"It's alleged McCurdy, 55, sold two dairy farms in 2009, wrongly using former colleague Andrew Gilmour's real estate agency's name, collecting $269,000 in commissions... Prosecutors argue McCurdy wrongly used Mr Gilmour's agency letterheads during the sales without his knowledge or permission."

The matter has not gone to trial and until that does, he is entitled to the presumption of innocence.

As usual the Polly Waffle Virus Fake News amounts to very little as the bloke has stood down from the Front Bench.  If the court case goes bad then a new candidate will step in to hold the seat at the election. But then the Lefty Polly Waffle VIRUS specializes in FAKE NEWS.

In any case what with the Red Shirts and Black African terrorists running riot the Andrews imposter Labor Govt is already on its last legs.

A Victorian Nationals MP has resigned from the frontbench after Victoria Police charged him with a number of alleged offences relating to property sales in 2009.

Ovens Valley MP Tim McCurdy today said he would hand over responsibilities as opposition spokesman for sport, veterans, gaming and liquor regulation, in anticipation of the matters being heard in court.

Police have charged the MP with four counts of making a false document, four counts of use a false document, attempt to obtain property by deception and obtain property by deception.

The charges relate to an alleged fraud in 2009 which occurred while Mr McCurdy worked as a real estate agent and before he had Mr McCurdy assumed office.

Mr McCurdy has forcefully denied the claims.

“I am innocent of these allegations and I await the opportunity to defend myself in court and clear my name,” Mr McCurdy said.

“As I prepare to have these matters heard in court, I am today stepping down from my Shadow Ministry responsibilities.”

He will appear in Shepparton Magistrates Court on April 24.

Victoria Police last year confirmed they were investigating Mr McCurdy following complaints he forged documents to profit from two land sales.

At the time, he was alleged to have falsified a company letterhead to secure sales commissions worth about $375,000 while working as a real estate agent.

Mr McCurdy has stated in the past that he resolved the dispute with the claimant, who was his former employer, through private mediation.

The announcement is a blow for the Victorian Nationals and comes less than six months after its Morwell MP Russell Northe resigned from the party and became an independent, as he seeks treatment for mental health and gambling issues.

Opposition leader Matthew Guy has unveiled a frontbench shake up in the wake of Mr McCurdy’s announcement.

Gippsland South MP Danny O’Brien will join Shadow Cabinet and take over responsibilities for Mr McMcCurdy’s portfolios of sport, veterans, gaming and liquor regulation.

Mr Guy has also promoted upper house member Margaret Fitzherbert to chair the opposition’s Victorian Population Policy Taskforce.

Real estate agent Andrew Gilmour told Mr McCurdy to 'man up' ahead of this week's hearing in Shepparton, the court heard.

It's alleged McCurdy, 55, sold two dairy farms in 2009, wrongly using former colleague Andrew Gilmour's real estate agency's name, collecting $269,000 in commissions. He plans to plead not guilty.

He is due to face a County Court directions hearing on November 2 on 10 fraud-related charges, three weeks before the November 24 state election in which he plans to recontest his safe seat.

"Most people understand this coincidence of it rolling out in an election year is not such a coincidence, but these things happen," McCurdy said outside court.

"There will be certain people trying to put (voters) off, but I have faith in the people of the Ovens Valley that understand the situation as it stands at the moment and we now get an opportunity to have my say a bit further down the track."


Prosecutors argue McCurdy wrongly used Mr Gilmour's agency letterheads during the sales without his knowledge or permission.

But McCurdy's lawyers told the court Mr Gilmour had to authorise payment of the property sale commission and his agency knowingly transferred the cash to the defendant.

In the witness box Mr Gilmour at times contradicted evidence from his former receptionist and admitting knowledge of the sales in 2009.

Mr Gilmour first took his complaint to Consumer Affairs Victoria in 2014. It was referred to police and almost four years later, charges were laid.

The court was told the men were neighbours and worked together on-and-off for several years, and were colleagues when one of the farms went up for sale in 2008.

Mr Gilmour ran an auction for the property as McCurdy was unlicensed to do so, but it did not result in a sale.

A short time later their employer, PGG Wrightson, closed its Australian operations, selling two offices to Mr Gilmour, who subsequently opened Gilmour and Company in 2009 while McCurdy worked for another firm.

Mr Gilmour's former receptionist Kally Morey on Wednesday told the court McCurdy asked for a letterhead during one of his regular visits to the office and she handed it over.

But on Thursday, Mr Gilmour said McCurdy was never in the office.

The parties reached an undisclosed civil settlement in 2014.


McCurdy holds his safe regional seat with a 16.6 per cent margin.

The Nationals say he will continue to work hard for constituents until the matter is resolved.

"Advice from Tim's legal representation before this week's committal hearing was that charges of this nature would usually proceed to trial, and that is the outcome Tim had expected," the party said in a statement after the court decision.

They most probably faced the Justice System and were sentenced accordingly.    I am sure the LNP will be quids in though to  win the Nov election, as long as there are enough polling booths outside the Lobster Cave and the Mafia run the election.   I tremble with anticipation at Matthew Guy being our next Premier
