Attorney General Merrick Garland didn’t spend very much time Thursday afternoon addressing Monday’s FBI search at Mar-a-Lago. But in the few minutes Garland stood at the lectern in the Department of Justice, he managed to wrestle several major talking points away from former President Donald Trump’s supporters.

First, Garland announced that the DOJ would be asking a court to unseal portions of the warrant used to search Trump’s Mar-a-Lago estate. Trump has chosen to keep those details of the warrant and its scope under wraps, prompting Republicans to accuse the FBI of conducting a politically motivated raid and forcing Garland to step forward and defend the work of the bureau.

Providing Trump with a chance to intervene is a solid gambit on multiple levels.

True to his word, even before Garland made his brief appearance, the motions were filed on the docket relating to the search warrant. “Given the intense public interest presented by a search of a residence of a former President, the government believes these factors favor unsealing the search warrant" and related materials, the court filing reads. “That said, the former President should have an opportunity to respond to this Motion and lodge objections, including with regards to any ‘legitimate privacy interests’ or the potential for other ‘injury’ if these materials are made public.” The filing also requests that the court unseal a “redacted Property Receipt listing items seized pursuant to the search."

Providing Trump with a chance to intervene is a solid gambit on multiple levels. It signals to the public that the DOJ has nothing to hide, and it puts the ball in Trump’s court. Trump must now decide whether to have his lawyers intervene against releasing the warrant and the list of materials recovered.

Already in filing the motion Garland has undercut GOP attention-seekers such as Sen. Ted Cruz of Texas, who earlier this week tweeted urging the attorney general and FBI Director Christopher Wray to “RELEASE THE WARRANT NOW. The American people deserve to see it. NOW.” Cruz's wish will likely soon be granted, but he probably won’t like the contents. Given the reporting this week on the classified nature of the materials that the FBI was trying to obtain, and the subpoena it had already been granted to recover them, it’s very likely that the document will be embarrassing to the loud voices calling to “defund the FBI.”

A warrant shows the FBI took 11 sets of classified documents
from Donald Trump's Mar-a-Lago residence in Florida earlier this week.


One list of documents is marked "TS/SCI" - or top secret / sensitive compartmented information - a level reserved for information that could cause "exceptionally grave" damage to US security.

Mr Trump denies any wrongdoing.

He said the items were unclassified and safe.

The items removed include over 20 boxes, binders of photos, and a clemency letter written on behalf of political strategist Roger Stone, a long-time Trump ally.

Also recovered was information about the "President of France", although it is unclear what that refers to.

As well as the top secret documents, the list includes three sets of "secret documents, and three sets of "confidential" documents.
   
The warrant indicates that FBI agents were looking into potential violations of the Espionage Act, which makes it illegal to keep or transmit potentially dangerous national security information.

The removal of classified documents or materials is prohibited by law - a crime for which Mr Trump increased the penalties while in office.
It is now punishable for up to five years in prison.

The reason for the search warrant was not made public, and the probable cause is not noted as part of the documents.

However, the warrant details statutes being pursued by federal agents, United States Code section 793, section 2071, and section 1519. Section 793 refers to crimes committed as to the “gathering, transmitting, or losing defense information,” particularly as regards national defense information. Penalties for violation include fines, and/or imprisonment of up to 10 years.

The “concealment, removal, or mutilation” of documents is covered under Section 2071, which states that “Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.”

Section 2071 further states anyone in custody of such documents who “willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States.”

Section 1519 states that “Whoever knowingly alters, destroys, mutilates, conceals, covers up, falsifies, or makes a false entry in any record, document, or tangible object with the intent to impede, obstruct, or influence the investigation or proper administration of any matter within the jurisdiction of any department or agency of the United States or any case filed under title 11, or in relation to or contemplation of any such matter or case, shall be fined under this title, imprisoned not more than 20 years, or both.”

Materials marked "top secret", binders of photos, and information about
the "President of France" all made the list of inventory seized from former
US president Donald Trump's Florida estate by the FBI.  The contents of
the sought-after document were finally revealed after Trump's lawyers
decided not to block its release by a federal court. Such documents are
only meant to be stored and viewed in special secure facilities—certainly
not in golf clubs!

The search warrant was also unsealed. It confirmed federal agents have
been investigating potential crimes related to the mishandling of government
secrets.  Signed by a federal judge, the warrant cited three criminal laws,
including one contained in the Espionage Act, outlawing unauthorised
possession of certain national security information.

The property receipt, which was given to Trump's lawyers after the search,
listed about 20 boxes in total, including 11 sets of classified documents.

A violation of the Espionage Act, certainly the most serious crime listed on
the warrant, carries a maximum sentence of 10 years in federal prison. The
other laws, 2071 and 1519, make it illegal to conceal official US documents
and are punishable by up to three and 20 years in prison, respectively.

—As I've said before, in the US it is possible to run as a POTUS candidate from
   within jail.  This will in all likelihood be what Trump will be doing in 2024.

Depends on what he is charged with, if he is charged at all.

Some charges with a guilty verdict carry a clause that will forbid him from ever holding any public office again.
