Sadly it is evidence and not suggestions that are supposed to play a part in courts.... just because it could be done that way doesn't mean it was.

Wait until you see the one about the guy convicted of the murder of two Victorian police being released on re-trial after 24 years behind bars.

Perhaps you should lay blame on the prosecutor. Maybe if he'd stuck with charges of 'affray' or 'assault causing harm', they wouldn't have gotten away with it. The jury can only make a decision on the charges before the courts.

Can they still charge them with assault?

In any case, that is a fairly petty charge. I have no issue with the prosecutor having a go at a bigger charge.

Ah... I see.  Then they must have got a walk because of their youth... though how is beyond me.  If there was clear evidence they participated... hell.
