Brittany Higgins is doing herself no favours by going public today in a speech about the case.

She might be charged with contempt of court.

She may get the proposed February retrial dumped.

So, who is with me on calling 'bullshit?'

The story is that some bailiff was cleaning up the jury room and accidentally knocked a box off the table.  It was plastic and a box which each juror has to put bits of paper they have...notes on evidence, whatever.

Picking up the stuff that fell out of the box, the bailiff sees the naughty material, and heads off to the Judge with it.

Now, does anyone believe that it was an accident.  OR....is this far more plausible?

The Bailiff has ready and frequent access to the jurors and the jury room.  They will and do overhear jury talks, but they are not supposed to be in the room when 'formal' discussions are being held.  But, they do get to talk directly to each juror...plenty of opportunity.

I reckon this bailiff (maybe at the Judge's suggestion....naughty) has looked for the reason which was holding up a decision.  They wanted to know what the issue was which was deadlocking finality.

Bailiff has wind that there has been talk about evidence of false complaints being discussed and has been told which juror is leading that charge.

Said bailiff has deliberately gone to that juror's box knowing naughty stuff was in it.

The accidental knock off the table is a cover up...plausible deniability.

Bailiff goes to Judge with the goods and down hill from there.

Grappler, have you been posting from the jury room or in some way, have you been tampering with this Jury?  Research on false rape complaints as found in the box is right up your alley and consistent with your posts here.

Probably was against the law for her make a public speech since the case is set for retrial in February.

Participants in a case are directed to make no public remarks. The case was not over, only this particular proceeding was dismissed.

The defence is considering placing a charge.

Higgins is caught up in the vortex of a feminine instinct for reputation destruction.

That far outweighs whatever justice can be done by a trial.

Sure, a conviction would be the ultimate prize, but there are plenty of victories to be had by continuing her crusade beyond the justice system.

'Justice, schmusitice - destroy the 'enemy' by reputation destruction. Destroy his chances of ever being employed again. Ensure that, proven guilty or not, he will be treated with suspicion and disdain.

How has Higgins' behaviour advanced the cause for victims of this very serious crime? Who among us is not a least a little cynical over her behaviour? Who would say that Higgins herself has not insinuated reasonable doubt into the minds of potential jurists?

Maybe Peter Fitzsimons could write a book about that.

She was revealing enough to the media as it suited her.

Sealing a book deal - Don't you think she'd have to give the author every detail including revealing private messages and discussions?

I omitted to add that the DPP will consider whether to go ahead, but I will be stunned if they do not.

Also, contrary to previously, Lehrmann is now on bail conditions....which is a bit of an indication about what the Judge reckons.



It's pretty normal, Aussie - no big deal.... the Judge is neutral remember - unless you have an assymetric judicial system...
