Not according to the Immigration Act.  We are also signatories of the UN Convention on Refugees.  We legally not allowed to close our borders to those seeking asylum

You better read the Immigration Act again, you're not reading it right

Sure of that?  I suggest you read section 39...

t Quote:
The UN Convention on Refugees is not binding

Sure of that?  Why did we bother signing it?

Quote:
They weren't/are not asylum seekers, they are unlawful intruders

They are Asylum Seekers.  Something even the Department of Immigration has agreed on. Roll Eyes Roll Eyes

The key word there is "SEEKERS".

And their claim for asylum has been rejected twice.

You do not return to a place from which you supposedly fled in fear of your life .... which they have done at least twice.

They have used their children as pawns to assist their case.

Don't be an idiot all your life Pasta.....you'll just confirm what most on this forum think of you.......you're a smug twat! Roll Eyes

Actually you can just cross a border and claim asylum, its then up to the country in which you seek asylum to determine whether you met the correct criteria

Yes & their claim has been rejected twice.

So nothings changed ... they've been deemed "illegal economic migrants"

& as old mate said ... you're still a smug twat. Wink

If not for this they would have been repatriated long ago.

So, you'd prefer to send them back to Sri Lanka for torture, would you, Belgarion? Roll Eyes Roll Eyes
Why do you think they would get tortured Brian?  Thats a strange claim.

As others have pointed out, the fact that they have returned to Sri Lanka twice since attempting to claim asylum seems to indicate that they are in no danger there.  Roll Eyes

Even if there was some substance to their claim, they only had to cross the 50 miles or so of the Palk Strait to be in the Tamil homeland in southern India where they would be among their own people. No need to travel all the way to Australia for refuge... Roll Eyes

Because of scumbag lawyers with their heads in the asylum seeker trough.

The family has been engaged in legal appeals since 2012.

Court documents show the Tamil father travelled in-and-out of Sri Lanka during the civil war which ended in 2009.

Send them back

the family have not been truthful in visa applications and said evidence suggested they came to Australia in 2012 and 2013 by boat as economic refugees.

Brians tard wants liars to be rewarded.

However, he frequently travelled between Sri Lanka, Kuwait and Qatar between 2004 and 2010 for work, during the civil war that ended in 2009.

As a result, the Immigration Assessment Authority (IAA) did not accept he had links to the LTTE and would not be "of concern to the Sri Lankan authorities."

"Anyone who was associated with the LTTE or was suspected of being with the LTTE, would not have been coming and going into Sri Lanka," Mr Jeans said.

"They would have been picked up by security forces."

What one discovers if you read the report that Gordon quotes from the ABC:

Quote:
"The environment is changing and it's never been particularly favourable to Tamils but it looks like it's changing back to a more draconian environment," Professor Kingsbury said.

He said because the family left the country by boat, they will be taken into custody when they land in Sri Lanka.

"[Nades has] automatically committed an offence in the eyes of the Sri Lankan government," he said.

Source

Seems the Australian Government is a vengeful Government as well:

Quote:
Despite the distressing nature of the images, Mr Jeans said excessive media coverage and activism was harming the family's case by forcing the Immigration Minister, David Coleman, into a corner.

"If the Minister grants a visa to the family it just encourages more people to make media campaigns and it might be unfair for other people who may not be able to make as much noise in the community," Mr Jeans said.

"This is the most significant mistake and this is not a mistake of the family."

Source

And yet we have some here who believe their activism is a reason to deny them Refugee Status.  Tsk, tsk.   Roll Eyes Roll Eyes
