What happened was the Yanks accepted Hicks' surrender. Therefore he became a PoW. They failed to apply common legal principles to his case and imprisoned him without trial and held him at Guantanamo Bay without trial. He was denied his basic human and legal rights illegally. He became a cause celebre'. An embarrassment to American and Australian Governments. Our Government was too gutless to stand up to the American Government, as had the British and other Governments and demand that he be returned to our jurisdiction. Hicks was hard done by, by the Australian Government until public pressure forced them to request him to be delivered to them. Which he was. Since then, the whole case against him has foundered.
