Israeli occupation is illegal under international law: UN Commission



New York (20 October 2022) -- There are reasonable grounds to conclude that the Israeli occupation of Palestinian territory is now unlawful under international law due to its permanence and the Israeli Government’s de-facto annexation policies, according to the first report to the General Assembly issued today by the United Nations Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel.

Underlining that under international humanitarian law the occupation of territory in wartime is a temporary situation and does not deprive the occupied Power of its statehood nor its sovereignty, the three-person Commission called on the General Assembly to request an urgent Advisory Opinion from the International Court of Justice on the legal consequences of Israel’s continued refusal to end its occupation of the Occupied Palestinian Territory.

“Recent statements by the Secretary-General and numerous member States have clearly indicated that any attempt at unilateral annexation of a State’s territory by another State is a violation of international law and is null and void; 143 member States including Israel last week voted in favour of a General Assembly resolution reaffirming this”, stated Navi Pillay, Chair of the Commission. “Unless universally applied, including to the situation in the Occupied Palestinian Territory, this core principle of the United Nations Charter will become meaningless”, she added.

In reaching its findings, the Commission reviewed the policies and actions employed by the Governments of Israel to maintain the occupation, and annex parts of the Occupied Palestinian Territory. The Commission’s review was based on interviews with experts and stakeholders, and submissions received following a call for submissions issued on 22 September 2021.

The 28-page report focuses on the sustenance and advancement of the settlement enterprise, including statements made by Israeli officials indicating the intent to maintain permanent control over the land in violation of international law. The Commission concludes that by continuing to occupy the territory by force, Israel incurs international responsibilities and remains accountable for violations of the rights of the Palestinians individually and as a people.

“By ignoring international law in establishing or facilitating the establishment of settlements, and directly or indirectly transferring Israeli civilians into these settlements, successive Israel governments have set facts on the ground to ensure permanent Israeli control in the West Bank”, Ms. Pillay stated.

In producing its report, the Commission reviewed Israel’s expropriation and exploitation of land and natural resources, and Israel’s restrictive urban planning and zoning policies in the West Bank, noting that land is often confiscated for military purposes but is then used for settlement construction. The Commission reviewed statements by Israeli officials indicating that Palestinian construction is seen as an impediment to Israeli settlements, requiring action such as confiscation, demolitions and displacement. The Commission also observed similar processes in East Jerusalem where the restrictive planning and zoning regimes, which have obstructed adequate housing, infrastructure and livelihoods, have contributed to shrinking space for Palestinians.

The report also points to Israeli Government policies which have had a serious and multi-faceted impact on all areas of Palestinian life, including access to clean and affordable water, which has impacted the entire Palestinian agricultural sector, limiting opportunities for livelihoods particularly affecting women.

“There is so much ‘silent harm’ and psychological trauma, that may not be immediately apparent, resulting from the erosion of economic, social and cultural rights. These debilitating processes have severe short and long-term consequences and must be urgently addressed”, said Commissioner Miloon Kothari.

The Commission dedicated a significant part of its report to reviewing the impact of Israel’s occupation and de-facto annexation policies on Palestinian human rights, noting the coercive environment intended to force Palestinians to leave their homes and alter the demographic composition of certain areas. To this effect, the Commission reviewed the demolition of homes and destruction of property, the excessive use of force by security forces, mass incarceration, settler violence, restrictions of movement, and limitations on access to livelihoods, basic necessities, services and humanitarian assistance.

The Commission emphasised that this ongoing coercive environment has fragmented Palestinian society and ensured that Palestinians are unable of fulfil their right to self-determination among other rights. The Commission also noted the extremely harmful impact of the air, land and sea blockade of Gaza on Palestinian human rights.

The report outlines a specifically damaging impact on children, who experience constant military presence, arrest and detention, frequent attacks and acts of violence, restrictions on movement, home demolition and destruction of infrastructure and property...

The West Bank and Gaza were not the territory of another State in 1967 when Israel occupied them.  They were the occupied territories - not  States - by other States, Jordan and Egypt respectively, which together with Syria, attacked Israel in the 1967 war and lost. These Occupied Territories were then occupied by Israel.

The last time they were part of a State was when they were part of the Ottoman Empire which, obviously, no longer exists.


