She has a good point here:

Brittany Higgins,
Quote:
I was required to surrender:
my telephones, my passwords, messages, photos, and my data to him.

He was not required to produce his:
telephone, his passwords, messages, photos or his data.

What's her good point?

She was revealing enough to the media as it suited her.

Sealing a book deal - Don't you think she'd have to give the author every detail including revealing private messages and discussions?

Not to 3rd parties who are completely innocent and
now have their personal messages out there in public - I assume?

Fat, white, old men still defending alleged rapists rather than taking the word of the woman.

The woman is always lying, and the man is always the victim.

Would it be the same if it was their daughter?

According to a Victoria Police report, studies estimate 5% of
rape allegations are false.
[meta-analysis of seven studies in Western countries: Ferguson & Malouff, 2016].

Question:   Could Higgins be one of those 1 in 20 women who lie?

Absolutely she could.

And he could be lying too.

I don't know who's telling the truth in this case.

The thing is though, I don't automatically take sides - others on here unfortunately do, and it's always the side of the man.

I find that a little disturbing.

Being on the side of Law and Rights is not taking sides with individuals in a case.

So the accused should not have some respite from the intense glare of the media?

Damn that IS assymetric.

I assume the Judge said that and I agree with one exception.

There should be a full examination about that juror's conduct, including to find out if there was any outside assistance.  I also reckon jurors who act corruptly in this way ought be penalised with paying the costs of the abandoned Trial, AND pay damages to the 'victim' and accused, who now have to go through it all again.....Lehrmann having to double up on fees.  He now has to pay his Lawyers exactly the same as he has just paid them....or maybe he is legally aided and it is the taxpayer who is paying twice because a "Grappler" was on the Jury.

I wonder if Lehrmann realises after this that NOT getting in the box to give sworn evidence and be cross examined was a mistake.

Maybe he knows that it will be a BIGGER mistake to get in the box, ey?

OH!!!! The slander... the slander...

So, who is with me on calling 'bullshit?'

The story is that some bailiff was cleaning up the jury room and accidentally knocked a box off the table.  It was plastic and a box which each juror has to put bits of paper they have...notes on evidence, whatever.

Picking up the stuff that fell out of the box, the bailiff sees the naughty material, and heads off to the Judge with it.

Now, does anyone believe that it was an accident.  OR....is this far more plausible?

The Bailiff has ready and frequent access to the jurors and the jury room.  They will and do overhear jury talks, but they are not supposed to be in the room when 'formal' discussions are being held.  But, they do get to talk directly to each juror...plenty of opportunity.

I reckon this bailiff (maybe at the Judge's suggestion....naughty) has looked for the reason which was holding up a decision.  They wanted to know what the issue was which was deadlocking finality.

Bailiff has wind that there has been talk about evidence of false complaints being discussed and has been told which juror is leading that charge.

Said bailiff has deliberately gone to that juror's box knowing naughty stuff was in it.

The accidental knock off the table is a cover up...plausible deniability.

Bailiff goes to Judge with the goods and down hill from there.

Grappler, have you been posting from the jury room or in some way, have you been tampering with this Jury?  Research on false rape complaints as found in the box is right up your alley and consistent with your posts here.

Cheesy

I omitted to add that the DPP will consider whether to go ahead, but I will be stunned if they do not.

Also, contrary to previously, Lehrmann is now on bail conditions....which is a bit of an indication about what the Judge reckons.

It's pretty normal, Aussie - no big deal.... the Judge is neutral remember - unless you have an assymetric judicial system...

Was it against the law for her to talk?

Probably was against the law for her make a public speech since the case is set for retrial in February.

Participants in a case are directed to make no public remarks. The case was not over, only this particular proceeding was dismissed.

The defence is considering placing a charge.

Well - the comment about his data etc is apt - maybe he said something that was a giveaway..... but then - the accused has rights... under the French/European system he would have to give up his data etc.

I think that's fair enough.

How does she explain choosing to bear her soul to the media and agreeing to a book deal, yet complain that the justice system required her to do similar?

What is it about the justice system that differs from a sympathetic media pack, I wonder.

Was she so naive that she did not know how the justice system works? Did no one advise her?

Who said anything about an 'indication of guilt?'  The Judge has now concluded that he needs to have conditional bail, something he did not have previously.  What intervened?

Quote:
Under the first condition, he is not allowed to contact Ms Higgins, her partner David Sharaz, Kelly Higgins or Matthew Higgins.

The second condition states he must also inform AFP officers of his residential address or if his residential address changes.

The third condition will see Mr Lehrmann required to inform the AFP if he plans to travel overseas prior to the trial starting.

This must be done at least two weeks prior to leaving the country.
