Good work from people who stand up
for the right of free speech.

There is such a thing as an illegal contract.
It's amazing that our resident lawyer
didn't point that out.
Examples:
To pay a penalty for breaking a contract
by having a pound of flesh cut off from your body.

For a husband to cut his wife out of a Will
and give everything to the dogs home.

The court may decide that to remove
someone's free speech is also illegal.

Interesting observation.

Employment contract lawyers are now saying that code of conduct clauses are becoming too all encompassing and going into areas they have no right.

If you don't like the contract a burger chain offers you can go to another burger chain.

If you're a top rugby union player there are no other choices.

Rugby Australia is going to be shredded in court.

Thanks Gordon,
All companies are putting far more
fine print into contracts these days.
They want to own your soul.

As far as I know, no companies are holding a gun to people's heads in order to make them sign, or stay.

Don't like the contract? Walk away.

Great idea - then try and get a few pennies from Centerlink?

The Australian Constitution does not explicitly protect freedom of expression. However, the High Court has held that an implied freedom of political communication exists as an indispensible part of the system of representative and responsible government created by the Constitution. It operates as a freedom from government restraint, rather than a right conferred directly on individuals.

so are you in favor of say a very religious Muslim  telling infidels to go to HELL  in the open market place?... Roll Eyes Roll Eyes Roll Eyes

because when it some to FOS....its cannot stipulate only this religion or that religion can speak at will in the open  public arena...

it doesnt work like that..

the constitution  has nothing to do with this...

this is about a man made law...and deep down we all know there is no such thing as FOS>

Everyone is free to say what they want. However in every democracy on the planet freedom of speech does not mean freedom from consequence. Freedom of religion also means freedom from religion.

Yes you can say what you want but be prepared for the consequences of what you say. Yes a Muslim Cleric can preach hate in a market place. As can a Christian Minister. Freedom of speech means the government can not stop you from saying something. It does not mean you can not be held accountable for what you say.

Now if this Muslim Cleric or Christian Minister moonlights for an organisation that thinks that what the Muslim or Christian has said impacts negatively on their business then they reserve the right to discipline their employee, be it a warning or dismissal.

Falau can say what he wants, he is still free to say what he wants. But he needs to be prepared to stand accountable for what he says and not hide behind his religion.

of course its the consequences that count......he lost his job his well paying job....why doesnt he go out and become a real estate agent.. or a garbo or a postman.... whats stopping him getting another job...

oh thats right could be the money he was paid... Roll Eyes Roll Eyes

and yet those paying him huge sums to chase a ball...

have basically no right to ask him not to make statements in the public arena that could hurt their image  turn fans against the code  that pays him mightily well..... too well as far as i am concerned..

its biting the hand that feeds you...imo....no one is stopping him standing in the pulpit just dont post it thats all they asked...

And, freedom of speech is the right to express your opinions.

It's not freedom from consequences.

Funny how hyper-vigilant and hypersensitive Gordy is in relation to Folau's wife yet fails to understand the concept or consequence of hate speech.
