What is unlawful termination?


Section 772 of the Act says that an employer must not terminate an employee’s employment for one or more of the following unlawful reasons:

    temporary absence from work because of illness or injury (within the meaning of the Fair Work Regulations 2009)
    trade union membership or participation in trade union activities outside working hours (or during working hours with the employer’s consent)
    non-membership of a trade union
    seeking office as, or acting or having acted in the capacity of, an employee representative
    the filing of a complaint, or the participation in proceedings, against the employer involving alleged violation of laws or regulations or recourse to competent administrative authorities
    race, colour, sex, sexual orientation, age, physical or mental disability, marital status, family or carer’s responsibilities, pregnancy, religion, political opinion, national extraction or social origin
    absence from work during maternity leave or other parental leave
    temporary absence from work for the purpose of engaging in a voluntary emergency management activity, where the absence is reasonable having regard to all the circumstances.

The fleecer wasn't sacked for any of those reasons, Bobby.

He was sacked for breaching Rugby AU's Code of Conduct (which doesn't even mention the word 'religion').

Despite The Bible making it clear one must not get tattooed, Folau is fairly tattooed.

I don't post often, and there's a good reason for that ... this thread proves how f c u k ing stupid, deaf dumb and blind many OzP members are in support against IF's sacking ... He broke RA's code of conduct pure and simple, after being warned not to do so from a prior breach under the same circumstance. Go f u c k yourselves supporters of indefensible greed and religious bigotry under your version of free speech.  Liars every one of you, go f u c k  yourself and your hypocrital world view, you have nothing positive to offer. You are already living in your hell of your own making ... comes back to that deaf dumb and blind thing.

I'll now go back to obscurity to escape FD and his filthy f c u k ing support for a greedy little man who actually hates humanity ... unless you happen to be aligned with these greedy, do as I say, not as I do sh!tbags, then everything is A smacking OK. Notice I had to go back and edit some of my great language skillz as even FD's code of conduct has code written to sensor and change language to what HE wants and expects ... sound familiar? F c u k ing hypochristian!

He appears to be a very greedy little man.

It has nothing to do with religion, or freedom.

He just wants money, and attention (which makes me think aquascoot is a big fan of his).

I think this will end quite badly for the fleecer.

Today he goes to the FWC, for conciliation.

That'll last 5 minutes.

They won't come to any agreement, and so the case will proceed to a conference or hearing.

Of course, there's always the chance that Rugby AU will raise a jurisdictional objection.  That would make things interesting.

My objection is not a freedom of speech one, anyone...other than Israel can put that sort of stuff on their social media without comment.

My objection is to the extent to which an employer can govern what’s posted on a persons social page which has nothing at all to do with the employer or employment and further to that the legality of a contract that puts such control in an employers hands. 

The old union hacks I imagine would have said bugger that, the new ones check Israel’s privileges against possibly bogan and  millionaire Christian, then roll over supine wheezing contract...
