A MAN has been found guilty of the rape and manslaughter of his partner who bled to death on an isolated beach after what the offender described as a “wild sex session.”

Lynette Daley, 33, died from injuries sustained in the session with her “’on-again-off-again” boyfriend Adrian Attwater, 42, and Paul Maris, 47, on a 2011 Australia Day camping trip to Ten Mile Beach.

The family of Ms Daley, 33, gave the jury the thumbs-up after they returned a verdict of guilty against Attwater after just over 30 minutes of deliberation.

Following a five-week trial at the Coffs Harbour Supreme Court, a jury today found Attwater guilty of manslaughter and aggravated sexual assault, and Maris guilty of aggravated sexual assault and hindering the discovery of evidence.

The jury’s extremely fast deliberations were even more astonishing because the Director of Public Prosecutions Lloyd Babb had orginally refused to pursue a prosecution over Ms Daley’s death until The Daily Telegraph, followed by the ABC’s Four Corner’s brought Ms Daley’s tragic end to public attention.

Attwater pleaded not guilty to the rape and manslaughter of Ms Daley who was found dead by paramedics on Ten Mile Beach, near Iluka on January 27, 2011.

Maris pleaded not guilty to aggravated sexual assault in company and hindering the discovery of evidence by burning a bloodied foam mattress.

The jury found them guilty on all counts.

THE Attorney-General has asked the state’s top prosecutor to explain why he repeatedly failed to pursue charges over the two men convicted yesterday over the tragic death of Lynette Daley.

Director of Public Prosecutions Lloyd Babb SC has been slammed for first dropping charges against the two men and then refusing to reinstate the charges for more than five years.

It took a Supreme Court jury just 32 minutes to convict Adrian Attwater, 47, of manslaughter while both he and Paul Maris, 43, were convicted of the aggravated sexual assault of Ms Daley, 33, who they left to bleed to death on a remote north NSW beach from horrific internal injuries after violent sex.

In one of the fastest verdicts in the state’s history, Maris was also found guilty of hiding evidence when he burned the woman’s bloody bra and the blood-soaked mattress taken from the back of his 4WD during the drunken 2011 Australia Day camping trip to Ten Mile Beach.

Attorney-General Mark Speakman today revealed he has personally spoken with Mr Babb.

“I’ve spoken with the Director of Public Prosecutions and sought an urgent brief on the circumstances surrounding this case,” Mr Speakman said today.

He pledged the government would continue its support for mother-of-seven Ms Daley’s parents and family under services provided for victims of crime as the sentencing process continues.

Attwater, 47, and Maris, 43, were remanded in custody until they return to court on November 3 for sentencing.

A spokeswoman for Mr Babb said today that as the matter is still before the court, no comment will be made.

yes as you can see almost zilch interest  I am not surprised....

there could be more interest  as now the DPP Lloyd Babb  has  please explain questionaire to fill in....

it should be a good read... he must have had heaps of reasons..for dropping the charges............. Roll Eyes

and to just read how she died  how could he ignore that?????.....I never understand the power of the dept of the DPP...5 years this family has waited for justice....

I remember not being able to find reasons at the time Mothra posted her thread Cods.  Thought there may have been some clue in the Coroner's transcript, but found it is a suppressed document.

There was a clear case of tampering with evidence and attempting to pervert the course of justice... this could only have been because Daley was a Black and a mother of seven and was considered of no value... she shagged losers like that pair so she must be a nobody and worth nothing.... utterly disgraceful....  I never met her or know her family or anything though they are not that far from here... but I was shocked and appalled at the lack of action from day one.

There may have been no intent to kill, but no attempt was made to do anything but cover the situation up, and Lynette Daley was clearly drunk as a skunk long before the trip left town, so was in no position to offer any meaningful consent or even, when injured, call for assistance.

The cover-up was enough to cause a charge from day one.  How many law officers were asleep at the wheel on this one?

that is just not an excuse grap.. if it is some heads need to roll it sounds like lowlifes in America.....

she had alcohol problems no one has denied that....she obviously was an abused women...by men of course....who never get a mention. Roll Eyes

the mere fact these guys burnt evidence  tells us they  knew full well she didnt die a natural death....

but this is about the DPP grap... not the police  not even the mongrel blokes... but the DPP who fought off charging them for 5 years....

Yes - you have to wonder.  Obviously those guys didn't intend to kill her, but they certainly did everything they could to cover up the whole thing.... which was stupid, and that was enough to charge them with something.

I'm glad I'm not that kind of person, is all I can say.  No way I'd ever have taken a drunk woman to a beach for an orgy.... (shudders).... warm, willing, of age and able....

Probably 'death by misadventure' or something.... which still leaves the questions of covering the event etc... charges should have been laid immediately.

Such a tragic event- it is over now and no matter what the outcome was- they are  not going to bring back this mother of 7 children and as she was 33- they were all young ones who now have no mother- that is the very saddest part-

This is at least 2 yrs old now- more senationlist topics about rape- why?

It was pretty horrible- but dont rehash old news- what is the point? As if we dont get enough nasty topics about these assaults- and they always descend into nastiness- and you know it-

I fail to understand as an ex Police Officer, how with the evidence well presented by Channel 9, who did a great job on this..why the offenders were not pursued in the first instance

It speaks of a really sloppy investigation either that or the D.P.P. did not pursue the charges laid in the first instance,. Someone most probably multiple persons, need to face the chopping block on this one

It is a disgrace and an outrage