Muslim lands are 29.13 million sq km, about 20% of the total land area of Earth.  The WB and Gaza are about 6,100 sq kms. Or about 0.03% of the total Muslim lands.

Then there's the long-standing Geneva Convention.

When the Moslems get their 'Messiah' out of France, which they will burn (politics, military, religion) to the ground like a Cathedral.

Population transfers would be illegal if the Occupied Territories had been the territories of a State or States at the time of their occupation by Israel.
If they has occupied, say, Lebanon.

But the Occupied territories were not part of any state since the end of the Ottoman Empire, the last State they formed part o since then they have been occupied by various States but formed no part of any.

The West Bank and Gaza were not the territory of another State in 1967 when Israel occupied them. 


That's because  Israel had unilaterally proclaimed its existence in 1947, before the UN had been able to  establish two states side by side, due to warring between the Arabs and the Jews.

Merely a continuation of the unresolved 1947 situation.

True, but in 1947 the UN voted to partition the British Palestine mandate set up after the collapse of the Ottoman empire in 1918 (before the UN existed).

The ongoing problem arose because the UN could not establish the 2 states as envisioned by the UN, hence the ongoing war and illegal occupation.

In the 1990s, Israeli sociologists and scholars in other academic fields have focused more attention than ever before upon the social effects in Israeli society of Jewish fundamentalists. The overwhelming opinion of these scholars is that the adherents of Jewish fundamentalism in Israel are hostile to democracy .The fundamentalists oppose equality for all citizens, especially non-Jews and Jewish "deviants" such as homosexuals. The great majority of religious Jews in Israel, influenced by fundamentalists, share these views to some extent. In a book review published on October 14, 1998, Baruch Kirnrnerling, a distinguished Israeli sociologist, citing evidence from a study conducted by other scholars, commented:

The values of the [Jewish] religion, at least in its Orthodox and nationalistic form that prevails in Israel, cannot be squared with democratic values. No other variable—neither nationality, nor attitudes about security, nor social or economic values, nor ethnic descent and education—so influences the attitudes of [Israeli] Jews against democratic values as does religiosity.

Seffi Rachlevsky in his book states that Rabbi Kook, the Elder, the revered father of the messianic tendency of Jewish fundamentalism (who is featured in our book), said "The difference between a Jewish soul and souls of non-Jews—all of them in all different levels—is greater and deeper than the difference between a human soul and the souls of cattle." ... Rachlevsky pointed out that Rabbi Kook's entire teaching was based upon the Lurianic Cabbala, the school of Jewish mysticism that dominated Judaism from the late sixteenth to the early nineteenth century. One of the basic tenants of the Lurianic Cabbala is the absolute superiority of the Jewish soul and body over the non-Jewish soul and body. According to the Lurianic Cabbala, the world was created solely for the sake of Jews; the existence of non-Jews was subsidiary. If an influential Christian bishop or Islamic scholar argued that the difference between the superior souls of non-Jews and the inferior souls of Jews was greater than the difference between the human soul and the souls of cattle, he would incur the wrath of and be viewed as an anti-Semite by most Jewish scholars regardless of whatever less meaningful, positive statements he included...

We have written this book in order to reveal the essential character of Jewish fundamentalism and its adherents. This character threatens democratic features of Israeli society. We believe that awareness is the necessary first step in opposition...

We believe that a critique of Jewish fundamentalism, which entails a critique of the Jewish past, can help Jews acquire more understanding and improve their behavior towards Palestinians, especially in the territories conquered in and occupied since 1967. We hope that our critique will also motivate other people in the Middle East to engage in criticism of their entire past in order to increase their knowledge of themselves and improve their behavior towards others in the present. All of this could constitute a major factor in bringing peace to the Middle East.

“For over 55 years, the Israeli military occupation has prevented the realisation of the right to self-determination of the Palestinian people, violating each component of that right and wilfully pursuing the “de-Palestinianisation” of the occupied territory,” said Francesca Albanese, UN Special Rapporteur on the situation of human rights in the Palestinian Territory occupied since 1967, in a report to the General Assembly.

