at the expense of the workers.”

Two years, too late, Malcolm. Abbott presented you, on a plate, the results of the RC. You did nothing, even though the Unions and Shorten came out of it, smelling like dead eels. You simply let it go. And now, with your job looking increasingly shaky all of a sudden, you are going to do something, about these burglars.
