The story is that some bailiff was cleaning up the jury room and accidentally knocked a box off the table. It was plastic and a box which each juror has to put bits of paper they have...notes on evidence, whatever.
Picking up the stuff that fell out of the box, the bailiff sees the naughty material, and heads off to the Judge with it.
Now, does anyone believe that it was an accident. OR....is this far more plausible?
The Bailiff has ready and frequent access to the jurors and the jury room. They will and do overhear jury talks, but they are not supposed to be in the room when 'formal' discussions are being held. But, they do get to talk directly to each juror...plenty of opportunity.
I reckon this bailiff (maybe at the Judge's suggestion....naughty) has looked for the reason which was holding up a decision. They wanted to know what the issue was which was deadlocking finality.
Bailiff has wind that there has been talk about evidence of false complaints being discussed and has been told which juror is leading that charge.
Said bailiff has deliberately gone to that juror's box knowing naughty stuff was in it.
The accidental knock off the table is a cover up...plausible deniability.
Bailiff goes to Judge with the goods and down hill from there.