Albanese’s report found that the Israeli occupation violates Palestinian territorial sovereignty by seizing, annexing, fragmenting, and transferring its civilian population to the occupied territory. The occupation endangers the cultural existence of the Palestinian people by erasing or appropriating symbols expressing Palestinian identity and violates Palestinians’ ability to organise themselves as a people, free from alien domination and control, by repressing Palestinian political activity, advocacy and activism.

“This is, in essence, proof of the intent to colonise the occupied territory, and manifests Israel’s policies of domination through the “strategic fragmentation” of the occupied territory,” the expert said.

According to the report, the international community’s political, humanitarian, and economic approaches to resolving the Israel/Palestine “conflict” have failed without exception.

“These approaches conflate root causes with symptoms and serve to normalise Israel’s illegal occupation instead of challenging it. This is immoral and renders the regulatory and remedial function of international law futile,” Albanese said.

The report calls for “a paradigm shift”, which entails moving away from the narrative of “conflict” between Israel and the Palestine and recognising Israel’s “intentionally acquisitive, segregationist and repressive settler-colonial occupation.”

Albanese urged the international community to formally acknowledge and condemn the settler-colonial nature of the Israeli occupation, demand an immediate end to the illegal occupation, and call on Israel to withdraw its military presence and support to Israeli civilians in the colonies. She cautioned all States against making withdrawal subject to negotiations between Israel and Palestine.

“Meaningful discussions on a political solution for Palestine can only begin when the illegal occupation is dismantled once and for all,” the expert said.

Yes. The UN of course was crippled from the start by adopting the obsolete doctrine of absolute national sovereignty, as well as the absurd doctrine  of legal ("defensive") war, when the whole Charter of the UN was supposed to eradicate the scourge of war. 

Doc Evatt resisted adoption of the veto by members of the (so-called) "Security" (!) Council, but he was overruled.  Hence as many people have been killed in wars since WW2 as were killed in that war itself.

As to "human rights" abuses, every nation commits them; the West particularly in the area of systemic economic abuse, leading to entrenched poverty in otherwise rich nations, in violation of UN HDHR article 23.

The US of course is trying to lay the blame for the present collapse in "peace" negotiations - which "everyone has agreed to" - on Hamas.

Hamas have every right to think stage 3 of the US -brokered plan won't ever be agreed to by Israel's RW government. 

In  other words, the US 3-stage plan: ie, ceasefire, hostage and prisoner swap, and establishment of 2-states -  is a fraud, without specifying  the actual date for the 3rd stage to be implemented (ie the now decades old UN res 242 which was always blocked by the US).

ICJ Declares Israel's Occupation Illegal

The International Court of Justice (ICJ) yesterday issued its advisory opinion in its case examining the legal consequences of Israel’s occupation of Palestinian territory, ruling that Israel’s persistent occupation and discriminatory policies have no legal justification and therefore violate international law.

The ICJ had already ruled in 2004 that all of the Gaza Strip and the West Bank, including East Jerusalem, remained “occupied territories” under international law and therefore that Israel’s settlement regime and the separation wall it was constructing within the West Bank were illegal.

In that prior ruling, the ICJ, also known as the World Court, affirmed “the illegality of territorial acquisition resulting from the threat or use of force”.

That is a principle of international law emphasized in United Nations (UN) Security Council Resolution 242 from November 22, 1967, which in the wake of the June “Six Day War” legally required Israel to withdraw its forces to armistice lines drawn in 1949 after Zionist forces established the “Jewish state” of Israel by ethnically cleansing most of the Arab population from their homes in Palestine.

The ICJ’s ruling for the more recent case goes further than its 2004 judgment by concluding that Israel’s prolonged occupation of Palestinian territory is itself inherently illegal.

The ICJ case is formally an inquiry into the “Legal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalem”, which the court opened at the request of the United Nations (UN) General Assembly in December 2022.

This case is separate from a pending case brought before the ICJ on December 29, 2023, by the government of South Africa, which charged Israel with violating the 1948 Convention on the Prevention and Punishment of the Crime of Genocide (or the Genocide Convention) for its murderous military operation in the Gaza Strip ongoing since October 2023.

The US government under the administration of President Joe Biden has also violated the Genocide Convention for its complicity in Israel’s genocide.

