Berkeley cops said Sunday that 20 people were arrested demonstrating against a rally organized by so-called "alt-right" groups. The mugshots of those arrested, their names and what they were arrested for allegedly doing was posted to the BPD's Twitter account -- a practice that is not unusual. The mugshots were posted before the protesters were formally charged. The department told The Guardian on Monday that the protesters' cases were not brought before prosecutors.

Veena Dubal, a law professor at the University of California, said she found it “disturbing” that the police department would post the mugshots and risk the possibility of putting the demonstrators in danger.

“This is very disturbing,” Dubal told The Guardian. “It seems like a public-shaming exercise, which is not the role of the police department...They are making it really accessible for folks who might wish these people harm to locate them.”

Berkeley Mayor Jesse Arreguín said the police “did a very good job” handling the rally. But he said he spoke to police about the posting of mugshots on social media.

“We need to look into this and discuss whether this is an appropriate practice going forward,” Arreguín said.

The Sunday protest began after two groups of "alt-right" protesters announced plans for a "No to Marxism" rally at the city's Civic Center Park earlier in the week. That prompted plans for a "Sweep Out The Fascists" march and counter-rally that drew hundreds of people downtown.

Officials said three people suffered minor injuries after a group of "extremists" threw "explosives" -- believed to be fireworks and flares -- at police and Alameda County Sheriff's officers. No members of law enforcement were hurt.

Berkeley police also said that "an extremist element among a large group" damaged 21 city vehicles, setting one on fire, and slashed their tires. The group also set fires in trash bins, which were extinguished quickly.

Videos taken during the protest also showed masked Antifa protesters smashing the windows of a U.S. Marine Corps recruiting office and another demonstrator sucker-punching someone.

But Jay Kim, the executive director of the National Lawyers Guild local chapter, said he felt police were targeting “anti-fascist protesters.”

“It really seemed to us like the Berkeley police department was there to…target the anti-fascist protesters,” Kim said.

Kim said about 21 people contacted the NLG regarding the arrests, claiming the “vast majority” arrested were anti-fascist protesters.

Byron White, a spokesman for the Berkeley Police Department, defended the release of the mugshots.

“People are coming from out of town and bringing weapons and are committed to violence…We don’t want people to be able to do that with anonymity,” White said.

If Fox News had specific evidence of Antifa crime, they'd report it. This is what the news does.

Your article suggests that they didn't do anything. They were simply at a rally.

No one needs to call the police. If you have evidence, please post it. Otherwise, you won't convince anyone of anything.

For the time being I want to follow up a statement I made......I said that 3 Antifa members, in the commission of their alleged crimes,  were wearing masks when arrested, & that due to recent legislation, if found guilty their punishment would be more severe.

The legislation has yet to be passed, & is presently pending, so sentences would not be lengthened untill it is passed & signed into law by the US President.

If passed, Bill HR 6054 would punish anyone wearing a mask or disguise who "injures, oppresses, threatens, or intimidates" someone else exercising a right guaranteed under the Constitution.

The title of the bill -- "Unmasking Antifa Act of 2018" -- makes it clear that Antifa activists are its intended target, but the bill's text never explicitly mentions them.

The bill, which was introduced by Republican Rep. Dan Donovan of New York last month, has drawn widespread condemnation from critics who claim it unfairly targets Antifa activists, while it could embolden the far-right demonstrators Antifa protests against.

"This is another draconian measure to actually criminalize dissent in the United States," said Scott Crow, a former Antifa organizer and author.

"Because the law, even if it doesn't explicitly state 'leftists who mask up,' that's who the largest potential target of the law is," he said, "far more than white nationalists."

The term "Antifa," short for "anti-fascist," is used to refer to a loose coalition of individuals with extreme left-leaning political views that often fall outside of the mainstream Democratic Party's platform.

The group has no figurehead or official governing body, but members -- some of whom turn to radical or militant tactics to make their views known -- generally oppose the inequality of wealth by corporations and discrimination against marginalized communities. They often wear black and obscure their faces while protesting.

The Antifa movement's profile has significantly risen in recent years, especially after members clashed with self-described "white nationalists" in Charlottesville, Virginia, last summer -- a day that ended in tragedy when a James Alex Fields Jr. allegedly drove a car into a crowd of counter-protesters, killing one demonstrator, Heather Heyer.
Crow said the bill is an attempt by lawmakers to avoid tackling the issue of hate speech and instead address a "symptom" of it by targeting protests.

"Instead of dealing with that, they'd just rather deal with this," he said, "which is to put a band aid on something."
Walter Shaub, the former director of the Office of Government Ethics, tweeted about the bill on Tuesday, suggesting it advanced "authoritarianism."

"Two groups go to Charlottesville. A big group chants racist filth, wields semi-automatic assault rifles, fires a gun into a crowd & murders a woman with a car," he wrote. "A small group wears masks. It's the small group these Congressmen want to lock up for 15 years. Authoritarianism rises."

Donovan's office sent out a fact sheet that pointed out other instances in which Antifa activists exhibited violence, including an instance in February 2017 where they turned up to protest at a speaking event held by right-wing commentator Milo Yiannopoulous at UC Berkeley.

Donovan's spokesman Patrick Ryan also pointed out that the bill would simply add a section to federal civil rights statutes to include a penalty for wearing a mask.

"My bill expands upon long-standing civil rights statutes to make it a crime to deprive someone of Constitutionally-guaranteed protections while masked or disguised,"

Donovan said in a statement sent to CNN.

"Americans have the natural right to speak and protest freely; it is not a right to throw Molotov cocktails and beat people while hiding behind a mask."

But regardless of whether the bill becomes law, Crow said it won't stop protesters from wearing masks.

"If they take away the right to mask up," he said, "people will still do it anyway to fight against authoritarianism in any form."


If the law is passed, I hope Antifa tests it's teeth.

Law abiding American citizens, ever mindful of the Constitutional Right to peacefully protest, are sick & tired of these Antifa assholes breaking the law in anonymity.

They want them punished, & punished hard to turn their type of lawlessness into a thing of the past!

15 years is a long time for wearing a mask while setting a police car afire!   ;
