This case is a good lesson for parents.

Teach girls not to drink to excess so they don't make poor decisions. and if they must, do so with a sober friend who will defend her to the death from making bad decisions.

Teach boys not to have sex with smelly drunk women.
Also teach boys to not drink to excess because bad stuff often happens.

You can't say that - you'll trigger a Slut Walk - abuse of police safety officers making points to school girls  - and screaming in the press about violent rape of women's rights.

You can't expect them to take any personal responsibility....

Come in the monkey gallery again... we know... we know ...

BTW my daughter went to a slut walk, but - as before - she would go to clubs and such with her very gay best friend... he'd look after her and she him.

Similar to the effect of blaming a rapist for raping someone, even after the laws have been passed that outlaw such activity. You get told not to do something. You follow the law.

Please point out to me where she was told not to talk to the media?

A woman should be able to get as drunk as she wants, and wear as little as she wants, without having to worry about being raped.

It's sad that this needs to be pointed out.

And?  The very VERY vast majority do not get raped....... so when you find the answer to cutting out crime, let us all know.  One thing for sure - it isn't in perpetrating the crimes of seeking to bash men down as a group and bringing legal and civil rights down to the level of the mob.

If nothing else, this case must be a true watershed on whether or not, as a society, we wish to retain the few flimsy safeguards there are for any accused.

Any lawyer who tells you the rights of the accused are always paramount has never been in a real court, since those rights are more demonstrated in the abuse than in the keeping.

The media could not report what she didn't say - she knew the judge said 'no commentaries' yet went ahead anyway.  That shows a contempt for the court.

I can agree that sometimes courts ... and their processes ... need to be held in contempt - as 'Hurricane' Carter said - "Yes, I do hold this court in contempt!"

We hear constantly the outrage when the 'victim' is not satisfied etc and the judiciary are pillories as a result - but take one moderate step the other way and all hell breaks loose.

*coughs*  this is like taking the moderate position that children should be left to go through puberty before they are allowed any hormones and especially surgery including tit binding (FCS) etc - when of age they can make their own decisions.... but there are reasons they cannot do so.

Are you seriously suggesting that Higgins spoke to the media openly and publicly and in seriously emotional terms if she did not expect fully that they would report that in full?

Now it's your turn - "I have no way of knowing" - in which case I refer you and mothra back to the fly on the wall in the Ministerial suite that night...how do you know what happened then?

Squid's ink will change nothing... it only blinds those who cannot see through it.....

No Lawyer is ever going to say that the rights of an accused are 'always paramount.'  Show me one Lawyer who has.

The (relevant in this case) rights are...the usual basic ones....innocent until proven guilty, proof beyond reasonable doubt, and the right to remain silent.

This is what the Judge said Grappler:

Quote:
“The fairness of his trial will undoubtedly be impaired or at risk if people continue to report on this case with the frequency that has occurred.

“I would expect after reporting the outcome of today that reporting of the matter should fall silent so the accused can have a fair trial and Ms Higgins can have some respite from the intense glare of the media that has been pervasive in this trial.”

Can you show me where that precludes Higgins from making comment to the media, or any other bastard willing to listen?

It does not matter one iota.  She was free to say what she likes to the media and for whatever reason.  It is then up to the media to decide, 100% in their hands, whether they are going to abide by what the Judge said.

Poor decisions also include having consensual sex with people you wouldn't if sober.

Also, the general risk for men when drunk is WAY more than wymmin

Was not the concern of involving the police investigating Brittany's press statement after the aborted trial the result of the judge having told her (and others) not to talk about the trial to anyone?

Ferfuzsake!  Read what the Judge said and stop making up what the Judge said!

Well the media are hedging around that point .. they won't give the precise wording..... but in their usual craven way choose to state this:-

"Much of what Ms Higgins said cannot be republished for legal reasons in light of the pending re-trial."

Fine - so she herself chose to publicly make a spectacle of herself... I trust she will accept the blame if the re-trial is canceled.