On January 26, 2024, the ICJ ruled that Israel was perpetrating a plausible genocide in Gaza and called on Israel to comply with its obligations under the Genocide Convention; and on May 24, the court issued additional provisional measures ordering Israel to halt its military operation in the city Rafah in Gaza.

As with its January ruling, Israel proceeded to ignore the ICJ order on May 24.

While the ICJ is a UN body that has no authority to enforce its legal judgments, the prosecutor of the International Criminal Court (ICC), a separate body at the Hague in the Netherlands that was established independently from the UN by the Rome Statute in 1998, has concomitantly sought arrest warrants for Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant for “crimes against humanity”.

In its ruling issued yesterday, the ICJ determined that Israel’s continued occupation of Gaza and the West Bank, including East Jerusalem, is “unlawful”, and that Israel is therefore obligated under international law to end its occupation “as rapidly as possible”.

Reaffirming its 2004 advisory opinion, the ICJ ruled that Israel “is under an obligation to cease immediately all new settlement activities, and to evacuate all settlers from the Occupied Palestinian Territory”.

Additionally, Israel is obligated “to make reparation for the damage caused to all the natural or legal persons concerned in the Occupied Palestinian Territory”.

The ICJ also emphasized the legal obligation of UN member states to not act complicitly in Israel’s illegal occupation.

That applies to the US government, which has long maintained a policy of supporting Israel’s crimes against the Palestinians, including by means of the US-led so-called “peace process”, which was always aimed at blocking implementation of the two-state solution to the Israeli-Palestinian conflict.

The aim of the “peace process”, which was premised on a rejection of international law, is not to be confused with the two-state solution, which is premised on the applicability of international law to the conflict.

As another example of US complicity in Israel’s violations of international law, in 2017, the Donald Trump administration moved the State Department’s Israeli embassy from Tel Aviv to occupied Jerusalem, which was a violation of UN Security Council resolutions prohibiting UN member states from taking actions to prejudice Palestinians’ rights in the occupied territories, including East Jerusalem.

While a welcome development to those concerned with peace and justice, it is regrettable that it took until July 2024 for the world’s highest governmental authority on matters related to international law to explicitly inform the public that Israel has a legal obligation to immediately withdraw its military from the Gaza Strip and the West Bank, including East Jerusalem.

Israeli Jews don't even realize what a mess they created for themselves.

Once the ICJ Decision is promulgated in the UN countries will be bound to shun Israel and treat it as a pariah state until it complies with the ICJ ruling.

The US will not be able to help Israel out of this hole because any entities that help Israel commit crimes will themselves be guilty of the crime.

Israeli Jews with half a brain will be leaving Israel.

No rational investor will be investing money in Israel.

UN Resolution 181 neither partitioned Palestine nor conferred any legal authority to the Zionists for their unilateral declaration of Israel's existence.

Don’t be fooled. The ruling by the International Court of Justice (ICJ) on 19 July that Israel’s occupation of Palestine is unlawful is earth-shattering. Israel is a rogue state, according to the world’s highest court.

For that reason, the judgment will be studiously ignored by the cabal of western states and their medias that for decades have so successfully run cover for Israel...

Western politicians and columnists will keep emphasising that the World Court is offering nothing more than an “advisory opinion” and one that is “non-binding”.

What they won’t point out is that this opinion is the collective view of the world’s most eminent judges on international law, the people best positioned to rule on the occupation’s legality.

And it is non-binding only because the western powers who control our international bodies plan to do nothing to implement a decision that doesn’t suit them.

Nonetheless, the ruling will have dramatic consequences for Israel, and its western patrons, even if those consequences will take months, years or even decades to play out...


Apartheid rule

The World Court’s ruling is most significant in that it permanently blows apart western states’ cover story about Israel.

The judges point out that Israel’s permanent occupation of the territories, and its transfer of Jewish settlers into them, has necessitated the development of two separate and distinct systems of laws.

One is for the Jewish settlers, enshrining for them the rights enjoyed by Israelis. Palestinians, by contrast, must submit to the whims of an alien and belligerent military regime.

There is a word for such an arrangement: apartheid.

Over the past decade, a consensus had already emerged in the world’s human rights community - from Amnesty International to Human Rights Watch - that Israel was an apartheid state.

