Justices John Basten and Anthony Meagher and Acting Justice Carolyn Simpson today ruled Thomson, who held the federal seat of Dobell on the NSW Central Coast from 2007 to 2013, did not meet the “fit and proper person” standards for legal practitioners.

Thomson was in 2014 found guilty in a Victorian court of 12 charges of stealing thousands in cash belonging to the Health Service Union between 2003 and 2007. He had been national secretary of the union. He was convicted and ordered to pay fines of $25,000 and $5650 in compensation to the union.

“The evidence establishes, and we find, that Mr Thomson engaged in the criminal and contravening conduct … and that he was convicted of the offences and found to have committed the contraventions described in the judgments of the County Court of Victoria and Federal Court of Australia,” the Court of Appeal found.

The Fair Work Commission, the judges noted, had previously ruled Thomson had contravened sections of the Workplace Relations Act. Between September 2005 and December 2007, the FWC found, he used HSU credit cards to purchase escort services and made cash withdrawals for his own use. He also used HSU funds to pay for part of his election campaign in Dobell.

In September 2015, he was ordered to pay a penalty of $175,550 for his contraventions.
Thomson was admitted as a legal practitioner in March 1995, but had never held a practising certificate in any Australian jurisdiction. In October 2016, however, he applied for a certificate, which the Law Society of NSW refused two months later.

In March this year, the Prothonotary of the Court applied for his name to be removed. Thomson did not contest the move, stating in a letter to the court: “I do not intend to make any statement in this matter.

I am not contesting the application and will not be appearing for health and financial reasons that saw me not contest the [Fair Work] application in the civil matter referred to in these proceedings.

“I accept the position of the Law Society of NSW and do not wish to incur costs to anyone for this matter which is why I volunteered to undertake not to apply for a practice certificate for such time as the Law Society saw fit.”

The three judges on the Court of Appeal found he had not shown himself to be a reformed man.
“Mr Thomson has not suggested that the deficiencies of character revealed by that conduct are shown no longer to be present and that he has undergone a reformation of character sufficient to justify the conclusion that he is presently a fit and proper person,” they wrote.

“To do so would first require that he demonstrate an appreciation of his obligation of candour in relation to that past conduct. Thomson has neither demonstrated that appreciation nor acted consistently with it.”

Thomson has been ordered to pay the costs of the decision.