Now the world’s highest judicial body has declared that it agrees.

Apartheid is a crime against humanity. This means that Israeli officials are war criminals, quite aside from the crimes they are currently committing in Gaza.

That was why the Israeli media reported panic inside the Israeli government at the ICJ ruling.

Officials fear that it will leave the International Criminal Court, its sister court, with no option but to issue arrest warrants against Netanyahu and his defence minister, Yoav Gallant, as already requested by its chief prosecutor.

It is also likely to strengthen the ICC’s resolve to prosecute more senior Israeli officials for crimes associated with Israel’s settlement programme.

A former Israeli foreign ministry official told the Haaretz newspaper that the World Court ruling had punctured Israel’s claim to be a western-style state: “The democratic aura is no longer protecting us as it did before."

In the area of Judah in the central hills, Benjamin and Jerusalem, the population was approximately 110,000. By the early sixth century, Ofer's survey results suggest that around 100,000 lived in the kingdom of Judah, with the population in the central hills, Benjamin and Jerusalem about 69,000.

A.  because none of its countries want to waste their troops' lives there when the HAM-ASSES continue to play up.... if Israel stopped fighting, it would be driven into the sea - if the Arabs stopped fighting, there would be peace and separation.

Many of you are both sick and thick in the head.  Close down all pro-"Palestinian" riots - maybe 10% are worth saving for the re-education camps... support of a terrorist organisation should mean instant removal of your student rights.... that'd shut 'em up...

That's why war is still the method of dispute settlement between nations, negating the UN Charter itself, with the UNSC reduced to  "grabbing the moral high ground"  -while babies are slaughtered by grown men.

The Jews had a nation and sovereignty - not just a few wandering sub-tribal groups that never numbered more than 20-30 at any one time, and that was where the food was good, say - down on the coast.

The Aborigines were never driven out of Australia... they were partially assimilated until the useless tools came along and filled their ears with 'rights' and other nonsense... the Jews were forced out and now they've taken it back with world backing.  You have a problem with that?

YOU are actually advocating that Israel either go down or literally smash all the rest to ensure its peace and survival.  YOU and your kind are the war-mongers and troublemakers and are causing the wars on wars there by encouraging the Arabs to wage wars they can't win - but there are always costs in human lives.  Don't encourage the rat-bags too much in the Arab world.... most of them can't think that well....  Allahu Akbar.... at Sydney U of course they are Yahoo Akbars and should have their student privileges withdrawn NOW!

Oh, lookee there -- there's a river and a sea... all Israel ... so when the Gazans carry on about 'from the river to the sea' they're not even talking about their own borders ... they ain't got no river to the East... part of Jordan has the river as border.... hence The West Bank ... and they ain't got the balls to attack Israel.... apart from a few cowardly rockets and whining ....

THE UN’S PARTITION PLAN

An inexperienced UN, just two years old in 1947, entrusted the question of the future of Palestine’s fate into the hands of a Special Committee for Palestine, UNSCOP, none of whose members turned out to have any prior experience in solving conflicts or knew much about Palestine’s history...

The report UNSCOP came up with in the end envisaged that the two future states would be identical except for their internal demographic balance, and it therefore stressed the need for both entities to adhere to liberal democratic precepts. On 29 November 1947 this became General Assembly Resolution 181. It is clear that by accepting the Partition Resolution, the UN totally ignored the ethnic composition of the country’s population...

Partitioning the country – overwhelmingly Palestinian – into two equal parts has proven so disastrous because it was carried out against the will of the indigenous majority population. By broadcasting its intent to create equal Jewish and Arab political entities in Palestine, the UN violated the basic rights of the Palestinians, and totally ignored the concern for Palestine in the wider Arab world at the very height of the anti-colonialist struggle in the Middle East. Far worse was the impact the decision had on the country itself and its people. Instead of calming the atmosphere, as it was meant to do, the resolution only heightened tensions and directly caused the country to deteriorate into one of the most violent phases in its history.


THE ARAB AND PALESTINIAN POSITIONS

The Palestinian leadership decided from the start to boycott the UN proceedings. This decision features often in contemporary Israeli propaganda as proof that the Palestinians themselves – not Israel – should be held responsible for the fate that befell them in 1948. Palestinian historiography has successfully fended off such accusations by exposing the extent to which the procedures the UN opted to follow were unjust and illegal, and by exploring the raison d’être behind the establishment of UNSCOP.

By opting for partition as its primary objective, the UN ignored a basic principled objection the Palestinians were voicing against the plan, with which mediators had been familiar since Britain made the Balfour Declaration thirty years earlier. Walid Khalidi succinctly articulated the Palestinian position as follows: ‘The native people of Palestine, like the native people of every other country in the Arab world, Asia, Africa, America and Europe, refused to divide the land with a settler community.’

Within a few weeks of UNSCOP starting its work, the Palestinians realised the cards had been stacked against them: the final result of this process would be a UN resolution on partitioning the country between the Palestinians, as the indigenous population, and a settler colony of newcomers, many of whom had arrived only recently. When Resolution 181 was adopted in November 1947, their worst nightmare began to unfold in front of their eyes: nine months after the British had announced their decision to leave, the Palestinians were at the mercy of an international organisation that appeared ready to ignore all the rules of international mediation, which its own Charter endorsed, and was willing to declare a solution that in Palestinian eyes was both illegal and immoral. Several leading Palestinians at the time demanded that its legality be tested in the International Court of Justice (founded in 1946), but this was never to happen. One does not have to be a great jurist or legal mind to predict how the international court would have ruled on forcing a solution on a country to which the majority of its people were vehemently opposed.

The injustice was as striking then as it appears now, and yet it was hardly commented on at the time by any of the leading Western newspapers then covering Palestine: the Jews, who owned less than six per cent of the total land area of Palestine and constituted no more than one third of the population, were handed more than half of its overall territory. Within the borders of their UN-proposed state, they owned only eleven per cent of the land, and were the minority in every district. In the Negev – admittedly an arid land but still with a considerable rural and Bedouin population, which made up a major chunk of the Jewish state – they constituted one per cent of the total population...

Again in the words of Walid Khalidi, Resolution 181 was ‘a hasty act of granting half of Palestine to an ideological movement that declared openly already in the 1930s its wish to de-Arabise Palestine.’ And thus Resolution 181’s most immoral aspect is that it included no mechanism to prevent the ethnic cleansing of Palestine...

The expected Arab and Palestinian rejection of the plan allowed Ben-Gurion and the Zionist leadership to claim that the UN plan was a dead letter the day it was accepted – apart, of course, from the clauses that recognised the legality of the Jewish state in Palestine. Its borders, given the Palestinian and Arab rejection, said Ben-Gurion, ‘will be determined by force and not by the partition resolution.’ As would be the fate of the Arabs living in it.

You are as mentally incompetent as Fraudiver; you look at names and borders on a map which have long disapppeared in the course of history. 

That 'Kingdom of Israel' (shown on your map)  - already separated  from the 'Kingdom of Judea' because of civil war among the Jews after the short-lived Israeli 'golden age' under King Solomon (ruled  c.950 BC) , was soon subsumed by the Assyrian Empire c.720 BC.  (Judea itself fell to the Babylonian Empire c. 600 BC).

Indeed, the operative word being "had"; in fact, Israel  at its peak under King Solomon no doubt existed 'from the river to the sea',  before it split into 2 kingdoms:

The  kingdom of Israel divided into two states (following  Solomon's death c.930 BC) and lasted from approximately 922 to 721 BC

While two southern tribes, Judah and Benjamin, remained loyal to the memory of King David  (hence "Judea"); the northern ten tribes, collectively called "Israel", revolted against  Solomon's son, Rehoboam.

Refuted above: you are ignoring the incompetence of the UN to enforce its own laws, and are now complicit in the slaughter of children.

And the fact you reckon students at  Kent State
Uni (who were protesting the slaughter of civilians in Vietnam) deserved to be murdered by the National Guard, exposes YOUR war-mongering mentality. 

Men will disagree; hence the UN Charter is supposed to "save mankind from the scourge of war..."

But your delusional, instinct-driven, 'freedom values'  ideology forced the veto onto the UNSC, rendering it useless as an international law-enforcer.
